For and on behalf of the President of India, The Sr. Divisional Mechanical Engineer
(Diesel), Central Railway, Ghorpuri, Pune 411 001 invites sealed Tender, for the following
works, from reputed and experienced contractors who are having valid EPF, ESI and
Service Tax registration as required under Labour laws.

1. These additional special conditions are applicable to tender document and


considered as part of it, which is downloaded from internet/website.
2. Tenderers may note that permitting of downloading of tender document is an added
facility for convenience of Tenderer/s. Railway, however reserves right to extend
this facility for selected works or continue only with direct sale of tender forms. In
case, tender document is not uploaded on website or download failure or delay or
incomplete document downloaded, whatsoever, Railway shall not be responsible in
any way, Railway shall not be responsible for any direct/indirect loss of
business/profit resulting from inability to use this facility.
3. The tenderer/s shall download & print the tender document solely for the purpose of
bidding for above work and downloaded document shall not be used, copied or
reproduced for any other purpose.
4. The end of tender document is indicated by “End of Tender Document” marker.
Tenderer/s should carefully see that above marker appears on the last page of
downloaded tender document to ensure that downloaded document is complete.
Tenderer is suggested to check the integrity and completeness of document before
submission.
5. The tender document downloaded from website though does not bear signature of
Railway authority shall have same authority as having directly purchased from
Railway office. Tenderers while submitting his offer must sign all pages of tender
document.
6. The downloaded and printed tender document along with the various other
documents should be submitted as per details mentioned in tender document. The
tenderer should clearly write on main tender cover and also on the top of sealed
cover “ Tender documents downloaded from website”.
7. The tenderer/s are required to pay non-refundable cost of tender document in the
form prescribed in tender notice while submitting their offer. In case they fail to
furnish the requisite cost of tender document in prescribed form, their offer shall be
rejected. The cost of EMD shall not be merged with cost of tender form and
shall be separately furnished.
8. The Tenderer/s shall maintain the integrity of downloaded tender document and
shall not make any change/addition/deletion/tampering, whatsoever, in the
downloaded documents. The tenderer/s offer shall be rejected and full earnest
money shall be forfeited, in case it is detected after submission of offer, that they
have made any modification in downloaded documents. In case such modification
is noticed ever after award of contract, Railway is liable to terminate the contract on
contractor’s default. In addition Railway reserves the right to take action against the
firm as deemed fit, which may include Banning of Business Dealings with the firm
and the firm is also liable to be prosecuted as per the law. After award of work
agreement will be prepared based on the master copy of tender document available
in the Railway’s office. In case, any discrepancy is noted in tender document
submitted by Tenderer, the Master document kept with Railway shall prevail and
decision of Railway thereon shall be final and binding on Tenderer/Contractor.

9. Tenderer/s shall print the tender document on good quality A4 size papers of
thickness 75 GSM or above and printed document shall be clearly legible. The
document shall be properly bound and page numbers shall be in serial order as
mentioned in downloaded documents. The tenderer/s shall not be reimbursed with
the cost of stationary, printing and binding etc. Offer of Tenderer/s is liable to be
rejected by Railway, if tender document is not printed or bound as per above
instructions. Further tenderer shall bear expenses of Internet connection and
telephone charges if any for downloading of tender document.
10. The Tenderer/s shall keep themselves updated about any modification in tender
notice and tender document, issued by Railway through newspapers, website or
E-mail or any other means and shall act accordingly. It is the responsibility of the
Tenderer to check any correction or any modifications published subsequently in
Web site and the same shall taken into account while submitting the tender.
Tenderers’ offer is liable to be rejected if they have not enclosed all the
corrections/corrigendum along with downloaded tender documents.
11. The “Additional Conditions for Tender Document downloaded from Website” must
be signed by the tenderer and enclosed along with the Tender document failing
which the tender is liable to be rejected.
12. The following declaration should be given by the Tenderer while submitting the
tender:

I/We have not tampered/modified the tender form in any manner. In case the document
is found to be tampered/modified, I/We understand that my/our tender is liable to be
rejected and full earnest money deposit will be forfeited and I/we am/are liable to be
banned from doing business with Railways and /or prosecuted.

conditions to the tender attached hereto and hereby agree to abide by the said conditions. I/We
also agree to keep this tender open for acceptance for a period of 90 days from the date fixed
for opening of the same and in default thereof I/We will be liable for forfeiture of my/our “Earnest
Money” deposit. I/We offer to do the work for “Sr. D.M.E. (DSL), Central Railway, Pune at the
rate quoted in the attached schedule and hereby bind myself/ourselves to complete the work in
all respects within stipulated period of time from the date of issue of letter of acceptance of the
tender.

