Municipal Fish Sanctuaries Law
A. Municipal Waters of the City shall be comprised of all the rivers, streams, and, inland bodies of
water enclosed with the territorial jurisdiction thereof, including marine waters enclosed two (2)
lines drawn perpendicular to the general coastline from points where the boundary lines of the
City touch the sea at low tide and a third line parallel to the general coastline including offshore
island and fifteen (15) kilometers from such coastline. For the purposes of this Code, they shall
be divided into inland Municipal Waters and Marine Municipal Waters.
B. The Inland Municipal waters shall include the Molugan River and the streams, creeks or portion
thereof located within the Territorial boundaries of the City.
C. Territorial Boundaries of Municipal Marine Waters, Pursuant to the Local Government Code of
1991, the Philippine Fisheries Code of 1998, and as defined in this Code, the marine waters
within the municipal waters of the city shall be within the following geographic coordinates.
Section 13. Division and Classification of the Marine Municipal Waters. The municipal waters shall be
divided into the following zones.

Section 15. CitY Fishing Zone. The City Fishing Zone shall comprise all waters within the Inland Municipal
Waters and Marine Municipals Waters. No person shall be permitted to fish within the Cith Fishing Zone
unless he is duly registered with the Registry of City Fishfolk. The City Fishing Zone may be further
subdivided into sub-zones for various species fishing activities by the City Mayor, through the FMU.
The same area and geographic coordinates as provided in Article D. Section 13, Subsection D of
this Code.
Provided, that not more than fifteen percent (15%) of the surface area of the rivers of the City
may be devoted to aquaculture, mariculture and serviculture purposes; Provided further, that no fish
pens shall be permitted within the rivers; and provided finally, that nothing in this section shall be
interpreted to justify the construction of structures that pose obstruction to navigation, the flow and
ebb of tides, or the migration paths of fish and other aquatic species.
Section 17. Fishery Refuges/ Sanctuaries. The Fishery Refuges/ Sanctuaries of the City shall be
comprised of the area included within the following geographic coordinates:
Provided, that the Sanggunian may, through the appriopriate ordinates and upon
recommendation of and consultation with the CFARMC, eatablish additional in accoor Fish Refuges/
sanctuaries as may be necessary in accordance with Section 17, Article D. hereof.
All fishing activities are prohibited within the Fish Refuges/Sanctuaries. No license shall be
interpreted to justify any form of fishing activity within the designated Fish Refuges/Sanctuaries.
Section 18. Demarcated Areas. The areas enclosed by the following geographic coordinates are
hereby designated as Demarcated Areas:
All areas or zones under Section 13 Article D of this Code not otherwise identifies as reserved for
construction of fish cage, fish landing area, catching and taking of bangus fry, government reserved,
seaweed culture and mangrove areas shall be considered as demarcated areas. Within such areas, the
cooperatives or associations of resident City fisherfolk shall have priority and preference in the grant of
license, concessions, or other exclusive rights for fish capture, mariculture, or fish farming. They shall
likewise be entitled to exercise such exclusive privileges as may be identified pursuant to the provisions
of the Fisheries Department of the City.
Section 19. Division of Major Zones into Sub-zones. The major zones provided herein may be
further subdivided into sub-zones for specific fishing gear or activities by the City Mayor, acting through
the Fisheries Management Unit provided for in Article G, in accordance with the Fishery Development
Plan of the City, or the management plan of the special agencies in the case of waters falling under the
jurisdiction of other offices or agencies.
Section 20. Marking of Zone. The Office of the City Agriculture shall mark the boundaries of the
foregoing zones using appropriate, easily-available and cost-effective materials and methods such as
color-coded flags, coastal markers, and buoys. Such markings shall be publicized and disseminated to
the concerned members of the population of the City, and shall also be posted in prominent places in
the Fishery Management Unit.
CHAPTER III
MANAGEMENT AND DEVELOPMENT OF COASTAL FISHERIES
Section 21. Ban of Fishing of Certain Species. It is hereby prohibited to fish for the species
enumerated in Section 22 hereof, Provided, that subsequent to the effcetively of this Ordinanc, the
Sanggunian may impose a ban on the fishing of any other particular and additional species, upon
consultation with the CFARMC, througn an appropriate ordinance for that purpose;
Provided further, that should the BFAR or DENR declare any other aquatic species be rare,
threatened, or endangered, the same shall be considered as automatically included herein below.
Section 22. Closed Seasons. In order to permit the species to regenerate their population, it is
hereby prohibited to fish for the following species of fish and other aquatic species during the period
indicated;
