On 04.12.2018 at about 1412 hours RO1 was dispatched to 15 St Luke’s Lane, St. Luke’s Episcopal
School, for a report of a sexual assault of a child. RO1 notified RO2, detective, and RO2 responded
with RO1. RO1 and RO2 arrived at the location and contacted RP1, School Headmaster.
RP1 stated that V1 (pseudonym used), 14-year-old female student, had made an outcry to W1,
teacher, in writing about a possible sexual assault and showed RO1 and RO2 a copy of the writing. In
it V1, stated that AP1, coach, placed his hand under V1’s shirt and also placed his hand under V1’s
skirt and under V1’s shorts. RP1 stated that the female students wear a uniform that consists of a shirt
and a skirt. RP1 also stated that the female students are required to wear shorts under their skirts.
RP1 stated that V1 was in W1’s class before lunch and complained of a headache. W1 sent V1 to AP1
to get her medicine. RP1 stated that AP1 and the other coach (not currently identified) are responsible
for the health of the students, which includes dispensing over-the-counter medication provided by the
parents, to the students.
W1 said when V1 returned, V1 was upset but would not tell her why. RP1 stated that W1 later was
able to get V1 to write down why she was upset and that is when W1 learned of the assault. W1 then
notified W2, principal of the middle school, who in turn notified RP1. RO2 later spoke with V1, W1 and
W2 and was able to independently verify their account of the events. See RO2’s supplement for further
information.
RP2 stated that V1’s parents, O1 and O2, had arrived at the school and were waiting in his office. RO2
requested RP1 escort V1, O1 and O2 to our location. RP1 returned a short time later with V1, O1 and
O2.
V1 was visibly upset and crying and appeared to have been crying for some time as her eyes were red
and her face was also flush. RO2 began his interview with V1. V1 repeated what she had written on
the note to W1. V1 also stated that AP1 had put his finger inside of her.
Based on this statement by V1, RO2 directed RO1 to locate AP1 at the school and place him under
arrest. RO1 left RO1’s body camera with RO2 so the remaining interview with V1 could be recorded.
RO1 located W2, who was waiting in the hallway, and asked to be escorted to AP1. W2 escorted RO1
to the school gym and found AP1 standing alone in the gym.
RO1 instructed AP1 to turn away from RO1 and place his hands behind his back. AP1 complied, but
immediately began apologizing to W2 and also started to cry. AP1 was handcuffed with his hands
behind his back (double-locked) and searched incident to arrest. RO1 then escorted AP1 to RO1’s
marked patrol unit, unit 66, and secured him in the right, rear seat with the seat belt.
RO1 then transported AP1 to the Alamo Heights PD and secured him in the holding cell. RO1 left AP1
handcuffed to prevent him from washing his hands and possibly destroying any trace evidence. RO1
seized AP1’s ring and his watch, both of which were of his left hand. RO1 also seized AP1’s cell phone
as possible evidence. RO1 notified NR1 of the situation and NR1 instructed RO1 to transport AP1 to
Methodist Specialty and Transplant Hospital for a forensic examination.
RO1 obtained a spare body worn camera to document the examination. Prior to leaving the Alamo
Heights PD, RO1 advised AP1 of his Miranda Rights. RO1 then transported AP1 to the hospital and
met with O3, a Registered Nurse and Sexual Assault Nurse Examiner. O3 explained the examination
to AP1 and he signed the requested hospital’s consent form. O3 then began the examination. At the
conclusion of the examination, O3 turned over the collected evidence, including AP1’s clothes, to RO1.
RO1 then transported AP1 back to the Alamo Heights PD.
RO2 attempted to obtain a statement from AP1, but he refused and requested an attorney. AP1 was
issued a property receipt for the seized items, to include his ring, watch, cell phone and clothes. AP1
was secured in the holding cell pending transport to the San Antonio Magistrate’s Office. AP1 was
later transported to the San Antonio Magistrate’s Office and booked for SEXUAL ASSAULT OF A
CHILD.
RO1 secured the seized items as well as the SANE kit in the property room.