I/We also hereby agree to abide by the General Conditions of the Contract of Central Railway- 2005
updated till date and to carry out the work according to the special conditions of contract and the
specification for material and work laid down by the Railway for the present contract as well as
all other enclosures annexed to the tender form.

3. A sum of Rs.24, 010/- (Rupees Twenty four thousand ten only) deposited vide Rly. receipt /Pay
order/Demand Draft/FDR No. ………………………… Dated. …………… is
herewith forwarded as “Earnest Money”. The original receipt is enclosed with the offer. The full
value of earnest money shall stand forfeited without prejudice to any other rights or remedies
available to Railway in case my/our tender is accepted and if,

a) I/We do not execute the contract documents within 05 days after receipt of notice issued by
the Railways that such documents are ready. ‘OR’
b) I/We do not commence the work within 15 days after receipt of order to that effect.

4. Until a formal agreement is prepared and executed, acceptance of this tender shall constitute a
binding contract between us subject to modifications as may be mutually agreed to between us
and indicated in the letter of acceptance of my/our offer for this work.

Part-I

INSTRUCTIONS TO TENDERERS

1.0 GENERAL INSTRUCTIONS: -

On behalf of the President of India, Sr. Divisional Mechanical Engineer (Diesel),


Central Railway, Diesel Loco Shed, Pune ( herein after referred to as “Engineer” )
invites sealed tenders from established and reliable contractors/ tenderers for work as
set forth in the “schedule of works”.
1.1 All offers in the prescribed form should be submitted before the time and date fixed
for the receipt of the offers as set forth in the tender papers. The offer should be
forwarded in the form indicated in Annexure -‘A’. Offers received after the stipulated
time and date are liable to be rejected.
1.2 The check list as per the Annexure-‘B’ should be duly filled in & signed by the
tenderers.
1.3 The tender should be submitted in a sealed cover addressed to Sr. Divisional
Mechanical Engineer (Diesel) Central Railway, Pune superscribed with the name of
work as given in the tender notice.
1.4 The tender complete in all respect should be delivered in the tender box located in the
office of Sr. Divisional Mechanical Engineer (Diesel), Central Railway, Pune by 15.00
hrs. of the date of opening of tender.
1.5 Tender papers are not transferable.

2.0 Qualifying requirement of tenderers


2.1 The tenderer should provide satisfactory evidence acceptable to the “Engineer” to show
that

i) he is a licensed contractor who regularly under takes the works similar to the one
under the subject tender and has adequate technical knowledge and experience.
ii) he has adequate financial stability and status to meet the stipulations under the
contract.
iii) he has adequate plant and capacity to complete the tendered work.
iv) he has an established proper supervisory control organization to ensure that there is
adequate control at all stages of execution of the contract.
v) he has valid EPF, ESI and Service Tax registration as required under Labour laws.
2.2 for the purpose of 2.0 above, the tenderer should additionally submit –

a) A satisfactory work completion certificate along with a performance statement in


a pro forma as per Annexure -`C’ giving a list of major works executed in the
recent past or the works of this nature, giving details of customers’ name ,
address, order no.(s) and dates, and whether the work was completed within the
schedule time.

b) Tenderer not submitting the requisite information may note that his offer is liable
to be ignored.

The following documents should be submitted alongwith Tender Document : (a)List
of personnel, organization available on hand and proposed to be engaged for the subject work.
(b) List of works completed in the qualifying period (i.e. current year and
three previous financial years) giving description of work, organization for whom
executed, approximate value of contract at the time of award, payment received in the
qualifying period, date of award and date of scheduled completion of work. Date of
actual start, actual completion and final value of contract should also be given
(Proforma-I). (c) List of works on hand indicating description of work, contract val
approximate value of balance work yet to be done and date of award (Proforma-II).

Note : (1) In case of items (b) & (c) above, supporting documents / certificates from the
organizations with whom they worked/ are working should be enclosed. (2) Certificates
from private individuals for whom such works are executed /being executed will not be
accepted. (3) Tenderer should not quote any conditional offer, giving rebate for early
finalization of their offer. Such conditional offer will be summarily rejected and no
correspondence in this matter will be entertained. (Other Terms & Conditions are
available in this office). Tenderers may carefully note that their Contract Agreement for
this work is liable to be terminated at any time later, in case any of the information
furnished by them is found to be untrue or any adverse points come to light
subsequently. The decision of Railway in this regard shall be final and binding.

