PANCASILA AS THE IDEOLOGY OF THE UNITARY STATE OF THE REPUBLIC OF

INDONESIA (NKRI) IN FIQH MAQASHIDY

The purpose of this study is to explain that Pancasila as the foundation of the Unitary State of the
Republic of Indonesia (NKRI) is final and can not be debated anymore because it represents all
the aspirations of religion, customs and culture of Indonesia. The formulation of Pancasila was
also agreed upon by the founders of the Indonesian nation. Envoys from Islam also have believed
that the values of Pancasila have met the requirements and in accordance with the teachings of
Islamic law in accordance with the logic of fiqh maqashidy. However, there are small groups of
Islam who began to question the values of Pancasila contained in them. They say that Pancasila
is a TAGHUT and KAFIR system. Whereas the internalization of Islamic values in Pancasila has
shown that Pancasila is in line with the objectives of Islamic Shari'ah (Maqashid shariah)
bringing general benefit and refusing the damage according to the mandate of the 1945
Constitution.
