PETITION FOR ISSUANCE OF LOST OR DESTROYED TITLE
NOTIFICATION TO THE
REGISTER OF DEEDS
Notify the concerned register of
deeds of the loss of the owner’s
duplicate certificate of title by
filing an affidavit of loss with
the concerned register of deeds
detailing the circumstances
surrounding the loss of the title.
FILING OF THE
PETITION
File a petition with the court,
particularly the Regional Trial
Court of the place where the
land is located,
HEARING
There will be a hearing to
give the petitioner the
opportunity to establish the
fact of loss of the owner’s
duplicate certificate of title
and allow the court to
receive and evaluate the
presented evidence.
ISSUANCE OF A NEW
TITLE
Should the court grant the
petition, it shall order the
issuance of a new title which
will contain a memorandum
of the fact that it is issued in
place of the lost duplicate
certificate.
