Smoking is not permitted in any of the common area; this includes the lobby area, elevators, all
corridors, stairwells, party room, balconies, etc. This also applies to smoking in front of the building.
The requirement to smoke is not less than 25 feet away.
Smoking in the common elements is in direct contravention to the Corporation’s documents and the
Fire Code Regulations. There is a $5,000.00 fine as per the City By-Law and anyone caught will be
charged.
As for the smoking in the units, the Condominium Act specifies that no person shall permit a condition
to exist or carry on an activity in a unit that is likely to damage the property or cause injury to an
individual. Injury must be considered as including injury to one’s health. The health risks of second
hand smoke are well established. As a Condominium Managers, we have a duty under the Act to
take all reasonable steps to ensure the owners and occupiers of units comply with the Condominium
Act.
Furthermore, no unit shall be occupied or used for any other purpose or in any manner which shall
constitute a nuisance to, or otherwise unreasonably interfere with the use of enjoyment by other
Owners or Occupants of other units.
All Residents are kindly requested to abide by the Corporation’s documentation.
Please be considerate to your neighbors and take necessary steps to contain the smoke within your
unit.
