ASSIGNMENT

1.

If I was granted a Notarial commission as Notary Public by the Executive Judge, I


will perform notarial acts in any place within the territorial jurisdiction of the
commissioning court which is within the territorial scope of the Regional Trial Court of
Iloilo City.

As stated in the 2004 Rules on Notarial Practice (A.M. No. 02-8-13-SC) Section 11, Rule III
that a person commissioned as notary public may perform notarial acts in any place within
the territorial jurisdiction of the commissioning court for a period of two (2) years
commencing the first day of January of the year in which the commissioning is made,
unless earlier revoked or the notary public has resigned under these Rules and the Rules
of Court.

The following Cities and Municipalities where can validly notarize documents that is
included in the territorial jurisdiction of Regional Trial Court of Iloilo City:

Thus, even if a private lawyer is granted a notarial commission, but if he exercises
it outside of the jurisdiction of the commissioning court, he conclusively acts
without authority. Accordingly, he may be disciplined or even penalized for the
same. The Supreme Court, in many cases, has imposed the penalties of temporary
or permanent bar from being commissioned as a notary public and/or suspension
from the practice of law to erring lawyers.

Enumeration the instances when a Notary Public may authenticate


documents without requiring the physical presence of the signatories.

The following are the instances when a Notary Public may authenticate
documents without requiring the physical presence of the signatories:

1. If the signatory is old or sick or otherwise unable to


appear, his presence may be dispensed with if one credible
witness not privy to the instrument and who is known to
the notary public, certifies under oath or affirmation the
identity of the signatory.

2. If two credible witnesses neither of whom is privy to the instrument, not


known to the notary public but can present their own competent evidence
of identity, certify under oath or affirmation to the identity of the signatory.

3. In case of copy certification and issuance of certified true copies.
