Contract of Loan
-AND-
CHONA QUINTO SIAPNO, likewise of legal age, married, Filipino citizen, and a
resident of 5 Upper Kitma, Bakakeng Central, Baguio City, Philippines, hereinafter
referred to as the SECOND PARTY;
WITNESSSETH
That the SECOND PARTY is indebted unto the FIRST PARTY in the sum of
TWO HUNDRED FIFTY PESOS (P250,000.00), Philippine Currency, receipt of which is
acknowledged by the SECOND PARTY upon the signing of this instrument, payable
within a period of ONE MONTH (1 ) month, with interest thereon at the rate of five (5 )
per cent, per month, renewable for one month only.
That for and in consideration of this indebtedness and to assure the performance
of said obligation to pay, the SECOND PARTY hereby conveys as collateral
CHINABANK check numbers:
That the condition of this obligation is that should the SECOND PARTY perform
the obligation to pay the herein-above indebtedness of TWO HUNDRED FIFTY PESOS
(P250,000.00) , together with accrued interest thereon, this loan agreement shall at
once become null and void and of no effect whatsoever, otherwise, it shall remain in full
force and effect and the First Party shall have the right to enforce the obligation
immediately without prejudice to the filing of a criminal, civil or administrative case
against the Second Party.
IN WITNESS WHEREOF, the parties have hereunto set their hands on the 12 th
day of August, 2013 at Baguio City, Philippines.
We severally swear that the foregoing LOAN AGREEMENT is made for the
purpose of securing the obligation specified in the conditions thereof, and for no other
purpose, and that the same is a just and valid obligation, and one not entered in for the
purpose of fraud.
ACKNOWLEDGMENT
BEFORE ME, a Notary Public, for and in the City of Baguio, this 12 th day of
August 2013, personally appeared the above-named parties with their valid
identification as indicated below their names and signatures above. Known and
identified by me through competent evidence. They presented this integrally complete
instrument and represented to me that the signatures on the instrument were voluntarily
affixed by them for the purpose stated, declaring that they executed this instrument as
their free and voluntary act and deed.
