‫‪relationship between the Bank and the‬‬

‫‪accepted and shall comply with all the‬‬

‫‪conditions mentioned in this Terms and‬‬

‫‪request form or any other document relating to‬‬

‫‪any of the Services mentioned in these Terms‬‬
‫‪and Conditions shall be the Customer's‬‬ ‫م كككككك إ ككككككلحأل كككككك‬ ‫كككككك‬ ‫كككككك حكشككككككلتا تح‬ ‫ككككككك‬
‫‪Confirmation of having read, understood and‬‬ ‫ككككك‬ ‫كككككلة ككككك حكشكككككلتا تح‬ ‫حك م كككككا خلككككك ةلكككككا ككككك‬

‫‪2. Definitions and interpretation‬‬ ‫‪ .2‬التعريفات والتفسيرات‬

‫‪In these Terms and Conditions, the following‬‬ ‫كلمصككككككيل‬ ‫كككككك‬ ‫كككككك‬ ‫كككككك حكشككككككلتا تح‬ ‫ككككككك‬

‫‪ascribed to them as stated below:‬‬

‫‪“Bank” means Qatar International Islamic‬‬ ‫يككككككل حككككككك تك حي كككككك‬ ‫كككككك كككككك‬ ‫" البنــــــ "‬
‫‪Bank, (Also “we”, “us” or “our”).‬‬ ‫ال‪.‬‬ ‫تة ض ً ضم فل حكم ل (ةل ل‬

‫‪“Application Form” means the related service‬‬ ‫ككككك خح‬ ‫لككككك حك‬ ‫ككككك لمككككك خد‬ ‫"نمـــــوطل ال لـــــب"‬
‫‪application form signed by the Customer‬‬ ‫شكككك ا ككككةب ًح‬ ‫ككككا حك م ككككا تحككككك‬ ‫كككك‬ ‫حكصككككل حكم كككك‬
‫‪which shall constitute an integral part of‬‬

‫‪“Customer” means any individual (natural‬‬ ‫ككككككك ال‬ ‫(شككككككك‬ ‫ككككككك ة شككككككك‬ ‫"العميـــــــل " ‪:‬‬
‫‪person) or entity ( corporation or other‬‬

‫)‪business or corporate entity or organization‬‬
‫‪who is the holder of an Account(s) with the‬‬ ‫سكككككك ةعككككككلى‬ ‫ةت ة كككككك مكككككك ةت ظمكككككك تج أل كككككك ةت‬
‫‪Bank named in the account opening‬‬ ‫ككككككك ى حك كككككك‬ ‫سكككككك كك سكككككك‬ ‫( م لكككككك ك تم لكككككك‬
‫‪form/documentation and/or specified in the‬‬ ‫ككككككككك لمكككككككك خدك ت قكككككككك ككككككككك‬ ‫كككككككك و أل ك كككككككك و أل‬
‫‪Application Form of any Services mentioned in‬‬
‫كككككك حك ككككككك‬ ‫ككككككت‬ ‫حك سكككككك ك تكةت حكيلكككككك حك ككككككك‬
‫‪these terms and conditions.‬‬

‫‪“User(s)”means any of the authorized(s) on‬‬ ‫ككككككك‬ ‫ككككككك حكماككككككك نك حكما ضككككككك‬ ‫"المســـــــتخدم"‬
‫‪behalf of the customer to manage its‬‬ ‫سككككككك كك سككككككك‬ ‫كككككككا خلككككككك‬ ‫كككككككا حك م كككككككا كل‬
‫‪account(s), and notified to the Bank, whom‬‬
‫ت كككككم فم‬ ‫حك ككككك‬ ‫تتككككك إ ككككك‬ ‫حك م كككككا كككككك ى حك ككككك‬
‫‪from time to time are/is appointed to use the‬‬

‫‪Services pursuant to these Terms and‬‬ ‫ح‬ ‫كككككككك ت ككككككككي عككككككككل ال كككككككك‬ ‫كككككككك‬ ‫تحككككككككك‬
‫‪Conditions in accordance with QCB‬‬

‫‪regulations.‬‬

‫‪“Customer Instruction” means any request,‬‬ ‫لككككككك ةت ت ل مككككككك‬ ‫"تعليمـــــــات العميـــــــل" ت ككككككك ة‬
‫‪instruction or communications sent by the‬‬
‫كككككككا حك م كككككككا ةت‬ ‫إأل ككككككك كم ككككككك‬ ‫ككككككك‬ ‫ةت لح ككككككك‬
‫‪Customer or the User or any representative of‬‬
‫‪the Customer and received by the Bank‬‬ ‫م ككككك‬ ‫م كككككا كل م كككككا تتككككك ح ككككك‬ ‫ةت ة‬ ‫حكمسككككك‬
‫‪through an E-Channel with a valid‬‬ ‫ككككككا حك كككككك خ ككككككل حكق كككككك ح حكمصككككككلك حيك لتل كككككك‬
‫‪identification such as correct username,‬‬ ‫ككككككككا ح كككككككك‬ ‫كككككككك‬ ‫ت ل كككككككك‬ ‫تكقكككككككك ك لكككككككك‬
‫‪password, pin, token or any other similar‬‬
‫كككككل تك ةت أل كككككة ةت ة ككككك‬ ‫تك ةت أل ككككك‬ ‫ككككك‬ ‫سككككك‬
‫‪identification.‬‬

‫‪“Services” means any electronic banking or‬‬ ‫حكمصكككككككلك‬ ‫"الخـــــــدمات" ت ككككككك ة ككككككك ً ككككككك حك ككككككك‬
‫‪related services supplied via an E-Channel and‬‬ ‫خح حكصككككككل حكم كككككك كل خ ككككككل‬ ‫حيك لتل كككككك ةت حك كككككك‬
‫‪ancillary services that the Bank provide or‬‬ ‫حكمسككككككك خ حك ككككككك‬ ‫حكق ككككككك ح حيك لتل ككككككك تحك ككككككك‬
‫‪make available to you from time to time, as‬‬
‫‪may be further described in these terms and‬‬ ‫كككككك ت ككككككي‬ ‫قكككككك م ةت ل كل كككككك ككككككك‬ ‫قكككككك م حك كككككك‬
‫‪conditions.‬‬ ‫ككككك حك اصككككك ا‬ ‫كمة ككككك‬ ‫عكككككل خلككككك حك ككككك حكم ضككككك‬
‫‪.‬‬ ‫حكشلتا تح‬ ‫ك‬

‫‪“Security Procedures” means the facilities and‬‬ ‫"اإلجــــــراءات األمنيــــــة" ت كككككك حي ككككككلحبح تحك يكككككك ح‬
‫‪procedures used to control the operation of‬‬ ‫ككككككك تشكككككك ا وككككككا كككككك حكق كككككك ح‬ ‫حكم كككككك كلكككككك‬
‫‪each of the E-Channels and the Services as set‬‬
‫ككككك‬ ‫ضككككك كككككك‬ ‫ومككككك ككككك‬ ‫حيك لتل ككككك تحك ككككك‬
‫‪out in these terms and conditions.‬‬

‫‪“Authentication tool” means the physical or‬‬ ‫ككككككككك ةت‬ ‫"أداة تحقـــــــــ الـــــــــدخول" ت ككككككككك ح ح حكملم‬
‫‪virtual tool(s) or any type of solutions provided‬‬ ‫قككككك‬ ‫حك ق ككككك حك ككككك‬ ‫حكملف ككككك ةت ة لككككك ل ككككك حك لككككك‬
‫‪by the Bank to the User to use it to complete‬‬
‫م‬ ‫ةت كككككككككك حك م ككككككككككا تخككككككككككك ك سكككككككككك‬ ‫حك كككككككككك‬
‫‪the accessing process to the concerned‬‬
‫‪Service.‬‬ ‫ككككككك‬ ‫إكككككككك حك‬ ‫خمل ككككككك حكككككككك ع‬ ‫يتمككككككك‬ ‫حكمسككككككك‬
‫‪.‬‬ ‫حكم‬

‫‪3. Services currently provided‬‬ ‫‪ 3.‬الخدمات المقدمة‬

‫)‪a‬‬ ‫‪Phone Banking service‬‬ ‫حكمصلك‬ ‫حكم ت‬ ‫ع‬ ‫ة‪-‬‬
‫)‪b‬‬ ‫‪Internet Banking and mobile banking‬‬ ‫حيل للي تحكج ح حكمصلك‬ ‫ك‪ -‬ع‬
‫)‪(Personal/Corporate‬‬ ‫( ك كلح كحكشلو ال‬
‫)‪c‬‬ ‫‪ATM service‬‬ ‫‪ -‬ع حكصلحف ح ك‬
‫‪4. Transactions‬‬ ‫‪ 4.‬العمليات المصرفية‬
‫‪4.1.‬‬ ‫‪All automated banking instructions that the‬‬ ‫حكمصككككككلك حكصكككككك أل كككككك حك م ككككككا‬ ‫‪ 4.1‬و ككككككك حك ل مكككككك‬
‫‪Customer issues and sends to the Bank shall be‬‬ ‫ت ا كككككك‬ ‫كككككك‬ ‫ك كككككك ح‬ ‫إككككككك حك كككككك تحكم لقكككككك‬
‫‪executed on the same day, if it completed, in‬‬ ‫ملككككككك‬ ‫ككككككك تأل‬ ‫ككككككك‬ ‫كككككككك‬ ‫حك ككككككك‬ ‫كككككككك لاككككككك‬
‫‪case it issued up to 1 p.m. on any banking day in‬‬
‫‪state of Qatar. The instructions sent after 1 p.m.‬‬ ‫خمكككككا ككككك‬ ‫ككككك‬ ‫مكككككل ًح كككككك ة‬ ‫ككككك حكسككككك خ حك ح ككككك‬
‫‪shall be executed on the next banking day.‬‬ ‫تكككككك يكككككل ة ككككك حك ل مككككك‬ ‫خمكككككا حك ككككك ‪ ،‬كككككك‬ ‫ة ككككك‬
‫مككككككل ًح‬ ‫كككككك حكسكككككك خ حك ح كككككك‬ ‫حكمل ككككككل إككككككك حك كككككك‬
‫حك ما حك ك ‪.‬‬ ‫ك‬ ‫تا‬

