VIEWCAST CORPORATION WARRANTY OVERVIEW

®
Standard Hardware Warranty. ViewCast warrants all ViewCast Software Products to meet their current
published specifications as stated in the applicable Software License Agreement or other license document
supplies with the Software Product. ViewCast assigns any warranties it may have from any third-party
suppliers of Products to the Reseller or End User. Any modification voids this warranty or any other existing
or available warranties. ViewCast Hardware Products are warranted against defects in material and
workmanship under normal use for the period of twenty-four (24) months from date of sale (twelve (12)
months for GoStream™). Where specific warranties exist that provide more substantial coverage then,
notwithstanding the warranty provisions herein, such product warranties shall be controlling and shall
preempt or supersede the warranty provisions herein.

ViewCast Standard Limited Software Warranty. ViewCast warrants all ViewCast Software Products as
specified in ViewCast’s End User Software License Agreement.

Reseller Pass Through of Standard Limited Warranties. ViewCast's standard limited warranties for the
products are to be passed through to the Customer by the Reseller without modification. Any modification of
any Product voids ViewCast’s warranties or any other existing or available warranty.

OEM Warranties. ViewCast assigns any warranties it may have for any OEM Product to Reseller. Where
specific OEM Product Warranties exist that exceed ViewCast’s warranty then, notwithstanding the warranty
provisions herein, such OEM Product warranties shall be controlling and shall preempt or supersede the
warranty provisions herein for that specific OEM Product.

Reseller Warranty Tracking. The reseller is obligated and agrees to maintain sufficient documentation and
records to track product warranties for its customers, including a log of service activity, and to report such
data quarterly to ViewCast, such that ViewCast can properly track, investigate, and resolve product service
issues. Failure to provide adequate documentation to ViewCast may result in loss of warranty coverage.
The reseller agrees to provide to ViewCast, upon written request, with information about the Customers of
the Products and date of distribution. ViewCast assumes no responsibility to monitor or inform VAR of the
tracking or expiration of applicable warranties for Products sold or licensed by VAR, such responsibility is
solely that of VAR.

Return Material Authorization (RMA). Customer may request a Return Material Authorization in
accordance with ViewCast’s current RMA procedures as posted on the Viewcast web site:
http://www.viewcast.com/pages.asp?page=rma. If the Products are purchased through a reseller, the End-
User must contact reseller to request an RMA. ViewCast RMA procedures as posted on the Viewcast
Website are subject to change at any time.

Exclusion from Warranties. VIEWCAST DOES NOT WARRANT THAT THE OPERATION OF ANY PRODUCT
WILL BE UNINTERRUPTED OR ERROR-FREE. THE LIMITED HARDWARE AND SOFTWARE
WARRANTIES PROVIDED HEREIN ARE NON-TRANSFERABLE, CONTINGENT UPON THE PROPER
INSTALLATION AND USE OF THE RESPECTIVE PRODUCT IN ACCORDANCE WITH VIEWCAST'S
SPECIFICATIONS, AND SUBJECT TO ALL LIMITATIONS AND RESTRICTIONS SET FORTH
EXPRESSLY HEREIN. THESE WARRANTIES DO NOT APPLY TO ANY PRODUCT THAT (1) IS IN AN
OPERATING ENVIRONMENT THAT DOES NOT COMPLY WITH VIEWCAST'S SPECIFICATIONS;
(2) HAS BEEN REPAIRED OR MODIFIED BY PERSONS OTHER THAN VIEWCAST OR ITS
AUTHORIZED TECHNICIANS; OR (3) HAS BEEN DAMAGED OR RENDERED UNSERVICEABLE BY
IMPROPER MAINTENANCE, OR MAINTENANCE BY UNCERTIFIED SERVICE PERSONNEL ABUSE
OR NEGLIGENCE ON THE PART OF OTHERS THAN VIEWCAST.

Exclusion for High Risk Activities. The Customer acknowledges that ViewCast’s Products are not fault-
tolerant and are not designed, manufactured or intended by ViewCast for use or resale in on-line control
equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear
facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or
weapons systems, in which the failure of products could lead directly to death, personal injury, or severe
physical or environmental damage (“High Risk Activities”). ViewCast specifically disclaims any express or
implied warranty of fitness for High Risk Activities. The Customer represents and warrants it will not use
ViewCast’s Products or technology or derivative technology, and will not use, distribute, or resell Products
for High Risk Activities and it will ensure that its Customers and end-users are provided a notice
substantively similar to that contained in this Subsection.

Disclaimer of Other Warranties. EXCEPT FOR THE WARRANTIES EXPRESSED ABOVE, THERE ARE NO
OTHER WARRANTIES RELATING TO THE PRODUCTS EXPRESSED OR IMPLIED, AND ALL OTHER
WARRANTIES ARE HEREBY EXCLUDED AND DISCLAIMED FROM THIS AGREEMENT AND FROM
EACH PURCHASE ORDER SUBMITTED BY THE CUSTOMER.
