GIFT DEED

This DEED OF GIFT executed this, the 20th day of April, 2018 BETWEEN

Ms. Pratibha, daughter of Mr. Ranjan Gogoi, aged about 29 years and residing in Manaparai,
Trichy, Tamil Nadu-620009, hereinafter called the “DONOR” (which term shall mean and
include all their legal heirs, executors, representatives, assigns etc.) of the ONE PART AND Ms.
Preethi, daughter of Ranjan Gogoi, aged about 22 years and residing at No.50, I Cross Street,
Thillainagar, Trichy- 620009, hereinafter called the 'DONEE’, (which term shall mean and
include all his legal heirs, executors, representatives, assigns etc. of the OTHER PART).1

[Explanation 1: This is the preamble part of the deed. This part contains the description of the
parties, date of entering into the deed and the description of the nature of the deed. This specifies
the legal nature of the parties and along with the address for any kind of communication by court
or appointed authority etc.]

WHEREAS the donor is the absolute owner of the property consisting of house property
covering an extent of 3600 sq feet, bearing R.S. No.1600/85, located on shanty road, Manaparai,
Trichy-6200 09, more fully described in the Schedule hereunder, she has acquired the same from
Mr. Sanjay Ram, through a sale deed in 2015 and registered with the Sub-Registry at Manaparai,
Trichy, 620009, evidenced by Sale Deed No.2015/92.2

[Explanation 2: This is the first recital of the deed which describes the extent, location, and the
registration details of the property to avoid future conflicts regarding the same. This clause put
forth the required details about the legality of the property.]

WHEREAS, the donor is desirous of disposing off the property by way of gift deed the property
consisting of a housing property covering an extent of 3600 sq feet, bearing R.S. No.1600/85,
located in Manaparai, Trichy-620009, more fully described in Schedule hereunder, since the
donor is interested in the donee said being her sister.3

[Explanation 3: This is the second recital of the deed. It clearly establishes the intent of the donor
to gift the said property out of love and affection. This is an important clause as it helps in
proving the intent, in case any dispute arises for the determination of the title].
WHEREAS the donee having learnt that the donor is desirous of disposing off by way of gift
their property consisting of a housing property covering an extent of 3600 sq feet, bearing R.S.
No.1600/85, located in Manaparai, Trichy-620009, more fully described in the Schedule
hereunder, approaches the donor with a view to accept the same.4

[Explanation 4: This clause being the third recital, clearly establishes the intent of the donee to
accept the property intended to be disposed off by the donor out of love and affection.]

WHEREAS the donor having decide to donate the gift of property to donee and donee agreed to
the same property consisting of a housing property covering an extent of 3600 sq feet, bearing
R.S. No.1600/85, located in Manaparai, Trichy-620009, more fully described in the Schedule
hereunder, donor agreed to gift the property to done on amount of natural love and affection.5

[Explanation 5: This is the fourth recital of the deed which contains the agreement to gift the
property between donor and donee].

WHEREAS, in pursuance of the agreement arrived at between the donor and donee as regards
the gift and acceptance respectively of the property, more fully described in the Schedule
hereunder, the donee having agreed to accept the property worth Rs. 80 lakh on amount of
natural love and affection.6

[Explanation 6: This recital identifies the acceptance of donee as well as the worth of property
which has been gifted by the donor.]

NOW THIS DEED WITNESSES THAT IN CONSIDERATION OF the donor having agreed to
gift a housing property, bearing R.S. No.1660/85, more fully described in Schedule hereunder,
the donee having accept the same out of natural love and affection; the donor does hereby
convey unto the donee absolutely all the title and interests in the Schedule mentioned property
and further, the donor also delivering possession of the vacant plot to the donee to enable the
donee to enjoy the said property absolutely and without any interruption of whatsoever nature.7

[Explanation 7: This is the sixth and the last recital of the deed which concludes the agreement
by mentioning about the consideration involved. It also provides details about the transfer of the
title of the property and the interests attached with it from the donor to the donee. Also, this
recital clause conveys the absolute interest on the donee over the property delivering the
possession without any future interruption.]

TO HAVE AND TO HOLD the property by the donee absolutely and forever and without any
encumbrance of whatsoever nature.

THAT the donor and donee hereby mutually covenant as follows:

1. The donor hereby assures the donee that the property hereby gifted to the donee is free from
all encumbrances and that if any subsisting is found to be there, the same shall be discharged at
the expenses of the donor.

2. The donor hereby declares that in respect of the property gifted by him to the donee, he shall
pay all the taxes and other levies due on the property up to the date of execution of this Gift Deed
and that the donee shall pay the taxes and dues falling due hereafter.

3. The donee shall apply to the appropriate authorities and arrange to carry out the change of
name required in all the necessary records and for this purpose, the donor is always in readiness
to give consent and affix their signature.

4. The donor hereby declares that he surrendered all the parent deeds connected with the property
and that no document is retained by him.

IN WITNESS WHEREOF, the parties hereto have set their hands on this, the 20th day of April,
2018.

property to 3600 sq feet, bearing R.S. No.1600/85, located in Manaparai, Trichy-6200 09, and
bounded on,

NORTH by 100 Feet Main Road leading to Central bus stand

SOUTH - by a 3 storey flat, bearing R.S. No.1605/85 and belonging to N. Murugesan

WEST – by an uninhabited house, bearing R.S. No.241/16 and belonging to Mr. Sharma

EAST - by a Puspha main road and situated within the Registration and Sub-Registration District
of Manaparai