‫‪4.2.‬‬ ‫‪The banking services made through the‬‬ ‫حكمصككككككلك حك كككككك ت اكككككك يل ككككككا حك ككككككك‬ ‫‪ 4.2‬حك كككككك‬
‫‪Electronic Banking Services may not always‬‬ ‫حكمصكككككككلك حيك لتل ككككككك ككككككك ال ت اككككككك كككككككك لاككككككك‬
‫‪executed in the same day. Delays maybe occur‬‬
‫تككككككتع ل ل كككككك ك ح ككككككا‬ ‫كككككك‬ ‫ت كككككك حكجكككككك فة ة‬ ‫حك كككككك‬
‫‪for many reasons including but not limited to‬‬
‫‪the time or date of giving the instructions,‬‬ ‫ةت ت كككككي‬ ‫ككككك ا حكم ككككك ال حك صكككككل ككككك‬ ‫خلككككك‬ ‫شككككك‬
‫‪holidays or system problems. The Bank shall not‬‬ ‫ح ككككك ح ةت ح خيككككك حك ككككك‬ ‫ةت ة ككككك‬ ‫إخيككككك ب حك ل مككككك‬
‫‪be liable for any loss resulting from the delay of‬‬ ‫ككككككككل خككككككككك‬ ‫كككككككك ح ككككككككك إككككككككك‬ ‫ككككككككلن كمكككككككك حك‬
‫‪the execution of banking transactions.‬‬

‫‪4.3.‬‬ ‫‪The Customer access and uses the Electronic‬‬ ‫كككككككك حك كككككككك‬ ‫ح حك م ككككككككا ة‬ ‫ت إ كككككككك‬ ‫عكككككككك‬ ‫‪ 4.3‬إ‬
‫‪Banking Service shall be subject to the Bank’s‬‬ ‫ع ضككككككك كلم حكقككككككك‬ ‫ككككككك‬ ‫حكمصككككككلك حيك لتل ككككككك‬
‫‪approval and binding to both of them in the case‬‬
‫تة ككككك ل يككككككةح حك ككككك تحك م كككككا‬ ‫كككككا حك ككككك‬ ‫ككككك‬
‫‪of any legal dispute. The Customer’s statement‬‬
‫‪of account shall include all banking operations‬‬ ‫ت كككك ف ضككككم‬ ‫ة عكككك ف كككك ل ل‬ ‫ككككك ت كككك‬ ‫ككككك‬
‫‪performed through the Electronic Banking‬‬ ‫ككككككككما م كككككككك‬ ‫سكككككككك ك حك م ككككككككا حكصكككككككك أل‬ ‫وشكككككككك‬
‫‪Service.‬‬ ‫ل ككككككككا‬ ‫خكككككككك‬ ‫حكمصككككككككلك حك كككككككك لاكككككككك‬ ‫حك مل كككككككك‬
‫حكمصلك حيك لتل ‪.‬‬ ‫ح حك‬ ‫ح‬

‫‪4.4.‬‬ ‫‪The Customer shall not make any transfers or‬‬ ‫كككككككك لحب ة‬ ‫خلكككككككك حك م ككككككككا ككككككككت ال قكككككككك‬ ‫كككككككك‬ ‫‪4.4‬‬
‫‪issue instructions or request transactions‬‬ ‫تة ككككك خككككك‬ ‫ةت ل ككككك‬ ‫ةت خمل ككككك‬ ‫ةت ت ل مككككك‬ ‫ت ككككك‬
‫‪exceeding the balance available in his account.‬‬
‫‪Otherwise, the Bank shall be entitled to refuse‬‬ ‫كككك ق‬ ‫كككك ك‬ ‫ككككك حكق كككك‬ ‫ك سكككك ك تككككك‬ ‫أل كككك‬
‫‪to execute the transfer, instruction or‬‬ ‫ةت‬ ‫ةت حك ل مكككككككك‬ ‫حك كككككككك ككككككككك ألح ككككككككلكأ حك كككككككك‬
‫‪transaction immediately and without the need‬‬ ‫إك ة إعي أل‪.‬‬ ‫ت حك‬ ‫ةت حكيل‬ ‫حك مل‬
‫‪of any notification.‬‬

‫‪4.5.‬‬ ‫‪The Bank shall execute the Customer’s‬‬ ‫ةت حك مل كككككككككككك‬ ‫ةت حك ل مكككككككككككك‬ ‫‪ 4.5‬و ككككككككككككك حك كككككككككككك‬
‫‪transfers, the instructions, the transactions or‬‬ ‫ت ا كككككك‬ ‫حكصكككككك أل كككككك حك م ككككككا كككككك‬ ‫ةت حكيل كككككك‬
‫‪the requests at the Bank’s rate of exchange or‬‬
‫‪interest rates at the date of execution.‬‬ ‫ككككككا تة ككككك أل حك حفككككك حكسكككككك أل‬ ‫ح ة ككككك أل حك‬ ‫ككككك‬
‫ك ت أل خ حك ا ‪.‬‬ ‫تحكمي ق ك حك‬

‫‪4.6.‬‬ ‫‪The Customer shall be responsible for all‬‬ ‫حكم اككككك‬

‫‪transactions executed through the use of the‬‬
‫ككككككككك ح ة سككككككككك ق‬ ‫ككككككككك ح حك ككككككككك تخككككككككك‬
‫‪Service and the payment of any amount due to‬‬
‫‪the Bank resulting from such use.‬‬ ‫ح ‪.‬‬ ‫ح حال‬ ‫ل تج خ‬ ‫كص ك حك‬

‫‪4.7.‬‬ ‫‪The Bank may treat all the Customer‬‬ ‫حك م ككككا حكسكككك أل‬ ‫م كككك ت ل مكككك‬ ‫ككككل حك كككك‬ ‫كككك ف‬ ‫‪4.7‬‬
‫‪Instructions received by the Bank through an E-‬‬ ‫كككككككك حكق كككككككك ح‬ ‫سككككككككلمم حك كككككككك خ ككككككككل ة‬ ‫حك كككككككك‬

‫‪concerning the Customer accounts or affairs.‬‬

‫‪The Bank shall be under no obligation to check‬‬

‫‪the authority of the person or persons giving‬‬ ‫حك م كككككككا‬ ‫ت ل مككككككك‬ ‫ككككككك‬ ‫سككككككك تك حك قكككككككا ككككككك‬

‫‪Instruction for whatever reason, the Bank will‬‬ ‫حك كككككككك و ككككككككك حكجمكككككككك‬ ‫كككككككك ف كككككككك‬ ‫كككككككك ك‬ ‫ح‬
‫‪make all reasonable efforts to comply with the‬‬
‫‪Customer request. However, the Bank shall not‬‬ ‫كككككك‬ ‫ككككك كيلككككك حك م كككككا‪ .‬ت ككككك خكككككك‬ ‫حكم ق كككككك ك‬
‫‪be liable for any failure to cancel or modify the‬‬ ‫ككككككل سكككككك ت خكككككك ة كشككككككا ككككككك إك كككككك ب ةت‬ ‫حك كككككك‬
‫‪Customer Instruction if such a request is‬‬ ‫كككككا ككككك ح‬ ‫كككككك تلقككككك‬ ‫حك م كككككا كككككك‬ ‫ت ككككك ا ت ل مككككك‬
‫‪received at a time or under circumstances that‬‬
‫ككككك‬ ‫كككككا كككككلتف ت ككككك‬ ‫حكيلككككك كككككك ت كككككي ةت كككككك‬
‫‪render the Bank unable to comply with the‬‬

‫‪Security Procedures and any other instructions‬‬

‫'‪the Bank may issue regarding the E-Channels‬‬
‫‪security. The Customer agrees his responsibility‬‬ ‫حكمصككككككلك حالك لتل كككككك ومكككككك‬ ‫شككككككت ة كككككك حك كككككك‬
‫‪to set up, maintain and regularly review security‬‬ ‫حلكككككا حككككككا خلككككك ت مكككككا سككككك تك إخككككك ح حي كككككلحبح‬
‫‪arrangements concerning its access to and use‬‬ ‫ظمكككككك‬ ‫ككككك تحك اككككك ن خل مكككككك تت ق مككككك صككككك أل‬ ‫ح‬
‫‪of each of the E-Channels and information‬‬

‫‪Customer confirms that he has assessed the‬‬ ‫ككككك‬ ‫ح‬ ‫حك لت ككككك‬ ‫ق ككككك‬ ‫ككككك‬ ‫تلكككككا ككككك‬ ‫ككككك‬ ‫تح‬
‫‪security arrangements set out in these Terms‬‬
‫‪and Conditions, and have determined that they‬‬ ‫ككككككك‬ ‫ككككككك حكشكككككككلتا تح‬ ‫خل مككككككك كككككككك‬ ‫حكم صككككككك‬

‫‪any actual or attempted unauthorized access to‬‬
‫‪the E-Channels or any unauthorized transaction‬‬ ‫ككككل صككككل مكككك إككككك حكق كككك ح‬ ‫تككككك عكككك‬ ‫ك لكككك ةت‬
‫‪or attempt to execute an unauthorized‬‬ ‫ككككككككل صككككككككل مكككككككك ةت ة‬ ‫لكككككككك‬ ‫حيك لتل كككككككك ةت ة‬
‫‪transaction pursuant to these Terms and‬‬ ‫كككككل صككككككل مكككككك تكقكككككك‬ ‫لكككككك‬ ‫تكككككك ك ا كككككك ة‬

‫‪5.4.‬‬ ‫‪The Customer must ensure that neither the‬‬ ‫ت ككككك‬ ‫حكق ككككك‬ ‫ككككك خككككك‬ ‫خلككككك حك م كككككا حك توككككك‬ ‫ككككك‬ ‫‪5.4‬‬
‫‪Customer, the Users nor its employees do‬‬ ‫كككك‬ ‫كككك حكشككككلتا تح‬ ‫ككككل‬ ‫ة كككك ب كككك‬ ‫تصككككلك‬
‫‪anything during or after the term of these Terms‬‬ ‫كككككككا‬ ‫لكككككككا ةت ككككككك‬ ‫ككككككك حب ككككككك‬ ‫ةت ككككككك حل م فمككككككك‬
‫‪and Conditions which may impact the security‬‬
‫‪of the E-Channels, or the systems or security of‬‬ ‫ككككك شكككككتلم ة تككككك ل‬ ‫ا كككككا تحك ككككك‬ ‫ا ةت‬ ‫سككككك‬
‫‪any of the Banks’ customers.‬‬ ‫ككككككك‬ ‫خلككككككك ة ككككككك حكق ككككككك ح حيك لتل ككككككك ةت ة ككككككك ة‬