2.3 Variation in quantity


i )Individual NS items in contracts shall be operated with variation of plus or minus
(upto 25%) and payment would be made as per the agreement rate.
ii.) In case of increase in quantity of an individual item by more than 25% of the
agreement quantity is considered as unavoidable, the same shall be got
executed by floating a fresh tender. In floating a fresh tender is considered
not practicable, negotiations may be held with the existing contractor for
arriving at reasonable rates for additional quantities in excess of 125% of
agreement quantity (more than 25% of agreement quantity).
iii ). The limit of varying quantities for minor value items shall be 100% (as
against 25% prescribed foe other items). A minor value item of this purpose is
defined as an item whose original agreement value is less than 1% of the
totaloriginal agreement value.
As far as SOR items are concerned, the limit of 25% would apply to the value of
SOR schedule as a whole and not on individual SOR items. However, in case of NS
items, the limit of 25% would apply on the individual item irrespective of the manner
of quoting the rate (single percentage rate of implemented.
3.0 Time schedule:
3.1 The basic consideration and essence of the contract shall be the strict adherence to the
time schedule for the completion of the work as prescribed in special tender conditions.
3.2 The time and date specified in the contract for the completion of the work shall be
deemed to be the essence of the contract and the work must be completed not later
than the time specified. The attention of the tenderer is invited to the clause regarding
liquidated damages and default in the Indian Railways general conditions of the contract
by which the contract shall be governed.

4.0 Earnest Money: -
4.1 The earnest money as stipulated in the tender notice shall accompany each tender. The
earnest money shall be in any one of the following forms :
a) In cash to be deposited with Chief Cashier, Central Railway, Pune, on which no
interest shall be paid by the Railway Administration (money receipt in original to be
enclosed with the tender).
b) Deposit receipts, pay order and demand drafts in favor of Sr. D.F.M., Central
Railway, Pune from a Nationalized Indian Bank.
4.2 The earnest money shall remain deposited with the “Engineer” for a period of at least 90
days from the date of the opening of the tender. If the validity of the offer is extended,
the earnest money duly extended shall also be furnished failing which the offer, after the
expiry of the aforesaid period, shall not be considered by the “ Engineer”
4.3 No interest shall be payable by the “ Engineer” on earnest money.
4.4 The earnest money deposited is liable to be forfeited if the tenderer withdraws or
amends, impairs or derogates from the tender, any condition in any respect with in the
period of validity of his offer.
4.5 The earnest money of the successful tenderer may be returned after the security deposit,
as required is deposited and formal agreement duly signed by the tenderer, is received
by the Engineer. The earnest money can also be adjusted against the security deposit if
the contractor so desires.
4.6 If the successful tenderer fails to furnish the security deposit as required and fails to
return formal agreement with acceptance, then the earnest money shall be liable to be
forfeited by the “ Engineer”.
4.7 Any tender not accompanied by the earnest money in one of the approved forms given
in clause 4.1 as above shall not be considered.
5.0 Submission of offers: -
5.1 All offers shall be either type written or written neatly in indelible ink.
5.2 Any individual (s) signing the tender or other documents connected therewith shall
specify whether he is signing-
a) as sole proprietor of the concern or attorney of the sole proprietor.
b) as a partner or partners of the firm.
c) as a Director , Manager or Secretary of a Limited company duly authorized
by resolution passed by the board of Director or in pursuance of the authority
conferred by memorandum of association.
53 In the case of a firm not registered under the Indian Partnership Act, all the partners or
the attorney duly authorised by all of them should sign the tender and all other
connected documents. The original power of attorney or other documents empowering
the individual or individuals to sign should be furnished to the “Engineer” for verification,
if required.
5.4 All price and other information like document sets having a bearing on the price shall be
written both in figures and words in the prescribed offer form.
5.5 Offer in the prescribed form should be addressed to the Sr. Divisional Mechanical
Engineer (Diesel), Central Railway, Diesel Loco Shed, Pune. The tender should be
submitted in a sealed cover superscribed with the name of work.
5.6 Offers shall be as per the Indian Railways General and Special Conditions of Contract.
5.7 In case of any deviation from the requirement of tender specifications, Instructions to
Tenderers or General & Special Conditions of contract, the same should be brought out
by the tenderer as per proforma in Annexure – ‘D’.

