nominated as members of the Chemical Review Committee
Note by the Secretariat
1. In paragraph 6 of decision RC-6/3 on the operation of the Chemical Review Committee, the
Conference of the Parties to the Rotterdam Convention on the Prior Informed Consent Procedure for
Certain Hazardous Chemicals and Pesticides in International Trade appointed the 14 designated
experts to serve as members of the Committee for the terms of office commencing on 1 October 2011.
The curricula vitae of those members are set out in document UNEP/FAO/RC/COP.6/INF/3/Rev.1.
2. In paragraphs 7 and 8 of the same decision, the Conference of the Parties extended the terms of
office of the current 17 members of the Committee from 30 September 2013 until 30 April 2014 and
those of the other 14 members of the Committee from 30 September 2015 until 30 April 2016, and
decided that future terms of office would commence on 1 May of a given even numbered year and end
on 30 April four years later.
3. Furthermore, in paragraph 9 of the same decision, the Conference of the Parties adopted the
list of 17 parties to nominate Committee members for terms of office commencing on 1 May 2014 as
set out in the annex to that decision. The Latin American and Caribbean group agreed that Antigua and
Barbuda, the Dominican Republic and Honduras would nominate experts to serve as members of the
Committee from the Latin American and Caribbean region. By the close of the sixth meeting of the
Conference of the Parties, the three parties had not nominated those experts. As agreed by the
Conference of the Parties, the three parties subsequently communicated their nominations to the
Secretariat.
4. In addition, in accordance with the procedure provided in paragraph 8 of decision RC-1/6,
during the period between the Committee’s eighth and ninth meetings, Mr. Ram Niwas Jindal (India)
was designated by his Government to replace Mr. Manoranjan Hota (India) and Mr. Arturo Gavilán
García (Mexico) was nominated by his Government to replace Ms. Leonor Cedillo Becerril (Mexico).
5. A table summarizing the rotation of the membership of the Committee, including the names of
the nominated members, is set out in annex I to the present note. The contact information of the
current and nominated members is set out in annex II and the curricula vitae of the nominated
members are compiled in annex III to the present note. The annexes have not been formally edited.
The nominations of members are subject to confirmation by the Conference of the Parties at its
seventh meeting, to be held in 2015.

6. The term of office of the current Chair of the Committee, Ms. Hala Sultan Saif Al-Easa
(Qatar), will expire on 30 April 2014. As requested by the Conference of the Parties in paragraph 10 of
decision RC-6/3, the Committee at its ninth meeting may wish to identify a Chair of the Committee on
an interim basis for its tenth meeting. The Conference of the Parties shall confirm the election of the
Chair at its seventh meeting.

PUBLIC SERVICE EXPERIENCE:
1. Former Position (Executive Level 2):
Manager, Risk Assessment and Policy Section, Chemicals and the Environment Branch, Environment Australia (April
1993 to April 2001, plus in an acting capacity from July 1990 to August 1992). The description below also includes
my previous lower level positions in this area from October 1984.
The principal duties I undertook in these positions were:

Industrial chemicals assessment


Supervision and assessment of industrial chemicals firstly under the voluntary Interim Notification Scheme (INS),
but for the final nearly 11 years under the mandatory National Industrial Chemicals Notification and Assessment
Scheme (NICNAS). I became acting Director of the Section the day before the National Industrial Chemicals
Notification and Assessment Scheme commenced in July 1990. Since that time I was responsible for ensuring that
satisfactory environmental reports for over 1000 chemicals were completed within statutory deadlines. These
reports involve assessing the potential risk of chemicals from an environmental viewpoint throughout their life
cycle ie manufacture, transport, use, release into the environment, fate and pathways once released, effects on
biota (ecotoxicity), disposal; and recommending relevant control measures. In addition I also supervised the
environmental assessments of a smaller number of selected priority existing chemicals, some of which have been
in the assessments conducted in the OECD’s HPV/SIDS program.
Agricultural and veterinary chemicals assessment
From mid-1986 I was involved with the similar assessment and supervision of agricultural chemicals and veterinary
drugs. I was integrally involved in the setting up, planning and conducting of these assessments and since this time all
new active constituents have been assessed for their environmental impact. Over 200 of these reports have been
completed. I was also involved with the assessment of existing pesticides on a priority basis, and over 10 environmental
reports are now publicly available for some very important chemicals such as endosulfan, atrazine, parathion methyl,
aldicarb and chlorpyrifos.