‫‪5.5.‬‬ ‫‪Access to the Electronic Banking Service is‬‬ ‫ككككك حكمصككككككلك حيك لتل كككككك‬ ‫حك‬ ‫خلكككككك لظكككككك‬ ‫‪ 5.5‬حكككككك ع‬
‫‪password protected. The Customer shall create‬‬ ‫خلككككك حك م كككككا ة قككككك‬ ‫ككككك‬ ‫كككككم‬ ‫ككككك‬ ‫كل ككككك‬
‫‪his own personal password for his exclusive use.‬‬

‫‪The password shall be at his own responsibility‬‬

‫‪security requirements, and shall not reveal his‬‬ ‫كككككا تت كككككي سككككك تك ا ت جككككك خلككككك حك م كككككا‬ ‫عككككك‬

‫‪password if he becomes aware that another‬‬ ‫سككككك تك خكككككك‬ ‫إخح تصككككك ف خلككككك حك كككككل كككككا تتقككككك‬
‫‪person knows it and bear full responsibility for‬‬
‫‪this. Where the password is not changed, any‬‬ ‫ككككل حكل ككككة حكسككككل ككككك ة‬ ‫ت‬ ‫ككككك خكككك‬ ‫خل ككككاي تككككك‬
‫‪instructions or banking transactions shall be‬‬ ‫ح حكل كككككة‬ ‫ككككك‬ ‫صكككككلك تككككك‬ ‫ةت خمل ككككك‬ ‫ت ل مككككك‬
‫‪regarded as done by the Customer. The Bank‬‬ ‫ككككل كككك أل كككك حك م كككككا‬ ‫ل ككككا حك كككككل ت‬ ‫حكسككككل خكككك‬
‫‪shall not be responsible in any way where‬‬ ‫سككككككككككك تك ا تم ككككككككككك ً‬ ‫لاسكككككككككككا ت لككككككككككك حك ككككككككككك‬
‫‪instructions or transactions are made by‬‬
‫‪another person’s use of the password.‬‬ ‫ح حكل ككككككة‬ ‫كككككك‬ ‫تكككككك‬ ‫ةت خمل كككككك‬ ‫خكككككك ة ت ل مكككككك‬
‫ل ا حك ل‪.‬‬ ‫حكسل خ‬

‫‪5.7.‬‬ ‫‪The Customer shall be responsible for all‬‬ ‫ككككككككل حك م ككككككككا سككككككككي ًال خكككككككك و ككككككككك حك ل مكككككككك‬ ‫‪5.7‬‬
‫‪instructions or transactions sent to the Bank‬‬ ‫ةت حك مل كككككككك حكمل ككككككككل ككككككككا إككككككككك حك كككككككك ح كككككككك حب‬
‫‪from the moment he accesses the service by‬‬
‫‪using the Bank’s security procedures until he‬‬ ‫ح حي كككككلحبح‬ ‫ككككك‬ ‫ككككك‬ ‫ككككك ت كككككي ع ككككككا إكككككك حك‬
‫‪exits. These transactions shall be entered in the‬‬ ‫كككك‬ ‫كككك ت كككك ق‬ ‫كككك إككككك ت ككككي علت ككككا كككك حك‬ ‫ح‬
‫‪Bank’s records and are deemed final and non-‬‬ ‫حك ككككككك ت ال كككككككا كل م كككككككا‬ ‫كككككككج‬ ‫كككككككك‬ ‫حك مل كككككك‬

‫‪amendments thereof shall be published on the‬‬

‫‪Bank’s tariffs and may be changed from time to‬‬
‫‪time. The Customer shall be able to see them at‬‬ ‫كككككك ت ككككككي عككككككل ت م كككككك كل م ككككككا حي كككككك ل خل مكككككك‬
‫‪any of the Banks’ branches or the Bank official‬‬ ‫ككككككتت خلكككككك حكم كككككك حكل ككككككم‬ ‫كككككك كككككككلتل حك‬ ‫كككككك ة‬
‫‪website www.qiib.com.qa . The customer shall‬‬ ‫‪ www.qiib.com.qa‬ت ل ككككككككككككة حك م ككككككككككككا‬ ‫كل كككككككككككك‬
‫‪pay all requested services fees in order to be‬‬
‫حك ككككككك‬ ‫ك ككككككك‬ ‫ككككككك‬ ‫حك‬ ‫سككككككك ح و كككككككا حكل ككككككك‬
‫‪executed by the Bank.‬‬

‫‪with service fees and charges. The Customer‬‬ ‫حكككككككككا‬ ‫سكككككككك ك حك م ككككككككا تحككككككككك‬ ‫شككككككككل كككككككك‬
‫‪agrees to pay the fees and charges for the‬‬
‫ككككككةب‬ ‫كككككك ةت ة‬ ‫حك‬ ‫ت صكككككك أل‬ ‫كككككك ح أل كككككك‬ ‫خلكككككك‬
‫‪service or any part of it.‬‬

‫‪entitled to suspend, withdraw or limit the use of‬‬

‫‪all or part of the Services for the protection of‬‬
‫‪its Customer. The Bank shall notify the‬‬ ‫حك ككككككك‬ ‫كككككككةب مككككككك ت قككككككك‬ ‫ككككككك ةت ة‬ ‫حك م كككككككا كل‬

‫‪provide the Services. However, the Bank shall‬‬ ‫كككككككل سكككككككي ًال خككككككك ة إعاككككككك خ كككككككك تقككككككك‬ ‫تال‬
‫‪not be liable for any failure to provide all or part‬‬
‫‪of the Bank Electronic Banking Services for any‬‬ ‫كككككك ح‬ ‫ت ضككككككم‬ ‫كككككك‬ ‫ةف كككككك ً ةت ول كككككك ً‬ ‫حك كككككك‬
‫‪reason including in particular any suspension‬‬ ‫لككككككك ت‬ ‫ة إ قككككككك ف كل ككككككك‬ ‫خلككككككك ت كككككككا حك صككككككك‬
‫‪due to maintenance or upgrades or defect to‬‬ ‫خكككككك حكصكككككك ل ةت ت كككككك م ةت علككككككا ككككككك حككككككك ظ ككككككك ى‬
‫‪the Banks’ systems or those at any party the‬‬ ‫م حك كككككك ك قككككككك‬ ‫مكككككك سكككككك‬ ‫حك كككككك ةت خكككككك ة‬
‫‪Bank uses to provide the Services.‬‬

‫‪7.3.‬‬ ‫‪A transaction being carried out is not always‬‬ ‫حفمكككككككك‬ ‫ال ت كككككككك‬ ‫جككككككككل ت ا كككككككك‬ ‫‪ 7.3‬حك مل كككككككك حك كككككككك‬
‫‪simultaneous with an Instruction given. Certain‬‬ ‫شكككككككتلم كككككككك أ‬ ‫ككككككك إخيككككككك ب حك ل مككككككك‬ ‫ةح ككككككك‬
‫‪transactions may take more time to process and‬‬
‫ككككك تسككككك لخ ة ككككك ًح ككككك حك كككككي كم كج مككككك‬ ‫حك مل ككككك‬
‫‪certain Instructions will only be processed‬‬
‫‪during the Business Day and during normal‬‬ ‫ككككك‬ ‫كج مككككك عككككك‬ ‫ككككك ف تككككك‬ ‫ت كككككأ حك ل مككككك‬
‫‪working hours although the Services are‬‬ ‫ككككك أل ككككك ة‬ ‫حك مكككككا حك‬ ‫ككككك خ‬ ‫حك مكككككا كقككككك تعككككك‬

‫‪to the Customer enhancements, improvements‬‬ ‫كككككككككككك‬ ‫حك‬ ‫تحك ل كككككككككككك‬ ‫تحك سكككككككككككك‬ ‫حك كككككككككككك‬
‫‪and upgrades to the existing Services, which‬‬
‫‪shall be governed by the provisions of these‬‬ ‫جككككككك ح ت ضككككككك كمككككككك‬ ‫حك ك ككككككك تحك ككككككك‬ ‫ك ككككككك‬
‫‪Terms and Conditions.‬‬ ‫‪.‬‬ ‫حكشلتا تح‬

‫‪7.5.‬‬ ‫‪From time to time the Bank may suspend some‬‬ ‫ككككك ت كككككي عكككككل ت ل كككككا كككككأ ةت وكككككا‬ ‫‪ 7.5‬جككككك كل ككككك‬
‫‪or all of the E-Channels or Services for routine,‬‬
‫ككككككلحن حكصكككككك ل‬ ‫حكق كككككك ح حيك لتل كككككك ةت حك كككككك‬
‫‪non-routine or emergency maintenance or for‬‬
‫‪any other reason where we reasonably consider‬‬ ‫كككككك‬ ‫حكلتت كككككك ةت ككككككل حكلتت كككككك ةت حكي ألفكككككك ةت‬
‫‪it necessary to do so.‬‬ ‫ك ‪.‬‬ ‫حكضلتأل ة ق‬ ‫تعل ج ا‬

‫‪contact the Bank Call Centre to activate the‬‬ ‫تإلشكككككككك ب حكل ككككككككة‬ ‫كككككككك‬ ‫ع كككككككك حك مكككككككك ب ك ا ككككككككا حك‬
‫‪Service and create his password.‬‬

‫‪transaction by the use of his password under‬‬ ‫قككككك ً‬ ‫كككككا‬ ‫ح حكل كككككة حكسكككككل حك ككككك‬ ‫ككككك‬ ‫حكمصكككككلك‬
‫‪the banking telephone system. The instructions‬‬
‫‪shall be deemed issued by the Customer‬‬ ‫ككككككككا‬ ‫ككككككككل كككككككك أل‬ ‫حكمصككككككككلك تت‬ ‫حكمكككككككك ت‬ ‫ك ظكككككككك‬
‫‪personally and if full responsible for this. The‬‬ ‫ش صككككك ً ت كككككل سكككككي ًال خ مككككك سككككك تك ً و لككككك تكككككك‬
‫‪Bank shall not be liable for the accuracy of the‬‬ ‫كككككككك ة ت ل مككككككككك‬ ‫كككككككك حك كككككككك سككككككككي ًال خكككككككك‬
‫‪Customers instructions or requested banking‬‬ ‫صكككككلك قككككك مككككك حك م كككككا تتق ككككك ككككك‬ ‫ةت خمل ككككك‬
‫‪transactions. These banking transactions shall‬‬
‫‪be entered in the Banks’ books and deemed‬‬ ‫ت ال ككككككا‬ ‫حك ككككك‬ ‫كككككج‬ ‫حكمصكككككلك ككككككك‬ ‫حك مل ككككك‬