5.8 Each page of the offer must be numbered consecutively, should bear the tender
number and should be signed and stamped by the tenderer at the bottom. A reference
to the total number of pages comprising the offer must be made at the top right hand
corner of the first page.
5.9 All the copies of annexures enclosed with the tender paper should be duly filled in by
the tenderer and submitted along with the tender duly signed and stamped on each
page.
5.10 The tenderer should avoid ambiguity in his offer e.g. if his offer is to his standard
sizes / lengths/ dimensions, he should specifically state them in details without
any ambiguity. Brief descriptions such as Standard lengths’ etc should be
avoided in the offer.
6.0 Local conditions: -
It will be imperative for each tenderer to fully acquaint himself of all the local conditions
and factors which would have any effect of the performance of the contract and the cost
of item of works. The “Engineer” shall not entertain any request for clarification from the
tenderers regarding such local conditions. No request for change of price, or time
schedule of completion of work shall be entered after the offer is accepted by the
“Engineer”. The tenderer can visit the place of proposed work to understand the site
conditions and correct appreciation of volume of work to be done, if necessary.
7.0 Deductions: -
Payment as in clause 18 of Part III Special conditions of contract shall be subject to
deductions of any amount for which the contractor is liable under the contract against
this tender or any other contract in respect of which the President of India is the
contracting authority.
8.0 Income Tax :
2% of the total contract value of Income Tax, 10% Surcharge on Income Tax and 3%
Education Cess on IT plus surcharge of IT will be deducted from the bill.
9.0 Work contract Tax :
At present 4% WCT is recovered. If registration certificate under Sales Tax Act is
produced 2% of work contract tax will be recovered.
10.0 Service Tax :
Service tax, if claimed will be provided. Depositing of service tax with concerned
authority will be Contractor’s responsibility.
11.0 Legal charges :
A fee of Rs.200/- per legal document, like partnership deed or power of attorney
executed before or after the execution of the contract, will be paid by the contractor for
obtaining legal Advice from Law Officer.

12.0 Conservancy Cess charges


Conservancy cess charges per month will be deducted as directed by Rly. Bd’s recent
order for average labourer or workmen employed to carryout the work.

13.0 Evaluation of the offers :


The tenders received will be evaluated by the Engineer to ascertain the lowest
acceptable tender in the interest to the Engineer ,as specifically in the specifications
and tender documents. Evaluation criteria not mentioned herein but mentioned
specifically in the technical specifications will be taken into consideration in the
Evaluation of offers.

14.0 Acceptance of tender:
14.1 The “Engineer” may accept a tender for a part of the quantity offered, reject any tender
without assigning any reason and may not accept the lowest or any tender.
14.2 Acceptance of tender will be communicated by a formal acceptance letter (by
registered post) of the tender direct to the contractor which may be deemed to conclude
the contract. Completion period will be deemed to have commenced from the date of
signing agreement.

15.0 Effect and validity of offer:


15.1 The submission of any offer connected with these specifications and documents shall
constitute an agreement that the tenderer shall have no cause of action or claim against
the “Engineer” for rejection of his offer. The “Engineer” shall always be at liberty to
reject or accept any offer or offers at his sole discretion and any such action will not be
called into question and the tenderer shall have no claim in that regard against the
“Engineer”

15.2 The offer shall be kept valid for a minimum period of 90 calendar days from the date of
opening of tender, within which the tenderer will not be entitled to rescind or to withdraw
his offer. Not withstanding this, if the tenderer rescinds his offer within the period
stipulated above, the earnest money deposited by him along with the tender shall be
liable for forfeiture at the sole discretion of the Sr.D.M.E (Diesel), Pune and in that case
the tenderer shall have no further claim on the amount deposited by him as earnest
money.

15.3 Offers shall be deemed to be under consideration immediately after they are opened
and until such the official intimation of award of contract is made by the Railways to the
tenderers. While the offers are under considerations, tenderer and /or their
representatives or other interested parties are, advised to refrain from contacting the
“Engineer” by any means. If necessary, the “Engineer” will obtain clarifications on the
offers by requesting for such informations from any or all the tenderers, either in writing
or through personal contacts, as may be considered necessary. Tenderer will not be
permitted to change the substance of their offers after the offers have been opened.
16. Negotiation :
Should the Railway decide to negotiate with a view to bring down the rates
the original offer will still be binding in case nothing materializes out of the
negotiations. A declaration of this effect should be submitted by the
tenderer/s alongwith negotiated offer in prescribed proforma.

17.0 General:
The tenderers must ensure that the conditions laid down for submission of offers
detailed in the preceding paras, are completely and correctly fulfilled. Tenders, which
are not complete in all respects as stipulated above, may be summarily rejected.

17.0 Last date for receipt of tenders:
17.1 The offers complete in all respect should be dropped in Tender Box provided in the
office of the Sr. Divisional Mechanical Engineer (Diesel), Central Railway, Diesel Loco
Shed, Pune not later than 15.00 hrs on the date specified.

17.2 The tenders received shall be opened in the presence of such of the tenderers or their
representatives, who may like to be present at 15.30 hrs. on the date specified and
where practicable the name of tenderers and the rates tendered by them will be read
out.