Development of methodologies for environmental assessment of chemicals


I was closely involved with the development of methodologies used for the environmental assessment of these
chemicals. Initially this included helping the planning, organising and running of the Workshop on the Environmental
Assessment of Chemicals held in Canberra in May 1986, and also attending, as the Australian representative, the OECD
Workshop on Practical Approaches for the Assessment of Environmental Exposure held in Vienna in April 1986. The
principles obtained from these, as well as other available material, were very important in the subsequent development of
the relatively low tech Australian approach. I was the Australian representative at the OECD Hazard/Risk Assessment
workshop held in London in May 1994. I was also invited by the organisers to deliver a plenary lecture entitled
“Environmental Fate, a Down Under Perspective” at the IUPAC 9th International Congress on Pesticide Chemistry held
in London in August 1998. In respect of the more advanced probablistic risk assessment I was a main speaker at the
May 1999 Canberra workshop entitled Ecological Risk Assessment of Pesticides in the Aquatic Environment. I was also
the chief organiser of the successful Probabilistic Environmental Risk Assessment workshop held in Canberra on 11
February 2001 in conjunction with the Australasian Society for Ecotoxicity’s Conference “Envirotox 2001”.

Development of agvet and industrial chemicals legislation/policy advice


From the start I was involved in the formulation/advice upon policy on the assessment of chemicals, particularly in
relation to the proposed mandatory notification and assessment scheme for industrial chemicals. This included a revised
proposal of the data requirements and treatment of polymers. I was also closely involved with the drafting of the
Industrial Chemicals (Notification and Assessment) Bill 1989, as well as co-ordinating the lodging of the Cabinet
Submission for this Scheme. Since that time I was the main representative of the environment department in meetings
looking at policy aspects relating to industrial chemicals regulation, and was intricately involved with two reviews of
operations of the scheme as well as proposed amendments to the Act resulting from these.
In addition to supervision of our agvet chemicals assessments I was the chief environmental representative in
negotiations concerning National Registration of these chemicals during the early 1990s, ensuring that our views were
heard and incorporated. This included commenting on the draft National Registration legislation, as well as being
involved in reviews of this program since it became law. I was also heavily involved in the Government's response to
the Senate Select Committee's report on the use of Agricultural and Veterinary Chemicals in Australia. One of the main
recommendations relevant to us was the need for an environmental monitoring and wildlife incident reporting scheme
for which I subsequently commissioned and supervised a consultant’s report aimed at providing options as to how this
might be achieved.
I also represented the environment department on many States/Commonwealth committee meetings related to the
National Registration Scheme. One of these was representing all Australian environment agencies on behalf of
ANZECC on the Agricultural and Veterinary Chemicals Policy Committee (AVCPC). I was also closely involved with
one of AVCPC’s major achievements, the National Strategy for Agricultural and Veterinary Chemicals, being both a
member of the drafting working group and the working group trying to implement this strategy.

International chemicals work


During my period as acting Director I worked very hard at raising Australia's international chemicals profile, particularly in
the OECD Chemicals Programme. I attended the OECD Joint Chemicals meeting in November 1990 as the first Australian
based representative for some time, which was soon followed by heading a larger delegation, in particular when we became
a co-sponsor of the Clearing House for Lead Risk Reduction. Australia is now actively involved in nearly all aspects of the
chemicals programme.
As the departmental interests in chemicals expanded my responsibilities became largely to run the domestic
assessment program, though I maintained a strong interest in OECD activities. This includes having been the
National Test Guidelines co-ordinator from 1990 to 1999, and attending the OECD workshops on Monitoring of
Industrial Chemicals in the Environment held in Berlin in May 1998 and Aquatic Risk Indicators held in
Braunschweig in June 1999. I was also very keen to further the exchange of environmental pesticide assessment
reports (with the ultimate aim of worksharing), and informally contacted authorities in both Canada and the UK aimed
at making more progress in this area. We have also endeavoured to draft our reports in the accepted OECD format.
In addition I was Australian environment delegate on the POPs Criteria Expert Group (CEG) and had a major input
into the Australian position for the two meetings that were held during 1998-9, and subsequently maintained an input
into the Australian briefings for the POPS INC meetings. I have also had an involvement (through the Australian
briefing process) in the IMO’s proposal to draw up an international instrument aimed at banning the use of anti-
foulant paints, principally tributyltin, as well as the assessment of alternatives.

Other responsibilities/interests
Over this time, as well as supervising up to 17 staff, I also had a great interest in other environmental chemicals issues
such as dioxins and other persistent organochlorines, and assessment of the proposal to destroy US stocks of chemical
weapons in a purpose built incinerator on Johnston Atoll in the Pacific. Other duties I performed include preparation
of routine or ministerial correspondence, briefings for senior management, particularly in relation to OECD chemicals
activities, preparation and collation of co-ordination comments on Cabinet Submissions and analysis of consultants'
bids for projects. I have also been involved in the UNCED and ESD processes, as well as with the initial development
of the National Pollutants Inventory in Australia.