‫‪to his mobile number registered at the Bank,‬‬ ‫ككككا تحكمسككككجا ككككك ى ك كككك‬ ‫حكجكككك ح حك كككك‬ ‫حكمكككك ت‬ ‫كككككل‬

‫‪3 attempts to input the correct Password to gain‬‬ ‫كككككككك تال كقكككككككك ي عكككككككك ولمكككككككك حكمككككككككلتأل حكصكككككككك‬
‫‪access to the Services. After the third incorrect‬‬
‫‪attempt the Customer’s account will be blocked‬‬ ‫ككككل كككك‬ ‫تككككك‬ ‫كككككم‬ ‫كككك‬ ‫كككك‬ ‫إككككك حك‬ ‫كلكككك ع‬
‫‪and he must contact the Bank’s Call Centre to‬‬ ‫ككككك حك كككككك خلككككك‬ ‫إ قككككك ف حك سككككك ك تكككككك‬ ‫ككككك ف ككككك‬

‫)‪d‬‬ ‫‪Any instructions given to the Bank using your‬‬ ‫ح‬ ‫ككككككككككك‬ ‫تصككككككككككك أل إكككككككككككك حك ككككككككككك‬ ‫‪ -‬ة ت ل مككككككككككك‬
‫‪user name and password and enter key‬‬ ‫تولمككككككك حكمكككككككلتأل ت ا ككككككك حكككككككك ع‬ ‫ح ككككككك حكمسككككككك‬
‫‪authentication tool will be considered as legally‬‬

‫‪confirmed by the secret authorization code,‬‬
‫‪which has been sent to the Customer’s‬‬ ‫إأل ككككك كا إككككك حكجككككك ح‬ ‫كككك‬ ‫ككككا حكسكككككل حككككك‬ ‫ل ككككة حك‬
‫‪registered mobile number, shall be considered‬‬ ‫ك م كككككككا تحكمسكككككككجا أل مكككككككا كككككككك ى‬ ‫حك ككككككك‬ ‫حكم مككككككك‬

‫‪owner of the mobile phone line and number‬‬
‫حك ككككك ت وككككك خلككككك‬ ‫كككككج‬ ‫حكمسكككككجا كككككك‬ ‫حكم مككككك‬
‫‪registered at the Bank and confirms keeping the‬‬
‫‪mobile at all times and under his personal‬‬ ‫ت ككككككي‬ ‫م كككككك ح ت كككككك‬ ‫ككككككك‬ ‫إ قكككككك ب حكجكككككك ح حكم مكككككك‬
‫‪responsibility. He shall also avoid losing it. The‬‬ ‫ت كككككك‬ ‫تتج كككككك ضكككككك ل حكجمكككككك‬ ‫سكككككك تك ا حكش صكككككك‬

‫‪for the reading, viewing or stealing of any‬‬

‫‪information through the mobile phone or any‬‬

‫‪is stolen or his number is changed.‬‬

‫)‪c‬‬ ‫‪The Bank will be entitled to act on the Customer‬‬ ‫حك م كككككا ت‬ ‫ا ككككك ت ل مككككك‬ ‫ككككك ًال‬ ‫حك ككككك‬ ‫‪ -‬ككككك‬
‫‪Instructions without any further written or‬‬ ‫كككككك ةت تتو كككككك ح ةعككككككلى‬ ‫و‬ ‫حك كككككك إككككككك ة كككككك ت ل مكككككك‬
‫‪other confirmation, and will not acknowledge‬‬
‫ككككككك‬ ‫ة ة ككككككك تكككككككك‬ ‫لة ككككككك ً‬ ‫حك ككككككك‬ ‫ككككككك‬ ‫تكككككككك‬
‫‪receipt of any instruction nor shall it be‬‬

‫)‪h‬‬ ‫‪The Bank shall apply daily operational limits for‬‬ ‫ككككككك‬ ‫حك جم‬ ‫كككككككق ف حك مل ككككككك‬ ‫ككككككك‬ ‫كككككككا كل ككككككك ت‬ ‫خ‪-‬‬
‫‪all transfers and payments etc. These limits‬‬ ‫ت ككككككك‬ ‫حكككككككك تعكككككككل‬ ‫تحكمككككككك ك خ‬ ‫كجم ككككككك حك ككككككك‬
‫‪include separate both internal and external‬‬ ‫ككككك حب‬ ‫اصكككككل‬ ‫ككككك‬ ‫تجم‬ ‫حكسكككككق ف ت ضكككككم خمل ككككك‬
‫‪based on it absolute discretion and according to‬‬

‫‪while being logged to the Services. For security‬‬ ‫كككككككك أل مكككككككك‬ ‫كككككككك خل ككككككككا خكككككككك‬ ‫حيك لتل كككككككك ك‬
‫‪reasons and for the preservation of confidential‬‬
‫‪information, if the Customer leaves the logged‬‬ ‫تإخح‬ ‫كككككل حكم ل ككككك‬ ‫ككككك تحك اككككك ن خلككككك‬ ‫ككككك ك ة‬
‫‪on device inactive for 5 minutes the system will‬‬ ‫ككككككك ً خلككككككك حكم ككككككك كمككككككك‬ ‫ا‬ ‫تكككككككل‪ ،‬حك م كككككككا مككككككك‬
‫‪time out and the Customer will be logged out of‬‬ ‫ككككك م حك كككككي‬ ‫لوككككك كككككك حك ظككككك‬ ‫‪ 5‬ككككك فا ككككك ت‬
‫‪the Services. To regain access to their Electronic‬‬ ‫كككك حكمصكككككلك‬ ‫تسككككج ا عكككككلتد حك م ككككا ككككك حك‬ ‫ت كككك‬
‫‪Banking Services the Customer must log on‬‬
‫‪from the beginning and input their Username‬‬ ‫سكككككك ك حك م ككككككا‬ ‫إككككككك‬ ‫حككككككك ع‬ ‫حيك لتل كككككك ال كككككك‬
‫‪and Password and use the Authentication tool‬‬ ‫ككككك حك ح ككككك‬ ‫حيك لتلككككك خلككككك حك م كككككا تسكككككج ا حكككككك ع‬
‫‪again.‬‬ ‫تولمككككككككك حكمكككككككككلتأل تة ح‬ ‫تح عككككككككك ح ككككككككك حكمسككككككككك‬

‫)‪j‬‬ ‫‪The Customer (In case it’s a corporate) shall‬‬ ‫ككككككك ةلكككككككا شكككككككلو "‬ ‫ح كككككككا حك م كككككككا " كككككككك‬ ‫ككككككك ف‬ ‫‪-‬‬
‫‪communicate with the Bank via its Users. The‬‬ ‫خلكككككك‬ ‫ت كككككك‬ ‫حكمسكككككك‬ ‫كككككك عكككككك‬ ‫كككككك حك كككككك‬
‫‪Customer shall ensure its Users only use the E-‬‬
‫‪Channels and the Services in accordance with‬‬ ‫ح حكق كككككك ح حيك لتل كككككك‬ ‫ح كككككك‬ ‫حك م ككككككا ضككككككم خكككككك‬
‫‪these Terms and Conditions and agree to be‬‬ ‫تكقككككككك كمككككككك‬ ‫كككككككا حكمسككككككك‬ ‫إال ككككككك‬ ‫تحك ككككككك‬
‫‪bound by and observe the terms of these Terms‬‬ ‫كككككك‬ ‫ت حككككككا حك م ككككككا خلككككك ة‬ ‫كككككك‬ ‫حكشكككككلتا تح‬
‫‪and Conditions.‬‬ ‫‪.‬‬ ‫م حكشلتا تح‬ ‫الك ةح‬ ‫ُ لة‬

‫)‪k‬‬ ‫‪Certain E-Channels for accounts viewing and‬‬ ‫ككككك ك مككككك‬ ‫ككككك ح إك لتل ككككك‬ ‫إكككككك‬ ‫ككككك‬ ‫ل‪ -‬ال جككككك حك‬
‫‪conducting transactions may only be accessed‬‬ ‫ةت إ حألتمكككككككككك‬ ‫حال كككككككككك ل خلكككككككككك حكم كككككككككك‬ ‫كككككككككك‬
‫‪by specified Users. The Customer (In case it’s a‬‬
‫‪ .‬ت ل كككككة حك م كككككا‬ ‫ككككك‬ ‫كككككا سككككك‬ ‫إال ككككك‬
‫‪corporate) shall provide a list of all such‬‬
‫‪specified Users for accounts viewing and‬‬ ‫ككككم ب كككك الب‬ ‫فمكككك‬ ‫كككك ةلككككا شككككلو " قكككك‬ ‫"ككككك‬

‫‪will issue tokens for use by such specified Users‬‬

‫‪instructions to banks on Wage Protection‬‬

‫‪System including the requirements of the‬‬
‫‪Ministry of Labor and Social Solidarity as‬‬ ‫حكمصكككككلف‬ ‫حال مككككك خ خلككككك حك ككككك حكككككك حأل كككككك ت مككككك‬
‫‪indicated in the Central Bank Circular No.‬‬ ‫حكملوككككككة أل كككككك (‪ 70‬الكسكككككك ‪ 2014‬كككككك أل خ ‪ 14‬كككككك م ل‬

‫)‪b‬‬ ‫‪The Bank shall transfer the wages to the‬‬ ‫ك كككككك ل‬ ‫كككككك‬ ‫حك‬
‫ك‪ -‬كككككك ن حك كككككك حكلتحتكككككك كل ي كككككك‬
‫‪Customers’ employees cards according to their‬‬ ‫ككككك‬ ‫م ككككك أل ككككك ح ككككك (‪IBAN‬ال أل ككككك حك سككككك ك حك‬
‫‪(IBAN) based on the transfer order provided by‬‬
‫‪the customer each month.‬‬ ‫كككككا حك ككككك‬ ‫تح كككككل حك‬ ‫ا حك م كككككا تكقككككك‬ ‫حكككككك تك كمككككك‬
‫م وا شمل‪.‬‬ ‫ق‬

