Defendant committed the following offense(s):

Charge Description: That on or about 3/29/2018, in Hennepin County, Minnesota, JOSHUA ZOR

possession of movable property belonging to Victim without consent and with the intent to deprive the
owner/entity permanently of possession of the property, and the property was a firearm.

 STATEMENT OF PROBABLE CAUSE
 
THE OFFENSE PORTION HAS BEEN AMENDED TO ADD AN ADDITIONAL COUNT OF THEFT-
TAKE/USE/TRANSFER MOVABLE PROP-NO CONSENT (AS COUNT 1), THUS RENUMBERING THE
ORIGINAL COUNT 1, DANGEROUS WEAPONS-POSSESS ON SCHOOL PROPERTY, AS COUNT 2.
THE PROBABLE CAUSE PORTION HAS BEEN AMENDED, AS REFLECTED BELOW BY THE TEXT
IN ALL CAPS. 

Complainant has investigated the facts and circumstances of this offense and believes the following
establishes probable cause: 

At approximately 6:45 p.m. on or about April 5, 2018, Brooklyn Center Police Officers were on routine
patrol near Interstate 694 and Shingle Creek Parkway, Brooklyn Center, Hennepin County, Minnesota,
when they observed the driver of a silver Mercury commit several traffic violations, which included failure to
stop at a red traffic signal, failure to signal a turn, and failure to signal a lane change. The officers stopped
the vehicle and identified two adult male occupants: the driver was R.M. and JOSHUA ZOR BERNARD
(Defendant) was riding in the front passenger seat. 

While interacting with R.M. and Defendant, the officers smelled the odor of marijuana emanating from
inside the vehicle. During a subsequent vehicle search, the officers recovered a backpack from the rear
passenger area. Inside the backpack was a Glock 9mm handgun (SER #BECG417), with several rounds
loaded into the magazine, several loose rounds of live ammunition, and multiple documents with
Defendant’s name on them. The officers also recovered a small amount of marijuana from Defendant’s
person. 

In a post-Miranda statement, Defendant stated that he attended school on 4/5/2018 at Osseo Area
Learning Center, Brooklyn Park, Hennepin County, Minnesota. He further admitted that he knowingly
possessed the backpack and the handgun while at school between approximately 8:50 a.m. and 2:30 p.m.
on 4/5/2018. Defendant initially told police that a friend had given him the gun for protection. He later said
that he stole the gun from the center console of an unlocked vehicle in a residential driveway in Brooklyn
Park approximately a week before his encounter with Brooklyn Center police on 4/5/2018. The officers
learned that the handgun recovered from Defendant’s backpack had been reported stolen out of Brooklyn
Park, Hennepin County, Minnesota on 3/30/2018. Defendant is presently in custody. 

ON 3/29/2018, AN ADULT FEMALE, C.N. (VICTIM), REPORTED THAT HER FIREARM HAD BEEN
STOLEN OUT OF HER VEHICLE. SPECIFICALLY, VICTIM REPORTED THAT HER GLOCK 9MM
HANDGUN (SER #BECG417) WAS TAKEN FROM THE CENTER CONSOLE OF HER VEHICLE WHILE
IT WAS PARKED IN HER DRIVEWAY ON THE 6300 BLOCK OF TESSMAN TERRACE, BROOKLYN
PARK, HENNEPIN COUNTY, MINNESOTA, BETWEEN APPROXIMATELY 10 P.M. ON 3/28/2018 AND 9
P.M. ON 3/29/2018.

pending further proceedings. Defendant is therefore charged with the above-stated offense(s).

36 hours after the arrest or as soon as such Judge or Judicial Officer is available to be dealt with according to law.