Part-II
Scope of Work

• Name of work: Mechanised Cleaning and washing of locomotives at Diesel Loco


Shed, Pune for period of Two years.
• Work to be carried out round the clock at Diesel Loco Shed, Pune.
• The cleaning schedule as mentioned below is telescopic in nature.
• Activity is divided in to the following major segments and it will be advised by Shed
Representative as to what cleaning schedule is to be performed on locomotive.
• All locomotives going out of shed after maintenance schedule require a second cleaning
before dispatch. This involves wiping of window glasses, final cleaning of cab and
wiping to remove any grease and soot marks left by unclean hands.
• The Cleaning schedules should be over in approximately 30 minutes for Minor, 35
minutes for Medium and 60 minutes for Major.
1. Minor cleaning -
i) Cleaning hood including roof:
- Cleaning outer hood by applying soft soap solution and then washing off with a
brush and water jet. The specification of soap is Liquid synthetic detergent for
industrial purposes to IS 4956/77 or latest. Railway reserves the right to change
the specification of the soap solution at any time.
- The inside of the hood and the Engine room door get coated with dry soot. This
soot has to be removed by wiping with wet cloth,
- The soap solution, brushes, steam &/or water jet machine and other items
required for cleaning are to be procured and maintained by the contractor.
- Railway will supply water and electricity for the work without any charge.
- Adequate care should be taken so that water does not enter electrical
components and damage them.
ii) Loco chassis, Foot Board and Cattle guard:
- Cleaning by soft soap solution.
- Removal of dust and oil.
- Final cleaning by water jet.
iii) Cleaning of Drain holes:
- Drain holes are provided at the bottom of loco body. All the drain holes should
be properly cleaned, so that they are not chocked with dust or any other foreign
object.
iv) Engine Room, Generator Room, Expresser Room:
- The Engine block, tappet covers, Fuel Injection Pump [FIP] covers, hoses,
casings etc and all approachable areas should be swabbed to remove water, oil
or any foreign material.
- The accumulated dirty oil in the Expresser pit, Engine room and Generator pit
should be drained out before cleaning and then be cleaned by swabbing.
- The deposits on the expresser compartment body and piping have
to be swabbed lean.
v) Radiator Room:
- The Radiator cores in the room should be blown by compressed air and water &
or steam from inside to clean the radiator cores.
- The floor should be cleaned of oil, grease and any dirt by swabbing.
- The labourers should enter radiator room only when the loco is not in cranked
position.

- Care has to be taken so that fans of the radiator core and tubes are not
damaged in the process.
vi) U Clamp:
- Removal from loco at the time of loco arrival and handing over to loco pilot at the
time of loco departure.
vii) Cabin & Nose Compartment:
- Dry cleaning of the cab to remove visible dirt, dust and oily muck.
- Swabbing the cab floor, the wall, look out glass, window glass.
- It has to be ensured that various stickers pasted in the cab are not wiped out.
2. Medium cleaning –
i) Minor cleaning as above.
ii) Car body filters:
- All car body filters should be removed and replaced with clean car body filters.
- The removed filters has to be taken to HR cleaning section and the clean ones
are to be brought from there.
3. Major cleaning -
i) Minor and major cleaning as above.
ii) Fuel Tank and MR Tanks:
- Clean approachable areas by scrapping.
iii) Bogie Frames, Wheels, TM Magnet Frames, Gear Case and Air Brake system
- The dirt and cardium compound deposited are to be scrapped out.

SPECIAL CONDITIONS OF CONTRACT
MECHANISED LOCOMOTIVE WASHING/ CLEANING AT DIESEL LOCO SHED, PUNE

This contract is covered by Railways General terms and conditions of contract, In the event of
any conflict or inconsistency between General terms and conditions of contract and special terms and
conditions of contract, the later will prevail.

Should a tenderer find discrepancies or omissions in the drawings or any of the tender documents or
should he be in doubt as to their intent and meaning, he should at once make a reference for
necessary clarification. While every endeavor has been made to avoid error or omission in the tender
documents, it must be clearly understood that the successful tenderer must take upon himself and
provides for all risks of errors and omissions, which may subsequently be discovered and no
subsequent claim will be entertained by the railway on this account.
1. Scope of work
As detailed in Part. II of Tender document
2. General:
1) The contractor shall use the following minimum equipments, consumable material for the
purpose of locomotive washing & cleaning. Railway will provide electricity and water without
any charge for the operation of these equipments. Compressed air required for blowing and
cleaning as per schedule shall be provided by Railways
i) High-pressure water & / or steam jet machine - 02 Nos.
ii) All kinds of brushes, brooms and scrubbers
iii) Liquid detergent as per scope of work.
All cleaning agents and equipment to be used should be get approved by Sr. DME (D) or
nominated representative.