‫)‪c‬‬ ‫‪The Customer shall insure that sufficient funds‬‬ ‫ككككك ح حك ك ككككك كككككك حك سككككك ك‬ ‫‪ -‬ضكككككم حك م كككككا تككككك كل ح‬
‫‪are available in the account including covering‬‬ ‫حك كككككك ت يكككككك و ككككككك ح ت كككككك ك تحك مكككككك ال تحكمصكككككك أل‬
‫‪all fees, commissions and other expenses and in‬‬

‫)‪d‬‬ ‫‪The Bank shall be entitled without referring to‬‬ ‫ككككك‬ ‫صككككك‬ ‫ت حكل ككككك ل إكككككك حك م كككككا ة‬ ‫كككككا كل ككككك‬ ‫‪-‬‬
‫‪the Customer, to deduct from the account any‬‬ ‫سكككككك ق‬ ‫ةت ةت كككككك ك ةت خمكككككك ال‬ ‫صكككككك أل‬ ‫حك سكككككك ك ة‬
‫‪expenses, fees or commissions due to the Bank‬‬
‫حكمق ككككككك حكككككككك‬ ‫تحكم جككككككك‬ ‫كل ككككككك لظ كككككككل حك ككككككك‬
‫‪for the services and products provided to the‬‬
‫‪Customer according to the Bank`s schedule of‬‬ ‫كككككا‬ ‫حك م كككككا تككككككا كجككككك ت حك مككككك ال تح ت ككككك ك حكم مككككك‬
‫‪fees and commissions. Provided that no‬‬ ‫كككك ألتحتكككك‬ ‫إ ككككلحب ح عصكككك‬ ‫شككككل ي خكككك‬ ‫ككككك ى حك كككك‬
‫‪deduction shall be made from the wages of the‬‬ ‫‪.‬‬ ‫ا‬ ‫حكم‬
‫‪employees.‬‬

‫)‪e‬‬ ‫‪The Bank may refuse to execute any requests,‬‬ ‫ةت ت ل مككككككك‬ ‫ل ككككككك‬ ‫د‪ -‬جككككككك كل ككككككك ألككككككككأ ت ا ككككككك ة‬
‫‪instructions or services requested by the‬‬
‫ل كككككككة حك م كككككككا‬ ‫يل مككككككك حك م كككككككا إخح كككككككك‬ ‫ةت عككككككك‬
‫‪Customer if the Customer fails to comply with‬‬
‫‪the necessary procedures as provided in the‬‬ ‫لككككك‬ ‫كككككك‬ ‫ككككك ي لحبح حكضكككككلتأل خلككككك حك ككككك حكم ككككك‬
‫‪salary information file (“SIF”), the Bank`s‬‬ ‫حكلتحتككككككك ت ك ةت حكم كككككك حيك لتلككككككك كل ككككككك‬ ‫ل كككككك‬
‫‪website and/or herein, or if the information and‬‬ ‫كككك‬ ‫ككككك خكككك‬ ‫ةت ككككك‬ ‫كككك‬ ‫ت ك ةت كككك حكشككككلتا تح‬
‫‪data are incorrect or not in full compliance with‬‬

‫‪the laws of the State of Qatar including Ministry‬‬

‫‪currency shall be calculated at the prevailing‬‬

‫‪hereby allows the Bank to manage them by the‬‬
‫حكصكككككككككلف ح كككككككككك ( ‪ ATM‬ال ة ككككككككك ل حك ككككككككك تلككككككككك‬
‫‪specialised entities he contracts. The Customers‬‬
‫‪shall not consider this a breach of the secrecy of‬‬ ‫ككككك‬ ‫حكم صصككككك حك ككككك‬ ‫ل كككككا حكجمككككك‬ ‫مكككككة خككككك‬ ‫ح‬

‫‪ATM machine without previous notification to‬‬

‫‪its Customers. The Customers shall not be‬‬
‫‪entitled to the right of recourse against the Bank‬‬ ‫ل جككككك ة ةخيككككك‬ ‫ي ك ككككك‬ ‫كككككت‬ ‫حكل ككككك ل خلككككك حك ككككك‬
‫‪due to breakdowns sustained by the cards, the‬‬ ‫ككككككككا ح خيكككككككك‬ ‫كل ي كككككككك ةت مكككككككك حكصككككككككلحف ح ككككككككك‬

‫‪uncollected sums by crediting to the Customer’s‬‬

‫‪account according the inventory procedures.‬‬

‫‪related to any arrangements the Customer has‬‬

‫‪verification procedures. The Bank’s decision in‬‬

‫‪this regard is final. The Customer shall not be‬‬
‫‪entitled to object. The Bank shall also be‬‬ ‫ككككا حك م ككككا ت كككك اب‬ ‫ككككا ك خ ككككلحن كككك‬ ‫لم ف كككك ت ككككل‬
‫‪entitled to present these cheques to any of its‬‬ ‫ككككككك‬ ‫إككككككك ة‬ ‫ككككككك حكشكككككك‬ ‫ككككككا تقكككككك‬ ‫حك كككككك‬

‫‪through their sub -agents.‬‬

‫‪payment, forgery, insufficiency of funds or any‬‬

‫‪event that the deposited cheques are credited‬‬

‫‪be entitled to extend or reverse the transaction‬‬ ‫حكم ةت إك ب حك مل‬

‫‪entire agreement between the parties‬‬

‫‪concerning the supply and use of the‬‬

‫‪agreements communications, representations‬‬ ‫تحي كككككككككككلحألح‬ ‫تحكملح ككككككككككك‬ ‫م ككككككككككك حالتا ككككككككككك‬
‫‪and discussions between the Bank and the‬‬ ‫حك كككككك‬ ‫حكسكككككك ق كمكككككك تحكم ل كككككك كككككك‬ ‫تحكم شكككككك‬
‫‪Customer relating to the E-Channels and‬‬
‫لكككككككككا ككككككككك كق ح حيك لتل ككككككككك‬ ‫تحك م كككككككككا ك مككككككككك‬
‫‪Services which are hereby terminated. The‬‬
‫‪Customer will not have a right of action against‬‬ ‫كككككك‬ ‫م كككككك م كككككك‬ ‫ككككككل م مكككككك‬ ‫تت‬ ‫تحك كككككك‬
‫‪the Bank arising from any previous agreement,‬‬ ‫كل م ككككا حك ككككا ككككك‬ ‫كككك‬ ‫تككككك‬ ‫كككك‬ ‫حكشككككلتا تح‬
‫‪communication, representation and discussion‬‬ ‫ككككك حالتا ككككك‬ ‫حت ككككك خ إ كككككلحب ضككككك حك ككككك ل جككككك‬
‫‪in respect to the Services, except in the case of‬‬
‫حكسككككككككك ق‬ ‫تحي كككككككككلحألح تحكم شككككككككك‬ ‫تحكملح ككككككككك‬
‫‪fraud. Any other agreements between the Bank‬‬
‫‪and the Customer, terms of business and/or‬‬ ‫إال‬ ‫لكككككككا ككككككك كق ح حيك لتل ككككككك تحك ككككككك‬ ‫ك مككككككك‬
‫‪mandates relating to the conduct of your‬‬ ‫كككك حكشككككلتا‬ ‫ككككت‬ ‫كككك حك لكككك‬ ‫كككك‬ ‫كككك ال حال‬ ‫ككككك‬
‫‪accounts or our provision of related services‬‬ ‫ةعكككككلى ل ككككك‬ ‫ال تككككك ل خلككككك ة كككك حتا ككككك‬ ‫كككك‬ ‫تح‬
‫‪shall remain unaffected, save that if any conflict‬‬
‫‪between such terms and the terms of these‬‬ ‫حك ككككككك تحك م كككككككا ةت ة ككككككك شكككككككلتا خمكككككككا تكةت‬ ‫ككككككك‬
‫‪Terms and Conditions arises, these Terms and‬‬ ‫لقككككككك ككككككك حأل سككككككك ت ةت تقككككككك م‬ ‫تا ضككككككك‬

‫‪relates to the subject matter of the Services.‬‬

‫‪acknowledge the risks that any such‬‬ ‫حكل ككككككككككك فا حك صككككككككككك حكقصككككككككككك ل (إل إ إلال ةت ة‬
‫‪communications‬‬ ‫‪may‬‬ ‫‪be‬‬ ‫‪intercepted,‬‬ ‫كككك‬ ‫ل قكككك ةعككككلى ككككك حك م ككككا قككككل كم كككك ل حك كككك‬
‫‪monitored, amended or otherwise interfered‬‬

‫‪with by third parties. We are not responsible or‬‬

‫‪any such occurrence in relation to any‬‬ ‫سككككك تك‬ ‫ك ل ككككك ل لككككك‬ ‫ككككك ح حكصككككك‬ ‫ككككككم‪ .‬تكككككك‬

‫‪appears to have been made on your behalf), or‬‬

‫‪telephone conversations concerning the service‬‬

‫‪offered to the Customer through its specialised‬‬
‫‪center. The Customer recognises these‬‬ ‫كككككك ً‬ ‫حكم صككككك كككككك ك تت كككككل تلككككك حك سكككككج‬
‫‪recordings as true evidence. The Bank shall also‬‬ ‫كككك ً لككككك ً صكككك ا كككك حك م ككككا ومكككك ككككا كل كككك‬
‫‪be entitled to use these recordings in the cases‬‬ ‫حكم صكككككككككل خ مككككككككك كككككككككك‬ ‫ح حك سكككككككككج‬ ‫ح ككككككككك‬
‫‪it considers using them.‬‬

‫‪Channels or Services as the Bank advise the‬‬
‫‪Customer from time to time, and the Bank are‬‬ ‫يككككل ككككا‬ ‫خلكككك حك كككك حككككك‬ ‫حيك لتل كككك تحك كككك‬
‫)‪entitled to debit the Customer’s account(s‬‬ ‫ككككك‬ ‫ككككك ت كككككي عكككككل ت كككككا كل ككككك حك صككككك‬ ‫حك ككككك‬
‫‪wherever they are situated and wherever they‬‬ ‫ككككككك‬ ‫ممككككككك وككككككك‬ ‫حك م كككككككا حكم لاككككككك‬ ‫سككككككك‬
‫‪are opened, with the amount of any such fees‬‬

‫‪to ensure that communications through the‬‬

‫‪loggers) and other harmful programs or‬‬ ‫أل كككك ك كككك حكماكككك ت ال‬ ‫( ككككا ككككلح‬ ‫حك جسكككك‬ ‫ككككلح‬