2. Current Position
Principal Peer Reviewer, Risk Assessment and Policy Section (1 May 2001 to present).
My main task in this position has been to act as “peer reviewer” for the major assessments conducted for the National
Industrial Chemicals Notification and Assessment Scheme (NICNAS) and the National Registration Authority (NRA),
ensuring these are in a very advanced stage prior to consideration and sign off by the Section Director. This has relied
on my extensive experience gained previously while managing the Section. I have also undertaken assessment work,
including some permit applications and finalising both reports for registration of chemicals and those assessed under
Chemical Review due to the absence of staff on leave etc. Major assessments I have assessed/peer reviewed include
decabromo diphenylether (Deca-BDE), HBCD, perfluorobutane sulfonate (PFBS) and perfluorohexanoic acid
(PFHxA, replacements for PFOS and PFOA chemistry, respectively), as well as diuron, and fipronil. I have also been
closely involved with the international assessment of new pesticides under the Global Joint Review (GJR) process
since this started in the mid 2000s, not only peer reviewing but also undertaking some of the actual reviews of the
study summaries myself.
Due to my corporate knowledge and interests I have also continued to make contributions to other areas of both
chemicals assessment and policy, as needed. For example, in this time I have provided detailed comment on briefings
for the POPs Review Committee (POPRC) risk profiles for Annex E, in particular for lindane, endosulfan (including
the review and negotiations to cancel all Australian registrations) and HBCD, as well as commenting on a number of
documents involved with the Risk Management Evaluation under Annex F. I also drafted the environmental
persistence, bioaccumulation and toxicity (PBT) criteria for Australia, which are now routinely employed in our risk
assessments to ensure that new chemicals with POPs-like characteristics are not introduced into the Australian market
place.
In addition I peer reviewed the draft Environment Protection and Heritage Council’s/NChEM’s Risk Assessment
Guidance Manuals for both agricultural and veterinary chemicals and for industrial chemicals to ensure these
accurately reflected our current or future environmental risk assessment practices in this area. I also played a very
similar role in the updating of the Environmental Requirements Part of the AgMORAG, which sets out the
environmental requirements for applicants submitting proposals for registrations of pesticides. I was also the
Australian delegate on the VICH Working Group on Ecotoxicity/Environmental Impact Assessment, which developed
guidelines aimed at harmonising the environmental data requirements for veterinary drugs, attending 5 meetings from
November 2000 to September 2004. When things came to an impasse at the beginning of 2002, I offered and was
accepted to act as editor of the document. In this way I was able to co-ordinate and summarise all the views and had a
major impact on the successful delivery of a final document, which was accepted by all participating regions in
October 2004.

As an evaluator at NBSL I assessed the chemical and quality control aspects of submissions supplied by
manufacturers in support of applications to import pharmaceutical products, in order to conduct clinical trials or to
market new drugs or formulations. This gave me a broad background in both pharmaceuticals and the pharmaceutical
industry. The position involved examination of the submissions followed by written reports but no actual laboratory
work. I also served as chemistry and pharmacy adviser to the anti-cancer sub-committee of the Australian Drug
Evaluation Committee (ADEC).

Long engaged in technical support and research on China chemical environmental management. Since 2000,
undertaken independently the negotiation of the Rotterdam Convention and technical support for the implementation
of the Convention: participated in three sessions of Intergovernmental Negotiating Committee (INC9-INC11), six
Conferences of the Parties (COP1-COP6), and ten sessions of Chemical Review Committee (ICRC4-ICRC5 and
CRC1-CRC8); attended the Chemical Review Committee sessions on behalf of China and is responsible for the
specific implementation of the Rotterdam Convention in China. Participated in drafting the legislations and standards
on China chemical environmental management. Takes charge of various research projects on China chemical
environmental management. Acted as the expert on establishment and revision of China Hazardous Chemicals
Catalogue and Chemical Embargo Catalogue through Inland River. Joined the international projects in cooperation

Mr. Ram Niwas Jindal (India)

Mr. Ram Niwas Jindal has done his graduation in Engineering in 1981 and post
graduation in Environmental Engineering (1986) from Delhi College of Engineering
followed by LL.B. from University of Delhi (1989). Mr. Jindal has been trained in India as
well abroad.

Mr. Jindal has worked with the Central Water Commission, Department of
Environment (Government of Delhi), Delhi College of Engineering and Central Pollution
Control Board apart from working in Iraq for a railway project. Mr. Jindal had been a
visiting faculty to School of Planning & Architecture, WWF (India), Delhi College of
Engineering, Northern India Engineering College, Delhi Technological University and CBP
Government Engineering College.

Mr. Jindal at present is working with the Ministry of Environment & Forests in India,
in the capacity of Additional Director and worked extensively on policy matter associated
with air pollution, noise pollution and setting of standards. Mr. Jindal has been associated
with path breaking studies such as ‘Source Apportionment Studies for Particulate Matter’ in
six cities in India and Computation of Societal Risk, Abatement Cost and Long Run Marginal
Financial Cost with regards to Dioxin and Furans emission standards. He has represented
Government of India in Transboundary Movement of Air Pollution under Male’ Declaration.
Now, he is dealing in issues related with hazardous chemicals. Mr. Jindal has compiled
Material Safety Data Sheets for all 680 chemicals with the help of NCL, Pune which are
regulated under Manufacture, Storage and Impact of Hazardous Chemical Rules, 1989.

Mr. Jindal has travelled to Bhutan, Bangladesh, Sri Lanka, Thialand, Iraq, Germany,
U.K., France, Russia, Ukraine, USA and Switzerland.