2) The work shall commence after issue of letter of acceptance and accepted by the successful
contractor for all the events and purposes and after signing the agreement between the
parties; the work shall progress on the basis of subject contract

3) Railway Administration shall be entitled to terminate the contract at any time should, in the
opinion of the Railway cessation of work become necessary owing any reasons. Notice in
writing from the Railway for such termination and reasons thereof shall be conclusive
evidence thereof. Contractor is entitled for payment to the extent of work actually done to the
Railway

4) The contractor should ensure that the provisions laid down under various labour laws
applicable to such type of contracts are strictly adhered to. In addition to the above they
should also ensure that the guidelines given by the concerned authority from time to time in
this regard are strictly adhered.

5) The contractor or a responsible person appointed by him with the approval of the
Sr. DME(D) Pune or his authorized representative shall personally supervise the carrying out
of the work under this agreement.

4.0 Period of contract


The period of contract is two years (24 -months) from the date of acceptance of the offer
by the contractor.

5.0 Security deposit : -
5.1 Security deposits 5% of contract value are to be submitted by contractor in token for the due
fulfillment of a contract.
i. Deposit of cash with the Divisional Cashier with due receipt taken.
ii. Deposit receipts, pay orders, demand drafts drawn in favour of Sr.D.F.M., Central
Railway, Pune. These forms of security deposit could be either of the State Bank
of India or of any of the Nationalized Banks.
iii The security deposit shall be returned to the contractor without any interest after
completion of the contract to the satisfaction of the “Engineer”.
iv. The Security Deposit made in forms other than cash shall be valid for the entire
duration of the contract plus 2 months additional (Total 26 months)
6.0 Performance guarantee :
i) The successful bidder should submit a Performance Guarantee in any of the stipulated
form amounting to 5% of the contract value.
ii) The Performance Guarantee should be furnished by the successful contractor after the
Letter of Acceptance has been issued, but before signing of the agreement and should
be valid upto expiry of the maintenance period. The agreement should normally be
signed within 15 days after the issue of LOA and Performance Guarantee should be
submitted within this time limit.
iii) Performance guarantee shall be released after satisfactory completion of the work
and maintenance period is over. The procedure for releasing Performance
Guarantee will be as for security deposit.
iv) Wherever the contracts are rescinded, the SD should be forfeited and the
performance guarantee shall be encashed and the balance work shall be got
done separately.
7.0 Labour engagement
Sufficient labourers and supervisors should be provided by the contractor for
carrying out the subject work at nominated places to avoid delay and hampering of work.
The contractor will ensure for health and fitness of labour deployed by him.
The contractor shall ensure that his workers reports for work in time and observe
such timing at prescribed to them by the Railways. They must also be available at any
of time at the specific location allotted to them.
Work shall be carried out round the clock as specified by Railways. The contractor
will be responsible for fulfillment of these conditions during the execution of work for safe
working of his staff. The work needs to be carried out on shift basis on demand
depending upon the requirement.

8.0 Sufficiency of Labour


The contractor shall engage labour and supervisor required to carry out the work hereby
undertaken. If in the opinion of the Sr. ME (D) Pune or his representative, the
contractor does not have sufficient workmen when so required the Sr. DME (D) Pune or
his representative may penalize the contractor.

9.0 Competency of Labour

The contractor should engage only competent skilled/ semi-skilled/ un-skilled labours in
the prescribed field for carrying out the subject maintenance work. Further all employed
labours should be above 18 years of age.

10.0 Fine for Mis-conduct:
The contractor shall fine or dismiss any of his workmen, if so required by the Sr. DME
(D) Pune or his representative on account of unsatisfactory work, misconduct,
insubordination or any other cause not compatible with the efficient carrying out the
work as per terms of this contract.

11.0 Trespass and theft:

The contractor shall at times be fully responsible for any trespass / theft committed by
he/his agent. The person found involved in such activities shall be handed over to
authorities for prosecution

12.0 Record keeping:

The contractor shall maintain Inspection register for having inspected the schedule of
work executed by the contractor by the officers and nominated shed official executing
the work or by his authorized shed officials. This register shall be shown at the time of
inspection by the shed officials.

The contractor has to give proper instructions to his labourers that they should
record the work done as per schedule advised to them.

13.0 Behavior of labour at work place :


The contractor or his/their labour should not enter in shed premises in intoxicated
condition and will not smoke in the premises. The contractor should engage the labour
whose character and antecedents have been verified before they are utilized to work in
Railway. In the event of any staff of the contractor being found selling Railway material,
the person concerned will be turned out from the Railway premises summarily and
further if the Railway Administration on enquiry comes to know that proper verification
of the antecedent was not carried out by the contractor in case of the labour employed
by him, his contract will liable to be terminated forthwith.