‫‪its rights under any applicable law, and may be‬‬

‫‪waived only in writing and specifically, and any‬‬

‫‪required or in connection with changes in any‬‬
‫‪laws and/or regulations and we will inform you‬‬ ‫تكةت حكلكككككك حف ت كككككك ف ل يككككككل‪ ،‬ككككككك‬ ‫ككككككك حكقكككككك حل‬
‫‪as soon as possible for the effective operation‬‬ ‫م كككك مككككك ضككككم تشكككك ا حك ككككك‬ ‫ة ككككلك كل كككك‬

‫‪of these Terms and Conditions shall be binding‬‬

‫‪upon us unless made by a written instrument‬‬

‫‪9.12. Certain jurisdictions may have particular legal or‬‬ ‫يل ككككك‬ ‫حالع صككككك‬ ‫كككككك أ كككككلي‬ ‫‪ 9.12‬ككككك ت ككككك‬
‫‪regulatory requirements that require you to‬‬ ‫ككككككك‬ ‫ل ل كككككك ةت ت ظ م كككككك ع ككككككك تحك كككككك ت يلكككككك‬
‫‪agree to supplementary terms. Where such‬‬
‫ككككك‬ ‫حك م ككككا حكم حكقكككك خلكككك شككككلتا ت م ل كككك ‪ .‬تككككك‬
‫‪supplementary terms are necessary, the Bank‬‬
‫‪will provide the Customer with those terms in‬‬ ‫كككك ف ككككةت‬ ‫ضككككلتأل حالتاكككك خ شككككت تلكككك حكشككككلتا‬
‫‪writing together with these Terms and‬‬ ‫حك ككككككك حك م كككككككا لككككككك حكشكككككككلتا قلتلككككككك مكككككككك‬
‫‪Conditions and other relevant documentation,‬‬ ‫ح ح عككككككككككلى خح‬ ‫تحكمسككككككككك‬ ‫ككككككككك‬ ‫حكشكككككككككلتا تح‬
‫‪and such supplementary terms shall form an‬‬
‫حكصكككككل تتشككككك ا تلككككك حكشكككككلتا كككككةبح ال جكككككةة ككككك‬
‫‪integral part of these Terms and Conditions.‬‬

‫‪notwithstanding any change of name of the‬‬ ‫خلككككك حك سككككك ك صكككككلف‬ ‫ككككك أل خككككك ة ككككك حكما ضككككك‬
‫‪partnership, selling of the company admission‬‬ ‫كككككل كككككك ح ككككك حكشكككككلو ةت حك ككككك‬ ‫حك ظكككككل خككككك ة ت‬
‫‪of a new partner(s) or any partner ceasing to be‬‬ ‫ةت عككككلتد‬ ‫كككك ةت شككككلو ب كككك‬ ‫شككككل‬ ‫خ مكككك ةت كككك‬
‫‪a member of the partnership by reason of death‬‬

‫‪9.15. The Customer hereby explicitly acknowledges‬‬ ‫كككككككك حكشككككككككلتا‬ ‫م كككككككك‬ ‫‪ 9.15‬قككككككككل حك م ككككككككا ككككككككلح‬
‫‪the validity of the Bank’s automatic and‬‬ ‫حك ككككككك‬ ‫لككككككك كمسككككككك ل‬ ‫ك ج ككككككك حك‬ ‫ككككككك‬ ‫تح‬
‫‪electronic extracts establishing the Customer‬‬
‫‪instructions and transactions through the‬‬ ‫ح ك كككك تحيك لتل كككك حكم كككك كمكككك ة كككك أل حك م ككككا كككك‬
‫‪electronic service whether these extract are in‬‬ ‫كككككك‬ ‫ل ككككككا حك‬ ‫صككككككلك خككككك‬ ‫ةت خمل كككككك‬ ‫ت ل مككككك‬
‫‪English or Arabic appearing on the internet‬‬ ‫كل ككككك حك ل ككككك ةت حكل ككككك‬ ‫ككككك حب و لكككككي حكمسككككك ل‬
‫‪system.‬‬ ‫حيل للي‪.‬‬ ‫ش‬ ‫حاللجل ة حكم حتك خل لظ‬

‫‪9.16. The Customer authorizes the Bank to store the‬‬ ‫اككككككب و ككككككك حكملح ككككككك‬ ‫‪ 9.16‬صككككككل حك م ككككككا كل كككككك‬
‫‪internet, mobile or email correspondences by‬‬ ‫حيل لل كككككي ةت حك ل اككككك‬ ‫شككككك‬ ‫ككككك عككككك‬ ‫كككككك‬ ‫حكم‬
‫‪using the modern computer archiving systems‬‬
‫كككككككك ظ حك اككككككككب‬ ‫ةت حك ل كككككككك حالك لتلكككككككك‬ ‫حكم مكككككككك‬
‫‪or other. The Customer also accepts that‬‬
‫‪extracted copies are identical to the original and‬‬ ‫تل ح ألشكككككا تع ككككككا ت قكككككل كككككت‬ ‫ككككك ككككك ك م‬ ‫حك‬

‫‪have full authority in matters of proof and‬‬ ‫كككككا كمككككك‬ ‫كككككا ح‬ ‫كككككل ككككك أل‬ ‫حكصككككك أل حكمسككككك ل ت‬
‫‪confirms the validity of his signature on the‬‬
‫ت كككككككلف صككككككك‬ ‫لككككككك كككككككك حي ككككككك‬ ‫حك ج ككككككك حك‬
‫‪documents archived in the stated manner.‬‬
‫ح حك ككككككككك‬ ‫كككككككككا حيك لتلككككككككك خلككككككككك حكمسككككككككك‬ ‫ت‬

‫‪9.17. The Bank shall not be responsible for any‬‬ ‫ككككا‬ ‫ككككا ككككل سككككم‬ ‫ككككل سكككك ت خكككك ة ت‬ ‫‪ 9.17‬حك كككك‬
‫‪unauthorized access by third parties.‬‬ ‫ا لف كم ‪.‬‬

‫‪9.18. The Customer authorizes the Bank and use the‬‬ ‫ككككككك‬ ‫ككككككك حكق كككككك‬ ‫‪ 9.18‬صككككككل حك م ككككككا كل كككككك ككككككك‬
‫‪services of specialised entities for providing‬‬ ‫ح ة مكككككككككة حكصكككككككككلحف ح كككككككككك‬ ‫تا و ككككككككك‬ ‫لشككككككككك‬
‫‪ATM or any other activities. The Customer shall‬‬
‫‪not consider this a violation of the‬‬ ‫ككككككككك حكجمككككككككك‬ ‫ككككككككك‬ ‫ةت ة ةلشكككككككككي ةعكككككككككلى ة‬
‫‪confidentiality if his bank accounts.‬‬ ‫ككككككككل خككككككككك إعكككككككك ال سككككككككل‬ ‫حكم صصكككككككك ت ة‬
‫‪.‬‬ ‫حك س‬

‫‪9.19. The Customer authorizes the Bank to cooperate‬‬ ‫كككككلف تعكككككل‬ ‫ككككك ة‬ ‫ك ككككك ت‬ ‫‪ 9.19‬صكككككل حك م كككككا كل ككككك‬
‫‪with any other party to transfer the information‬‬ ‫ل ككككككا حكل كككككك فا‬ ‫ةت إأل كككككك كم خكككككك‬ ‫ك قككككككا حكم ل كككككك‬
‫‪sent by SMS authorizes the showing of‬‬
‫‪information on the screens of the electronic‬‬ ‫ومكككك صككككل حك م ككككا‬ ‫حكقصكككك ل خلكككك حكجكككك ح حكم مكككك‬
‫‪equipment. Bank shall not be responsible where‬‬ ‫مكككككككككة‬ ‫ح‬ ‫خلككككككككك ش شككككككككك‬ ‫كككككككككلن حكم ل ككككككككك‬
‫‪a third party – without the Bank’s approval or‬‬ ‫ككككك‬ ‫سكككككي ك‬ ‫ككككك ة‬ ‫ت اككككك حك ككككك‬ ‫حيك لتل ككككك‬
‫‪participation–succeeds in obtaining information‬‬ ‫حكقككككك حك ككككك‬ ‫كككككلف ككككك حك كككككل – ت‬ ‫حع كككككلحخ ة‬
‫‪of the accounts opened in the Customer’s name‬‬
‫‪at the Bank.‬‬ ‫خكككككك‬ ‫ل ككككك‬ ‫خلككككك‬ ‫ةت سككككك م ا – كككككك حك صككككك‬
‫ككككككج‬ ‫كككككك حك م ككككككا ككككككك‬ ‫كككككك‬ ‫حكما‬ ‫حك سكككككك‬

‫‪9.20. The Customer hereby authorizes the Bank to‬‬ ‫تت ا كككك ت ل م تككككا ككككت حب‬ ‫ق كككك‬ ‫‪ 9.20‬صككككل حك م ككككا كل كككك‬
‫‪accept and deal with his instructions to perform‬‬ ‫سكككككك ا كككككك‬ ‫كككككك تإككككككك‬ ‫تحك كككككك‬ ‫حكمكككككك ك خ‬
‫‪payments and transfers to and from the account‬‬
‫‪after the Bank verifies the authenticity of the‬‬ ‫ككككك‬ ‫حي كككككلحبح ح‬ ‫ككككك عكككك‬ ‫لكككك‬ ‫حك قككككا ككككك حكم‬
‫‪transaction through its security system.‬‬ ‫‪.‬‬ ‫حكمي ق ك حك‬

‫‪9.21. For joint accounts, the Bank shall deal with the‬‬ ‫حك كككككككك‬ ‫قكككككككك‬ ‫حكمشكككككككك لو‬ ‫ك سكككككككك كل سكككككككك‬ ‫‪9.21‬‬
‫‪instructions issued by authorized person(s), the‬‬ ‫حكصكككككك أل‬ ‫كككككك ب خلكككككك حك ل مكككككك‬ ‫ا كككككك حك مل كككككك‬
‫‪account holders shall be responsible for the‬‬ ‫خلكككككك حك سكككككك ك ت كككككك ف‬ ‫كككككك ةى كككككك حكما ضكككككك‬
‫‪executed transactions and the payment of any‬‬
‫‪indebtedness resulting on the account.‬‬ ‫كحك مككككككككككككك ب‬ ‫وكككككككككككككا ككككككككككككك حك م لككككككككككككك‬ ‫ككككككككككككك‬
‫حكم اككككك‬ ‫خككككك وكككككا حك مل ككككك‬ ‫ك سككككك تك‬ ‫سكككككي‬

