I am pleased to confirm our verbal offer of employment to you for a probationary full-time
position with 8 Quadrant Phils as a Telemarketing Representative, effective June 12, 2018. As
discussed, this offer is conditional upon completion of satisfactory references that could include,
but is not necessarily limited to, a review of past employment and education records.

The details of our offer, including the terms and conditions of your employment, are attached as
Schedule “A.”

Please take the time to carefully review our offer. This letter, along with the enclosed schedules,
outlines the obligations of both Company and yourself with respect to your employment
conditions, and is governed by the laws of the Philippine Labor Code as of May 1, 2018. It details
the terms and conditions of your employment with 8 Quadrant Phils, and will form our agreed
upon employment contract with you once signed.

Accepting employment will be conditional upon agreeing to and signing the attached copy of this
letter and the attached Schedule(s), initialing each page in the right-hand corner, and returning it
to me upon your earliest convenience, but prior to your first day of employment.

Terms and Conditions of Employment

The following outlines the terms and conditions of employment with 8 Quadrant Phils. The
Company reserves the right to change these terms and conditions as necessary, with due notice.

Responsibilities Your job responsibilities include a .copy of your position description is
attached as Schedule “B.”

While employed by the Company, you agree to work on a probationary


full-time basis exclusively for the Company and agree that you shall not,
while you are employed by the Company, be employed or engaged in any
capacity, in promoting, undertaking or carrying on any other business that
competes with the Company or interferes or could reasonably interfere
with your duties to the Company without our prior written permission.

Hours of Work The company’s core hours of operation are Monday to Friday from X:00
to X:00. Employees are expected to work a minimum of XX hours per
week.
Overtime Payment of overtime, for overtime eligible positions, will be paid for all
hours worked in excess of XX hours within one week.
Payroll Schedule Your salary will be paid to you on a semimonthly basis, less required
deductions, (through direct deposit) OR (by cheque).
Vacation You will be entitled to Number (X) weeks of vacation annually. OR You
will accrue vacation at a rate of X.XX days per month. Any further
increase is subject to policy. Vacation is to be taken at such time as is
determined by or acceptable to the Company.
Benefits You shall be entitled to participate in all benefit plans of 8QP as may be
made available to employees of 8QP from time to time for which you are
eligible.
Probationary To assess your fit within 8QP, the first three (3) months of your
Period employment will constitute a probationary period. At any time during this
probationary period, 8QP may terminate your employment without cause
and without advance notice or pay in lieu of notice. If this occurs, we
would have no further obligation to you, financial or otherwise.

Policies and 8QP has established a variety of policies and standards that ensure a safe,
Standards enjoyable working environment. During the period of your employment
with us, you agree to be bound by these policies and standards, and any
future policies and standards that are reasonably introduced by the
Company. It is agreed that the introduction and administration of these
policies is within the sole discretion of 8QP and that these policies do not
form a part of this Agreement. It is agreed that if 8QP introduces, amends
or deletes employment-related policies as conditions warrant that such
introduction, deletion or amendment does not constitute a breach of this
Agreement.
Confidentiality and Our offer of employment is conditional upon you agreeing to and abiding
Intellectual by the “Confidentiality and Proprietary Information Agreement.”

Non Solicitation You hereby agree that, while you are employed by 8QP and for one (1)
year following the termination of your employment with 8QP, you will
not (i) recruit, attempt to recruit or directly or indirectly participate in the
recruitment of, any 8QP employee or (ii) directly or indirectly solicit,
attempt to solicit, canvass or interfere with any customer or supplier of
8QP in a manner that conflicts with or interferes in the business of 8QP as
conducted with such customer or supplier.
Representation You hereby represent and warrant to 8QP that you are not party to any
written or oral agreement with any third party that would restrict your
ability to enter into this Agreement or the Confidentiality and Proprietary
Information Agreement or to perform your obligations hereunder and that
you will not, by joining 8QP, breach any non-disclosure, proprietary
rights, non-competition, non-solicitation or other covenant in favor of any
third party.
Changes to Duties If your duties or compensation should change during the course of your
and/or employment with Company, the validity of our agreement will not be
Compensation affected. In addition, if one or more of the provisions in our agreement are
deemed void by law, then the remaining provisions will continue in full
force and effect.
Resignation Should you wish to resign your employment with 8QP, you will be
required to provide Four (4) weeks’ written notice to enable us transition
your work.
Termination Company may terminate your employment at any time for cause.

After the end of your probationary period, Company may terminate your
employment without cause at any time by providing you with the
minimum notice, or pay in lieu of such notice, and any severance pay
required by the Philippine Labor Code and no more.

In the event a temporary layoff is ever required, it may be implemented in


accordance with the requirements of the Labor Code of the Philippines.
Legal Advice If you are uncertain about the contents of this offer, we suggest that it may
be advisable to seek independent legal advice prior to signing.

