In an Executive Summary
furnished this writer, Malaya
explained that “There is no
need to come up with an en-
tirely new Constitution. The
1987 Constitution has many
good provisions that need not
be changed. Thus, we have
taken a “surgical” approach
towards amending the fun-
damental law, concentrating
only on the articles and pro-
visions that would enshrine
federalism into the Constitu-
tion and strengthen our public
institutions, among others.”

EDITORIAL
The Shift
to Federalism
With the submission to Congress last week of
the proposed amendments to the Constitution
which will adopt a Federal form of government
in place of the current system, we should expect
the debate to further drive a wedge in our already
polarized political landscape.
Along our democratic way of life, we hope that
this new development will usher into a healthier
and enlightening discussion on the merits and
disadvantages of the proposal.
Jonathan Malaya, the Executive Director of
the PDP-Laban Federalism Institute which led
in the drafting of the proposal explains that the
present unitary and Manila-center government
has not worked wonders to solve the country;s
perennial poverty situation.
The current state of things he said is showed
in the skewed development picture of the
country – 60% of the GDP comes from Metro
Manila, Calabarzon and Central Luzon, with the
rest of the country, including Bicol still mired in
poverty.
“The problem, we submit, is our highly-
centralized form of government and the solution,
we believe, is the adoption of the federal
system. We believe that the only way to bring
about equitable and widespread development
in our country is for the central government to
share power – political and economic – with the
regions and LGUs,” Malaya argued.
There are safeguards he said to ensure the
success of this shift, including the banning of
political dynasties as well as more equitable
sharing of revenues, with 60% ensured for
regional governments and only 40% for the
Federal government.
He added that they “do not see federalism to
be the cure-all to all our problems. In fact, there
is no cure-all to all our nation’s ill. Federalism is
not a perfect system; but it may be the answer to
the country’s lingering problems rooted in our
country’s multi-cultural federal nature. Maybe
it is time to recognize the Filipino identity as
a “diversity of identities” and not one single
monolithic artificial construct. We submit that
it is the recognition of differences that make
communities prepared to embrace a common
identity with others. The time for change is now.”
Certainly, we do share this recognition of
our cultural diversity as one key in promoting
national unity and development. The ball is now
initially in the hands of our legislators who,
sadly, as of the present are lacking in terms of
independence and vision. There is therefore a
need to strengthen active people’s involvement
and engagement in the coming debates.

and Foreign Debt

TAX REFORM: The Department
of Finance (DOF) said it will respect
the decision of the Senate if the upper
chamber decides to just partially adopt
the Duterte administration’s first tax
reform proposal. Finance Secretary
Dominguez said that while they remain
hopeful the Senate will approve in full
their P134-billion tax reform measure,
the DOF respects the legislative
function of the lawmakers. That’s a
very rational approach to taxation.
Senate Ways and Means Chairman
Juan Edgardo M. Angara said last week
that they will only adopt 50% to 70% of
the DOF’s tax reform bill. In particular,
he said the Senate will propose
lower tax rates on sugar-sweetened
beverages and on petroleum products.
The Senate version lowers the excise
levy on sugar- sweetened beverages
from P10Bto P15B, and changes the
annual increase on petroleum taxes
to make the imposition moderate. We
saluté the pro-people stance of the
Upper House.
STOCK MARKET: As the market
exits the yearly ghost month (of August),
Philippine stock shares started the
week on a positive note, hitting another
all-time high for three straight days this
week. The benchmark PSEI surged
by 113.29 points, or 1.39% to close
at an all-time high of 8,294.16 points.

It’s good to know what our
Representatives in Congress are
doing instead of just believing one-
sided informations. We should know
both sides. Take the case of one
hundred eighteen congressmen (118)
who voted to give the Commission on
Human Rights P1,000.00 despite the
P60 million proposed of the Office of
the Budget Secretary. Why did they
do it? The following excerpts from the
column of Charlie Manalo in the Daily
Tribune dated Sept. 14, 2017 reveals
the reason:
Rep. Rodante Marcoleta argued
that CHR failed to bring justice for the
claim of 44 Special Action Forces in the
Mamasapano operations and Duterte
whose rights he claimed were violated
by the New York Times in a stinging
article aimed at the President. Other
supporters of the administration also
argue that the CHR does not pursue
human rights violation perpetrated by
criminals against innocent civilians and
uniformed personnel.”
These arguments, unfortunately,
is the height of idiocy. Human rights,
while it belong to all and cannot be
taken away, is perpetrated by structural
settings in which a person with power
abuses his or her power, status, or
authority against a less powerful person
to trap him or her into circumstances
in which he or she cannot resist:
relationships such as faculty-student,
superior -subordinate, senior-junior, or
a member of a majority and a minority
group, etc.
Only people in power can violate
human rights which they are supposed
to protect.
While we also weep for those who are
raped, killed by drug-crazed persons,