‫‪9.22. The Customer authorizes the Bank to send‬‬ ‫مكككككككككك‬ ‫أل كككككككككك حك‬ ‫‪ 9.22‬صككككككككككل حك م ككككككككككا كل كككككككككك‬
‫‪alerts, announcements, new products and‬‬ ‫حكج كككككككككككك ت مكككككككككككك‬ ‫تحكم جكككككككككككك‬ ‫تحيخ لكككككككككككك‬
‫‪marketing campaign using any of the electronic‬‬
‫‪means that includes and not limited to internet,‬‬ ‫كككككك فا حيك لتل كككككك‬ ‫كككككك حك‬ ‫ح ة‬ ‫كككككك‬ ‫حك سكككككك ا‬
‫‪email, SMS; the Customer shall not consider the‬‬ ‫حك كككككك تشككككككما تال تق صككككككل خلكككككك حيل للككككككي تحك ل كككككك‬
‫‪foregoing as a violation of his privacy.‬‬ ‫حيك لتلككككككك تحكل ككككككك فا حكقصككككككك ل ت حككككككككا حك م كككككككا‬
‫ا‪.‬‬ ‫ح حل م و ً ك ص‬ ‫حخ أل‬ ‫خل خ‬

‫‪9.23. The Customer shall indemnify the Bank, its‬‬ ‫ا كككككككا تتو فكككككككا‬ ‫لككككككك حك م كككككككا خ ككككككك حك ككككككك ت‬ ‫‪9.23‬‬
‫‪employees and agents and hold them harmless‬‬ ‫سكككككك تك حت ضككككككلأل حت خكككككك ى حت‬ ‫كككككك ح كككككك‬ ‫ت ككككككلفم‬
‫‪against any liability, damage, loss, proceedings,‬‬
‫‪claim, lawsuits, cost or expenses whatsoever‬‬ ‫حت صككككككككككلتك‬ ‫حت ضكككككككككك حت ت كككككككككك ك‬ ‫ي ك كككككككككك‬
‫‪incurred by the Bank or its employees as a result‬‬ ‫ا كككككككا ل جككككككك‬ ‫ملمككككككك حك ككككككك حت‬ ‫ككككككك‬ ‫تحك ككككككك‬
‫‪of (i) the entry by the Bank into these terms and‬‬ ‫كككككككككك‬ ‫كككككككككك حكشككككككككككلتا تح‬ ‫(ةال إ ككككككككككلح حك كككككككككك‬
‫‪conditions, (ii) any transactions instructed by‬‬ ‫ككككككا‬ ‫كككككك‬ ‫ق كككككك حككككككك حك كككككك‬ ‫ةت (كال ة ت ل مكككككك‬

‫‪the Customer under this agreement or (iii) the‬‬ ‫حك م كككككككككا مككككككككك حكشكككككككككلتا‬ ‫حك م كككككككككا حت (دال إعككككككككك‬
‫‪breach by the Customer of these terms and‬‬
‫لا م ‪.‬‬ ‫حت خق‬ ‫حت ح حتا‬ ‫تح‬
‫‪conditions, any agreement or contract related‬‬
‫‪thereto.‬‬

‫‪9.24. The Bank shall be entitled at any time, without‬‬ ‫ت حعيككككك أل سككككك ا‬ ‫كككككا كل ككككك كككككك ة ت كككككي ككككك‬ ‫‪9.24‬‬
‫‪prior notice, to freeze and / or set-off any‬‬ ‫لكككككككغ سككككككك ا ةت تح ككككككك‬ ‫تجم ككككككك ت ك ةت ق ككككككك ة‬
‫‪amount due or payable to the Bank by the‬‬
‫سكككك‬ ‫كككك‬ ‫كككك حك م ككككا كككك ة‬ ‫حككككك ك إككككك حك كككك‬
‫‪Customer from any of the Customer`s accounts‬‬
‫‪held with the Bank irrespective of their types‬‬ ‫صكككككلف حك ظكككككل خككككك‬ ‫ككككك كككككك ى حك ككككك‬ ‫حك م كككككا حكما‬
‫‪and names or whether they are individual and /‬‬ ‫جممككككككككككك تة كككككككككككم فم ت ككككككككككك حب و لكككككككككككي كل ككككككككككك‬
‫‪or joint and whether in local or foreign currency‬‬ ‫ل ككككك‬ ‫ملككككك‬ ‫ككككك‬ ‫ت ككككك حب و لكككككي ا‬ ‫تكةت تضككككك‬
‫‪whereby each such amount shall be considered‬‬
‫كككككككل خكككككككك حكم لكككككككغ ضكككككككم ل ك‬ ‫ككككككك ‪ .‬تخل كككككككا‬ ‫حت ة‬
‫‪as a security / collateral for the other accounts‬‬
‫‪jointly or severally for the settlement of any‬‬ ‫ةت ج م ككككككك‬ ‫ح عكككككككلى اكككككككل‬ ‫وا كككككككك كل سككككككك‬
‫‪indebtedness due from the Customer or its‬‬ ‫سككككككك ق خلككككككك حك مكككككككا ةت‬ ‫ل ككككككك‬ ‫ة ككككككك‬ ‫ك سككككككك‬
‫‪guarantor to the Bank.‬‬ ‫‪.‬‬ ‫ا إك حك‬ ‫ض‬

‫‪9.25. The Customer acknowledges that if the Bank‬‬ ‫خكككك‬ ‫ككككك إأل كككك حك كككك ك لكككك‬ ‫‪ 9.25‬قككككل حك م ككككا ةلككككا ككككك‬
‫‪sends data through any electronic means – as‬‬ ‫كككككك فا حيك لتل كككككك تكقكككككك ً كيلكككككك‬ ‫كككككك حك‬ ‫ل كككككا ة‬
‫‪requested by the Customer - it is the Customer’s‬‬
‫‪responsibility to maintain the confidentiality of‬‬ ‫خلككككك حك م كككككا حكم كظككككك خلككككك‬ ‫ككككك‬ ‫حك م كككككا ك لكككككا‬
‫‪this data. The Bank shall not be responsible for‬‬ ‫مكككككككككككا حك ككككككككككك‬ ‫تال‬ ‫كككككككككككل تلككككككككككك حك لككككككككككك‬
‫‪the leakage of this data or the Customer’s non-‬‬ ‫سككككككككككك تك خككككككككككك تسكككككككككككلك تلككككككككككك حك لككككككككككك‬ ‫ة‬
‫‪receipt of the data for any reason beyond the‬‬ ‫ككككك‬ ‫ت ككككك‬ ‫سككككك تك خككككك‬ ‫مكككككا حك ككككك‬ ‫ومككككك ال‬
‫‪Bank’s control. The charges for the service shall‬‬
‫‪be debited from the Customer’s accounts and‬‬ ‫ة كككككك ك ع أل كككككك خكككككك إألح‬ ‫إككككككك حك م ككككككا‬ ‫حك لكككككك‬
‫‪may not be entitled to claim any compensation.‬‬ ‫سككككك‬ ‫ككككك‬ ‫ككككك‬ ‫حك‬ ‫عصككككك أل ككككك‬ ‫حك ككككك ت ككككك‬
‫لحب خك ‪.‬‬ ‫ض‬ ‫حك م ا تال ا كا ل ة ت‬

‫‪9.26‬‬ ‫‪The Customer is obliged when he travels outside‬‬ ‫‪ 9,26‬ل كككككة حك م كككككا خ ككككك حكسكككككال عككككك ألد تكككككك يكككككل ة‬
‫‪of the State of Qatar, to notify the Bank of the‬‬

‫‪during his travel, and shall notify the bank if he‬‬
‫ةعكككككلى كككككل سكككككجل‬ ‫حتككككك‬ ‫ح ا ةأل ككككك‬ ‫ككككك إ ككككك‬
‫‪uses another phone number not registered with‬‬
‫‪the bank. The Bank shall not bear any damages‬‬ ‫مككككا حك كككك ة ةضككككلحأل كككك تل ككككا‬ ‫تال‬ ‫ككككك ى حك كككك‬
‫‪that the Client may incur as a result of his failure‬‬ ‫‪.‬‬ ‫حك ةح ا م ح حك‬ ‫حك م ا ل ج خ‬
‫‪to comply with this clause.‬‬

‫‪9.27. In case of conflict, discrepancies or difference‬‬ ‫حك ل ككككككك‬ ‫حكصككككككك‬ ‫عككككككك ف ككككككك‬ ‫ككككككك ت ككككككك‬ ‫‪ 9.27‬كككككككك‬

‫‪failure in performing any of its duties relating to‬‬
‫‪this Agreement caused in whole or in part by the‬‬ ‫تحك شكككككي‬ ‫ككككك‬ ‫ككككك حكشكككككلتا تح‬ ‫تح تكككككا م ككككك‬
‫‪action of any government or governmental‬‬ ‫ككككك‬ ‫صككككك أل و لككككك ةت ةف ككككك ل جككككك ك صكككككلف ة‬
‫‪agency, natural occurrence, law or regulation‬‬ ‫كككككككك‬ ‫ة و أل كككككككك‬ ‫كككككككك ةت سكككككككك‬ ‫يكككككككك‬ ‫ةت‬
‫‪(or any change in the interpretation‬‬ ‫ككككككل ككككككك تاسكككككك ل‬ ‫تحكلكككككك حف ال ةت ة ت‬ ‫ةت حكقكككككك حل‬
‫‪thereof),injunction,‬‬ ‫‪currency‬‬ ‫‪restriction,‬‬

‫‪action, equipment failure, or interruption to‬‬ ‫ةت حي ككككككككككككلحبح حكصكككككككككككك خ ال كككككككككككك حب ضككككككككككككم‬
‫‪power supplies or anything else beyond its‬‬

‫‪reasonable control. The Bank will attempt to‬‬
‫‪notify the Customer as soon as is reasonably‬‬ ‫كي ككككك‬ ‫ةت ت يكككككا حكم ككككك ح ةت حلقيككككك ل كككككك حي ككككك ح‬

the laws and regulations operating in various ‫كككككلي حالع صككككك‬ ‫مككككك كككككك ة‬ ‫تحكلككككك حف حكم مككككك‬
jurisdictions which relate to the prevention of
money laundering, terrorist financing and the ‫كككككك ح تتم ككككككا‬ ‫تحك كككككك ت لككككككا م ك كككككك سكككككك ا ح‬
provision of financial and other services to any ‫حكم ك ككككك ت ل ككككك إكككككك ة‬ ‫حيأل ككككك ك تتككككك ك ل حك ككككك‬
persons or entities which may be subject to . ‫عض ك ق‬ ‫ت‬ ‫ةت م‬ ‫ةش‬
sanctions.