14.0 Pre-caution while working at site

Contractor and the personnel deputed by him for execution of the work shall ensure
themselves their safety in shed premises. The contractor will solely responsible for any
accident. Railway will not bear any responsibility or claim in case of an accident.

15.0 Railways right in case failure of the contractor to perform his service:

In the event the Contractor fails to perform any of the service here in agreed upon
within the time deemed reasonable by or in manner considered satisfactory to the
Railway administration, the Railway administration shall make alternative arrangement
for the said contract for which the contractor shall be liable to reimburse the same to the
Railway administration and shall be entitled to recover the same from the outstanding
bills of any amount payable to the contractor. The decision of the Senior Divl.
Mechanical Engineer (Diesel), Pune in this respect shall be final and is binding on both
the parties.

16.0 Labour laws:
Adherence of the labour laws will be onus of the contractor and should have EPF, ESI
and other applicable registration with statutory authorities.
17.0 Completion schedule:

The contractor shall complete the work in accordance with the schedule indicated in the
schedule of requirements/technical specification
Necessary space will be provided by the Railways free of cost for storage of material.
However, Railways shall not be responsible for safety of the items. The space shall
under no circumstances be used for any other purpose.
18.0 Payment Terms :

On account bill for the completed quantity during the month or months period depending
upon quantum of work as per schedule of work to the entire satisfaction of the Railways
and certification of authorized representative of Sr. DME(D)Pune and acceptance by
Sr. DME (D).
Bills for work done under this contract shall be prepared in triplicate by the
contractor Such bills shall be submitted to the Sr. DME (D) Pune and when passed for
payment by the Sr. Divl. Finance Manager Payment amount due made by Electronic
Fund Transfer (EFT) and for the same the contractor has to submit EFT Registration
form.

All bills for payment shall be accompanied by the following :-


Contractors challan (Three copies)
Completion certificate granted by the authorized representative of Sr. DME (D)Pune.
Acceptance certificate by the Sr. DME (D)PA.
Railway reserve the right to make any of the following deductions: -
i) Any statutory deduction as per the orders of the Govt. of India for the State Govt.
ii) Fines as per the terms of contract.
iii) Financial liability on the Railway due to defective work done by the contractor while
executing this contract.
iv) The Railway administration shall have the rights to withhold payment of dues to the
contractor if in opinion of the Railway administration there has been breach in the
terms of the contract.
19.0 Right to withhold the payment:
The railway administration shall have right and be entitled to withhold the payment of
dues of the contractors under this agreement, in the event of breach in the opinion of
the Railway administration of the terms and condition of agreement entered into by
contractors with the President of India through the Sr.Divl.Mech.Engieer (Diesel), Pune
or any authorized officer of the Central Railways.
20.0 In case of any breach of default:
Time shall be the essence of this contract in all respect. The Railway Administration
may without prejudice to its other rights and remedies or any of them whether under
this contract at any time forthwith and without notice, in the event of any breach or
default the part of the Contractor of this contract or of any of the terms and conditions
hereof. No withstanding any loss or damage to the contractor resulting from any such
cancellation. The Sr. DME (D) Pune shall be the so judge as to whether any such
breach or default has been committed by the contractor.

The following special conditions shall apply to the contract for the execution of
works. But where they differ from the General condition, the special conditions
shall over-ride the General condition.

i) The contractor shall supply Identity cards with photographs pasted and attested by the
contractor to all labourers engaged for the above job. A sample of the same has to be
submitted to Sr.DME/Dsl./PA for approval before issue. (Annexure ‘E’)
ii) The contractor shall be responsible for the general conduct and discipline of his
labourers. Railway administration reserves its right to take necessary action as
deemed fit in all cases of misconduct/ in-discipline.
iii) The contractor shall be responsible for compliance with the provision the hours
of employment regulations in respect of the staff employed by him in the manner
decided upon by the appropriate authorities.
iv) The contractor shall have to indemnify the administration against all claims for
compensation by or on behalf of any workmen employed by him. In connection with
the present contract for injury or death by an accident under workmen compensation
Act-VIII of 1923 and Administration will be entitled to deduct for any sum of money due
and payable to the contractor.
v) The contract will remain in force for a period of two years from the date of
commencement of the work. However, Railway Administration may terminate the
agreement by giving the contractor 30 days notice without assigning any reason
thereof and in the event of any breach of any condition herein contained by the
contractor in the event of any misconduct on the part of the contractor or his workman.
It shall be lawful for the Sr. DME (D) / Pune to terminate this agreement forthwith
without any notice and to forfeit the whole or part of security deposit at his discretion
without being liable to the contractor for any loss and damages what so ever
vi) The contractor shall remain liable for theft of any Railway material by his staff and he
must take necessary proceeding against staff to prevent such occurrence and shall
reimburse to administration for the loss suffered if any. In the event of this being
repeated cases, the contract shall be terminated by giving 7 days notice and the
contractor shall be liable for the damage suffered by the administration
vii) Administration reserves to itself the right to carry out a post payment audit and / or
technical examination of the works and the final bill including all supporting vouchers,
abstracts etc. and to make a claim on the contractor for the refund if any excess
amount paid to him. If as a result of such examination any over payment to him is
detected to have been made in respect of any work done or alleged to have been done
by him under the contact.
viii) This will be a running contract for a period of two years from the date of
commencement of the work. However, the railway administration may at its discretion
extend this agreement or part thereof provided the administration considers it fit and
proper in the circumstance to do so. The administration is the sole judge to take a
decision in the matter without any reference to the contractor. The administration will
grant the extension at its discretion.
ix) The contractor shall remain liable for theft of any railway material by his staff and high
penalty/fine will be imposed by the railway administration as deemed fit for each case
which will be deducted form the bill.

