ADMINISTRATIVE CASE RESOLUTION NO. 2016-03

RESOLUTION

Complainant Blady Mire Rabanera was charging respondent in the above-captioned


administrative case for grave misconduct and conduct unbecoming of a public officer
allegedly committed as follows:

On November 9, 2015 at around 2:00 pm, said complainant was having a drinking
spree with his friends in the frontyard of his relative Zaldy Arig. After two hours of
enjoyment, his relative Zaldy Arig accompanied and boarded complainant on a tricycle and
few minutes thereafter, the two alighted in the Plaza. While there, complainant saw
respondent with some barangay officials coming and then respondent suddenly poked his
gun at complainant’s nose and fire his gun but missed to hit complainant because somebody
was able to shove his hand. However, complainant aimed again his gun and hit respondent
in the right shoulder and as a result, complainant sustained injuries.

Hence this administrative Complaint.

When notified, the respondent submitted his verified answer denying categorically
the allegations of the complainant. Respondent averred that he received a report that
complainant was destroying the billboard of the barangay and challenging everybody to a
fight. When respondent and two CVOs proceeded to verify the matter, they chanced upon
complainant destroying the billboard and when ordered to stop and asked why did he do
that, complainant got infuriated and even uttered invectives which was heard by several
people in the Plaza, by saying “Bauninam Kapitan, patayen ta ka la natan!” (Vulva of your
mother kapitan, I will kill you now) and at the same time drew a knife at respondent.

Sensing that complainant is determined to attack respondent, the later fired a


warning shot but complainant was very determined to launch an attack which forced the
respondent to shoot complainant right shoulder.

Respondent further alleged that complainant had been a trouble maker in the
barangay with string of cases filed in the barangay and prosecutor’s office.

After the last pleading (answer) was filed, the parties were invited for a preliminary
conference before the office the City Vice Mayor for the determination of issues surrounding
the circumstances and the exploration of an amicable settlement. Then and there, the
parties were informed of their rights to pursue or defend their respective case in the proper
forum or to have their dispute settled amicably.

After a sober and searching assessment and analysis of the incident and the affidavit
of desistance submitted by the complainant before this august body, said affidavit was in
fact executed voluntarily and it has the purpose and effect of putting to an end the
administrative complaint filed by the complainant after the latter realized that respondent
did not intent to cause harm or injury upon him.

WHEREFORE, finding no probable cause against the respondent for Grave


Misconduct and Conduct Unbecoming of a Public Officer, the complaint against respondent
is hereby DISMISSED.