10.3. The Bank may take any action which it, in its sole ‫ككككك تكقككككك‬ ‫ككككك ة إ كككككلحب كككككلح‬ ‫ جككككك كل ككككك ة‬10.3
and absolute discretion, considers appropriate ‫تحكلككككك حف حكمككككك و أل تكقككككك ك قككككك ل‬ ‫كجم ككككك حكقككككك حل‬
to act in accordance with all such laws and
regulations. Such action may include but is not ‫ ت جكككككك ة شكككككك ما كككككك ح حي ككككككلحب خلكككككك‬.‫حكميلككككككا‬
limited to the interception and investigation of ‫كككككك ا حكم كككككك ال حك صككككككل خلكككككك حخ ككككككلحن تحك ككككككل‬
any payment messages and other information ‫ةت‬ ‫خكككككك ة كككككك أل كككككك فا ككككككك ت ل كككككك كككككك حكم ل كككككك‬
or Customer Instructions sent to or by the ‫ككككا حك م ككككا‬ ‫حك م ككككا حكمل ككككل إككككك ةت كككك‬ ‫ت ل مكككك‬
Customer or on its behalf via the Bank's systems
or any E-Channel; and making further enquiries ‫كككككككك‬ ‫ةت ل كككككككك خ ككككككككا خ ككككككككل ةلظمكككككككك حك كككككككك ةت ة‬
as to whether a name which might refer to a ‫كككككك‬ ‫اسكككككك ألح‬ ‫كككككك حال‬ ‫إك لتل كككككك ت ككككككل حكمة كككككك‬
sanctioned person or entity actually refers to ‫ككككم ب حك كككك أل مكككك تشكككك ل إككككك‬ ‫كككك ح‬ ‫كككك إخح و لككككي ة‬
that person or entity. The Bank may take, and
‫خل كككككا كككككت خق ككككك تشككككك ل‬ ‫ككككك‬ ‫ةت و ككككك‬ ‫شككككك‬
may instruct third party to take, any action
which it, in its sole and absolute discretion, ‫ ت صككككككلف‬. ‫ةت حك كككككك‬ ‫كا ككككككا إككككككك خككككككك حكشكككككك‬

investigation of any payment messages and

to or by the Customer or on its behalf via the ‫كككككا حك ككككك كككككك‬ ‫(ةال ة تكككككتع ل ةت إعاككككك خ ككككك‬: ‫سككككك‬
Bank's systems or any E-Channel; and making ‫ككككككك حكشكككككككلتا‬ ‫ككككككك تح تكككككككا م ككككككك‬ ‫ت ا ككككككك ة‬
further enquiries as to whether a name which
‫حك شككككككي‬ ‫كككككك حالك ةح كككككك‬ ‫ةت ككككككل خككككككك‬ ‫كككككك‬ ‫تح‬
might refer to a sanctioned person or entity
actually refers to that person or entity. ‫ل ككككك‬ ‫كككككلحب ة عيكككك ح تحك ككككك‬ ‫ول كككك ةت ةف ككككك كككك‬
Notwithstanding any provision of this ‫ككككك‬ ‫سككككك تقككككك ل حكميلكككككا ت ككككك‬ ‫ككككك م‬ ‫ة‬
Agreement, the Bank shall not be liable for any ‫تحكلككككك حف ي ةت (كال‬ ‫كل مكككككا تكقككككك كجم ككككك تلككككك حكقككككك حل‬
loss (whether direct, consequential or loss of
profit, data or damage suffered by any party ‫ تككككك‬. ‫كككك حكمكككك‬ ‫ق ككككا م كككك‬ ‫كككك‬ ‫م أل كككك ة‬
arising out of: (a) any delay or failure by the ‫كككك‬ ‫حي ككككلحب حككككك‬ ‫كككك كككك‬ ‫كككك‬ ‫ككككا ككككلتف‬
Bank in performing any of its duties under these . ‫ككككك‬ ‫ل كككك‬ ‫كجككككك‬ ‫ككككك ةت تككككتع ل‬ ‫حك كككك إككككك‬
terms and conditions or other obligations
‫ككككككككك‬ ‫ككككككككك‬ ‫ح‬ ‫لحخككككككككك حكم يل ككككككككك‬ ‫ت ككككككككك‬
caused in whole or in part by any steps which
any of them, in their sole and absolute ‫ككككككك ف ككككككك‬ ‫مككككككك‬ ‫تحكلككككككك حف حكم مككككككك‬ ‫حكقككككككك حل‬
discretion, considers appropriate to act in ‫كككك‬ ‫حك م ككككا‬ ‫كككك ككككك ت كككك ا ي كككك‬ ‫حك كككك ة صكككك‬
accordance with all such laws and regulations; .ً ‫خمل‬ ‫تل حكظلتف ك ة لك ت ي م‬
or (b) the exercise of any of the Bank's rights
under this clause. In certain circumstances, the
action which the Bank may take may prevent or
cause a delay in the processing of certain
information. Subject to the overriding
requirements of any applicable laws and
regulations, the Bank will endeavor to notify the
Customer of the existence of such
circumstances as soon as is reasonably
practicable.

10.4. The Bank and any entity it engages its services ‫سكككككككككك تك خلكككككككككك خكككككككككك تا حك كككككككككك‬ ‫ ال ت لتكككككككككك ة‬10.4
shall not be responsible for losses arising from ‫مكككككك‬ ‫كككككك حك كككككك‬ ‫حكم صصكككككك حك كككككك‬ ‫ةت حكجمكككككك‬
delays in sending or transmitting, non-receipt or
‫خكككك ة ةضككككلحأل ل مكككك خكككك حك ككككتع ل ككككك إأل كككك تلقككككا‬

‫ةت ت ي ككككككا سككككككل ةت حك كككككك ال حكي ألفكككككك‬ ‫حكم ل كككككك‬
‫‪suspension of work, strikes, force majeure,‬‬
‫‪natural disasters, security problems, measures‬‬ ‫حك ق ككككككك ةت حلقيككككككك ل ح ككككككك ملحأل‬ ‫كككككككا حكمشككككككك‬
‫‪taken by the state’s authorities or any other‬‬ ‫ةت حكقكككككككككككك حكقكككككككككككك ل‬ ‫حك مككككككككككككا ةت حيضككككككككككككلح‬
‫‪events. The Customer shall not hold the Bank‬‬ ‫كككككككككك‬ ‫ةت حكمشكككككككككك وا ح‬ ‫كككككككككك‬ ‫ةت حك كككككككككك حأل حكي‬
‫‪liable for damages sustained by the Customer,‬‬
‫ةت ة‬ ‫حك لكككككككك‬ ‫ككككككككلي‬ ‫ةت حك ككككككك ح ل حك كككككككك ت كككككككك‬
‫‪the technology, the electronic and electrical‬‬
‫‪equipment in the case of any of the above‬‬ ‫سككككككي ك خلكككككك خكككككك تا‬ ‫ة كككككك ح ةعككككككلى تال تقكككككك ة‬
‫‪events.‬‬ ‫ككككلحب ت كككك ل ة ةضككككلحأل كل م ككككا ةت حك ق كككك‬ ‫كككك‬ ‫حك كككك‬
‫ككككككككك‬ ‫ةت حكم كككككككك ح حالك لتل كككككككك تحك مل ف كككككككك ككككككككك‬

‫‪11. Termination‬‬ ‫‪ 11.‬اإلنهاء‬

‫‪terminate these Terms and Conditions at any‬‬

‫‪time and serve a notification to this effect on‬‬

‫‪11.2. Upon termination, any debit balance and other‬‬ ‫تة‬ ‫ككككككككك‬ ‫ة أل ككككككككك‬ ‫‪ 11.2‬تكككككككككك ى حيلمككككككككك ب صككككككككك‬
‫‪commitments of the Customer in connection‬‬ ‫ح‬ ‫سكككككك ق خلكككككك حك م ككككككا لظ ككككككل إ كككككك‬ ‫حك ةح كككككك‬
‫‪with using any services(s) herein shall‬‬
‫كككككككك حكشككككككككلتا‬ ‫حككككككككك حأل ككككككككك‬ ‫كككككككك حك كككككككك‬ ‫ة‬
‫‪immediately become due and payable, without‬‬

‫‪this Agreement for which Software or Materials‬‬ ‫تككككككك‬ ‫ككككككك ك تحكككككككك‬ ‫ككككككك ح‬ ‫ككككككك‬ ‫ككككككك‬ ‫تح‬
‫‪were supplied, any such Software or Materials‬‬

‫‪on behalf of the customer in recovering its dues‬‬
‫‪and enforcement of its rights and shall, unless‬‬ ‫كككك ة ككككا ح كككك ل ح‬ ‫حك م ككككا‬
‫كككك ت كككك ل كككك ً خكككك‬
‫‪paid directly by the Customer, be debited to the‬‬ ‫سكككككك ق تا تتي ككككككا ق ككككككا ت جكككككك عصكككككك تلكككككك‬
‫‪Customer's Account(s).‬‬ ‫سككككككككك ك‬ ‫ككككككككك‬ ‫تحك اقككككككككك‬ ‫تحك ككككككككك ك‬ ‫حكل ككككككككك‬

‫‪12. Customer Complaints Handling Mechanism‬‬ ‫‪ .12‬آلية البحث فى شكاوى ونزاعات العمالء‬
‫‪The customer shall contact the Call Center at‬‬ ‫حتصكككككك حك م ككككككا ملوككككككة ع كككككك حك مكككككك ب خلكككككك‬ ‫كككككك‬
‫‪(+974- 44840000) or pay a visit to the nearest‬‬

‫‪branch to submit his/her complaint in writing.‬‬
‫‪Then the Complaints & Quality Management‬‬ ‫ح حأل‬ ‫ح و كككككك ‪ .‬تقكككككك‬ ‫شكككككك‬ ‫ح ككككككلك كككككككلل حك قكككككك‬
‫‪Dept. shall examine the complaint within a‬‬ ‫ى‬ ‫كككككككم حكشككككككك‬ ‫حكمصكككككككلك‬ ‫حكشككككككك تى تحكجككككككك‬

‫‪and will be construed in accordance with the‬‬

‫‪Qatari law to the extent that such law do not‬‬