x) The final acceptance of the tender shall rest with the competent railway authority who
reserve the right to accept or reject any tender or all tenders without assigning any
reason. The validity of the tender will be kept open for 90 days from the date of
opening
xi) The contractor/contractors shall agree (s) that all condition stipulated in the tender
schedule which forms part of the tender submitted by him/them are acceptable to him/
them.
xii) That the tender condition/instructions to tenders should form part of this document and
are enclosed herewith. Any breach of these conditions will constitute breach of
contract
xiii) Water and electricity required for the works will be supplied free of cost by Railways. In
case of any break down in water & power supply Railways is not liable to pay towards
any loss incurred by the contractor on this account. Necessary space will be provided
by Railways free of cost for storage of material. The space shall under no
circumstances be used for any other purpose

21.0 Penalty Clause:


A penalty of Rs.200/- will be charged towards every incidence of unsatisfactory
performance of the work. Delay in carrying out the work, poor cleanliness or non-
working of vital machinery /equipment, inadequacy of manpower etc. shall be treated
as unsatisfactory performance.
Decision regarding unsatisfactory performance taken by Sr. DME (D) or his
representative will be binding on the contractor.
Any damage to the Railway equipment/ property during working in shops, offices etc.
on the part of the contractor shall be recovered equal to he cost of damage.

22.0 Other condition:


The contract shall be governed by General condition of contract as applicable.
All the terms and condition in the tender form are also equally applicable.

WHEREAS M/s. _ _ _ __ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _ _one of our constituents, (hereinafter called the “Contractor”)
have agreed to carryout the above work at premises of Diesel Shed, Pune. (herein after referred to as the “Government”)_

said contract”).

AND WHEREAS according to the terms of said contract, it has been stipulated that payment of 5% of the value of the work
would be made, provided that the contractor furnish to the Purchaser a Bank Guarantee from a recognised bank,
acceptance to the purchaser for 5% of the value of the said contract, valid for a period covering in full the Guarantee period
as per warranty clause of the said condition of the contract, being the conditions attached to and forming part of the said
contract.

AND WHEREAS the contractor have approached us to give the said Bank Guarantee on their behalf in your favour for an
amount representing 5% of the value of the said contract which you have agreed to accept.

That in consideration of the promises and at the request of the said Contractor, we hereby irrevocably undertake and
guarantee to pay to the Government of India or at such other place as may be determined by you forthwith on demand and
without any demur, any sum upto a maximum amount of Rs. _________________________________ only (Rs.
_________/-) representing 5% of the value of the work carried out under the said contract in case the Contractor make
default in paying the said sum or make any default in the performance, observance or discharge of the guarantee contained
in the said contract.

We agree that the decision of the Government, whether any default has occurred or has been committed by the Contractors
in the performance, observance or discharge of the guarantee aforesaid shall be conclusive and binding on us.

Government shall be at liberty, from time to time, to grant or allow extension of time or give other indulgence to the said
Contractors or to modify the terms and conditions of the contract with the said Contractors without affecting or impairing this
guarantee or our liability hereunder.

This bank guarantee comes into force when the work carried out as per scope of work under the said contract, and will
remain in full force and effect upto _ _ _ _ _ _ _ _i.e. for _ _ _ _ _ _ months counted from the date of carried out the work
and shall continue to be enforceable for further six months i. e., upto _ _ _ __ _ (date), hereinafter called the said date.

That no claim under this guarantee shall be entertained by us unless the same has been preferred by the Government
within the said date.
