Affiday State of South Dakota, County of MEADE My current legal name is Staci Margheim, and my current occupation is Paralegal, Researcher, Artist, And Disabled Veteran. | am presently 45 years old, and my current address of residence is PO Box 156, Deadwood, South Dakota 57732. | signed a rental agreement with hotel manager, Dawn Kelly at the Stagebarn Lodging, L. L. C. also known as Ramada inn located at 7900 Stagestop Road, Summerset, SD 57718. This monthly rental contract was signed on 2/18/2018. This binding contract was to end on 3/20/2018. The monthly hotel room rent was 750.00 and was paid on 2/18/2018 and that also included the security deposit of 200.00, This was paid on 2/18/2018 as well. The room was in excellent condition and there was no damage during my entire stay at this location, During this entire stay at the hotel, | was subject to verbal and criminal harassment by Dawn Kelly for no just cause. | was told different rental dates and was threatened with an illegal 3-Day Notice To Quit(verbally) for no just cause even though there was a rental agreement already signed. Then, she advises me that hotel rental dates are subject to change. She proceeds to give me dates of May 18, 2018, April 18, 2018, and March 18, 2018-verbally. This is in violation of SD verbal contract law. This situation happened out in the parking lot front of the hotel lobby. | stated, "How would she like her mortgage due dates to change on different month without her notification?", and | proceeded to leave the premises to do some work. This activity by Dawn Kelly is in violation of SDCLR regarding street harassment. | had some clothing that was stolen from the hotel room and reported it to local law enforcement. | sent her a Cease and Desist e-mail and copy of SD Tenant's Rights on 3/12/2018. During the morning hours of 3/13/2018 between 7A.M. and 11:30 A. M., | was heading out to the parking lot and she was standing behind the hotel desk in the lobby and she immediately became rude, hostile, and belligerent after she was e-mailed the cease and desist letter and a copy of SD Tenant's Rights. | proceeded to digitally record this incident and she became even more hostile, rude, and belligerent for no just cause. She proceeded to contact her Attorney and local law enforcement. While I was in the lobby near the breakfast entrance, she comes marching around the comer into the lobby while I was digitally recording her actions and she initiated a simple assault against me by trying to deter me from from digital recording and aggressively touching my nose. | effectively blocked and deterred her from further acts of aggression. | shouted and pointed to her and said, "THAT'S AN ASSAULT!" and quickly left the building. | sat in my truck with the doors locked until local law enforcement arrived, These acts of physical harassment was initiated and created by Dawn Kelly. Local law enforcement arrived and | decided to leave under escort of law enforcement. The hotel room was clean and no damages. Officer Brandy Palmer assisted me and | digitally recorded the condition of room was in the same condition that was before which was excellent. While out in the parking lot, local law enforcement hands me a fraudulent document to sign that was produced by Dawn Kelly. It-had-my-forged-pen-name-of Viktoria Sigrun-listed-on-the ‘=! =e ~Sicm document, stating that | was not kicked out of Ramada Inn, Stagebarn Lodging, L. L. C.. | advised local law enforcement that | refuse to sign a fraudulent document with false statements. Local law enforcement advised me that | would not receive my $200 security deposit back if | did not sign the fraudulent document with my forged pen name. | stated that by holding my security deposit is theft by refusing to sign a fraudulent document. Local law enforcement said it was civil issue. In addition to this matter, during my stay, my hotel room would be locked and unlocked on numerous occasions during most of my stay at this location. Near the end of my rental stay, | was advised by Dawn Kelly and an associate by the name of Chad that they were going to enter my room three times a day for no reason. This is in violation of SD Tenant Law and verbal harassment for no just cause. Refer to Exhibit F, and the fraudulent document produced on 3/13/2018 by Dawn Kelly. This is a Class 5 Felony under SDCLR. *Check Fraud by back dating a check. *Agent(s) provocateur under the business legal definition are defined as follows: Person(s) who encourages, entices, or persuades another person(Plaintif) to commit crime, and then tries to get that person(Plaintiff) arrested (and/or convicted) for the same crime. Plaintiff committed NO crime.-Period Defendant criminally harassed Plaintiff in order to cause a hotel lock down in almost near armed standoff at the hotel. This indeed is called Agent(s) provocateur the Defendant ‘some of the staff at this location and caused emotional distress and unnecessary law enforcement protocols due to the Defendant's criminal harassment and activity-CREATED AND INITIATED BY THE DEFENDANT for NO JUST CAUSE. Agent(s) provocateur is a crime of terrorism and can carry heavy fines and penalties under Local, State, and local law. Holding a security deposit of $200 is theft and evidence of Landlord/Management harassment for no just cause under SDCLR for refusing to sign a fraudulent document on 3/13/2018, Return of a security deposit in a theft related matter is not a defense under SDCLR 22-30A-10. | am seeking treble damages of $600 for theft and theft by deception under SDCLR. Renting out a veterans’ protected vested partial interest of said rental property is in violation of SDCLR 22-30A-13 and is theft pursuant to SDCLR 22-30-10 and return of said rental property is not a defense for mitigation of punishment. Triple damages of $2250. This also includes violations under Chapter 38, subsection 5301. Landlord/Management retaliation for contacting local law enforcement by e-mail on 3/12/2018 and 3/13/2018 for reporting lost/stolen items by locking and unlocking the hotel room on numerous occasions and scapegoating the Plaintiff and Protected Class Member will be just cause for additional legal measures to included additional civil suits and class action(s) to remedy this situation. Producing falsified government documents, perjury, false official statements to law enforcement, perjury in a grand jury indictment, tampering with the witness(s), and perjury under cath will result in additional legal measures in order to remedy this situation. Defendant was sent Cease and Desist all forms of Defamation, Libel, and Assurance letter by regular mail on 3/21/2018. This also included to Cease and Desist all forms of Criminal Harassment and Assurance Letter on 3/21/2018 to sign and send back.