EXTERNAL DEBT: T h e
country’s outstanding external debt
as of June 30, 2017 was down by

basis, external debt declined by 1.8%
or $1.3B from $73.8B as of March 31,
2017. The external debt ratio which
is a solvency indicator, also improved
to 19.5% of annual aggregate output
from 21.7% last year. This means the
Pinoys have lesser loans to pay now!
External debt includes all borrowings
by residents from non-residents. It
is the outstanding amount of actual
current (not contingent) liabilities that
require payments of interest and/
or principal at maturity. BSP said
negative FX revaluation adjustments
were particularly recorded at $1.2 B as
of end-June. The country’s hefty gross
international reserves represents 5.6

those killed in drug-related instances,
insinuating all those 13,000 individuals
allegedly killed in that regard, to be
victims of Duterte’s operation against
illegal drugs. That those 13,000
individuals killed were victims of state-
sponsored violence with which Duterte
should take responsibility.
And the Gascon-led CHR even
gained momentum when two teenagers
were said to have been summarily
executed by members of the Caloocan
police.
While there seems to be nothing
wrong in taking an interest at those
killings as their mandate, as I have
mentioned, was for human rights
protection, my old friend Ferdie
Mendoza noted how weird it seems
that Gascon had never raised a howl
over killings concerning Lumads,
peasant and youth activists, etc.
It seems Gascon’s interest is
focused only in the killings concerning
anti-illegal drug operations as this
matter is being extensively used by the
Yellow cult in pinning down Duterte.
It is as if, the Gascon-led CHR, is

under the original maturity concept.
We should finance our projects using
internally generated funds!
MAUTE REBELLION: Thank
God – or Allah, there are good signs
that the big big peace and order
problem in Marawi – Lanao del Sur
may soon end. The “escape” of
the Vicar General of the Diocese of
Marawi – Fr. Chito Soganub from his
117 days of captivity by the Maute
rebels signals the potential end of
the fighting. Certainly the liberated
priest has observed the demeanor of
the Maute men – as well as the many
captives still being kept by Maute
– and this will be good info for our
soldiers and poliece.

band together so that other anti-

undertakings of their fanatic Islamic
fellows may be aborted at an earlier
stage. The damages and aftermath
of the useless Maute rebellion
leave stark lessons for all peace-
loving Filipinos! Everyone who

of terrorism must report these to
responsible government agencies
at once. We are riding on the same
embattled boat – whether Christians
or Muslims/Lumads, so we have to
save ourselves together.

Gascon could have emerged
guilty as charged.
So, did the House act right in
killing the CHR with a P1,000 budget
for 2018? Still no.
Gascon is not the CHR. But the
action of the House would affect
even its most lowly employee.
As lawyer Rico Quicho, dean of
the College of Law of the University
of Makati points out, the House
arrogantly used its power of the
purse to kill CHR when it could have
effectively used its legislative power
to take care of the abuses it accuses
CHR of committing.
According to Quicho, even while
the CHR was created by an EO, its
creation is still provided for in the
Constitution. The EO was merely an
instrument to fill in the details or in
other words, assume the role of an
enabling law.
If there is problem with the
implementation, especially on how
to handle officials deemed to be
operating based on another interest,
then the enabling law should dealt
with. One need not threaten the very
existence of the body whose creation
is guaranteed by the Constitution.
Conclusion: Representative
Marcoleta’s arguments are true. The
CHR should investigate and protect
human rights of everybody and not
limit itself to only the violations of the
police and military. What about the
human rights of the victims of drug
addicts and drug lords. Don’t they
have human rights too?

It aims to share with the pub-

The program will be real-
ized through the establish-
ment of “BSP Corner” in the
partner libraries of the BSP,
where the bank’s publica-
tions will be displayed.

“What we want is to make
this knowledge- based re-
source available to the prov-

Camarines Norte. With this,
students and researchers will
have better access…they

provided with regards to the
BSP information resources,
online publications and BSP
website databases so as to
maximize its use. Computers
needed for the project will
be provided by the partner
library, as stated in the MOU.

project will be conducted by
both parties ensure prompt
response of every needed
materials.
