Chapter 1

Article 3 of Labor Code

- To give maximum aid and protection to labor

- Protection of labor, promote full employment, ensure equal work opportunities
regardless of sex, race or creed, and regulate the relations between workers and
employers
- Should not be supposed that every dispute will be automatically decided in the
favor of labor
- Employer or management also has rights
- Every party is entitled to respect and enforcement in the interest of simple fair
play

Chapter 2

Liberal Interpretation of the Labor Code and Its Implementing Rules

- Law bends over backwards to accommodate the interests of the working class
- Those with less privileges should have more privilege in law
- Should be weighed on the scales of social justice heavier influence of the
employer should counter-balanced by the law which must accord sympathy and
compassion to the underprivileged employee
- Doctrine of Liberal Construction – cases should be determined on merits
rather than technicalities
o Cannot be applied when the law invoked is clear, unequivocal and leaves
no room for interpretation of construction
- Justice is done by properly applying the law regardless of the station in life of the
contending parties