Job Description

Class Title: Telemarketing Representative Unit:

Reports To: Team Leader FLSA Status: Non-Exempt

CHARACTERS OF THE CLASS:


This position is responsible for outbound calls to convey product and promotional
information to former and existing 8 Quadrant Phils customers and all potential
customers as needed, as well as backup inside sales and customer service in a
professional and expedient manner.

ESSENTIAL DUTIES:
 Achieve daily outbound call objectives as assigned by TL
 Achieve sales goals as assigned by TL and/or Operations Manager
 Develops call patterns to former customers to convey promotional and product
information and secure sales for 8QP.
 Cold call people using a given phone directory to sell products or solicit donations
 Use scripts to provide information about product’s features, prices etc. and present
their benefits
 Ask pertinent questions to understand the customer’s requirements
 Persuade the customer to buy by demonstrating how merchandise or services meet
their needs
 Record the customer’s personal information accurately in a computer system
 Deal with complaints or doubts to safeguard the company’s reputation
 Go the “extra mile” to meet sales quota and facilitate future sales
 Keep records of calls and sales and record useful information

RELATED DUTIES:
 Participate in special project teams as requested.
 Remains current on changes in policies, procedures, and products and promotions.
 Performs other duties and projects as assigned.

MINIMUM QUALIFICATIONS:
 Proven experience as telemarketer or similar sales/customer service role
 Proven track record of successfully meeting sales quotas preferably over the phone
 Excellent communication and presentation skills
 Proficient in English
 Skilled in negotiation and dealing with complaints
 Persistent and results-oriented
 Patient and able to handle customer rejection
 High school diploma; BSc/Ba is a plus

CONFIDENTIALITY
AND
NON-DISCLOSURE AGREEMENT

This Agreement is made and entered into by and between 8 Quadrant Phils and the__________________
(Receiving Party) in connection with the information and data submitted by the former pertinent to information relevant
to ______________________________________________________. This Agreement is being executed to safeguard
and protect Confidential and Proprietary Information [Intellectual Property (IP) and/or Intellectual Property Rights
(IPRs)] owned by_____________________________.

8 Quadrant Phils (the “Disclosing Party”) and the Receiving Party do hereby agree, as follows:

1. “Confidential Information,” as used herein shall mean proprietary information and/or data provided by
__________________________________ to the Receiving Party during the disclosure of confidential
information, which are to be kept confidential by the Receiving Party.

2. All information provided through and/or by __________________________________to the Receiving


Party for the commissioned work shall be marked as “Proprietary and Strictly Confidential.”
Information disclosed through oral presentation and/or through power point presentation and/or other
means must be identified also as strictly confidential during and after the time/period of disclosure.

3. It is agreed that the Receiving Party shall keep the information confidential and shall not publish or
otherwise disclose such information except to the extent that it can be established by the Receiving Party
by competent proof that such information:

(a) Was already known to the Receiving Party, other than under an obligation of confidentiality, at
the time of disclosure and/or presentation;

(b) Was generally available to the public or otherwise part of the public domain at the time of its
disclosure to the Receiving Party;

(c) Became generally available to the public or otherwise part of the public domain after its
disclosure and other that through any act or omission of the Receiving Party; and

(d) Was subsequently lawfully disclosed to the Receiving Party by a Third Party.

4. Except as provided herein, the Receiving Party will not disclose any Confidential Information to any
other person or will use any Confidential Information other than in connection with the commissioned
work without its prior written approval. Each one or all agree to observe, exercise and execute extreme
care in protecting the confidentiality of any Confidential and Proprietary Information.

5. ___________________ may disclose Confidential Information (i) to other parties and/or Receiving Party
who have executed non-disclosure agreements (ii) or by requirement of law, and (iii) to other 8 Quadrant
Phils employee or faculty provided that such employee and/or faculty member/s has signed a
nondisclosure agreement.

6. All Confidential Information delivered/presented and/or disclosed by ______________________will be


and remain as Intellectual Property of ____________________________. All Confidential Information,
and/or any hard copies, thereof of the disclosed confidential information will be promptly returned to
________________________without retaining a copy in the possession of the Receiving Party. All
electronic documentation of the confidential information will be deleted from the file repository of the
Receiving Party once the commissioned work is completed, or if ______________________ wanted to
do so.
7. Any one or all persons listed herein recognize and agree that nothing contained in this Agreement shall
be constructed as granting any rights in his/her/their favor, by license or otherwise, to any Confidential
Information except as specified in this Agreement.

8. Any one or all persons listed herein similarly acknowledge that all Confidential Information is owned
solely by __________________and that unauthorized disclosure or use of such Confidential Information
would cause irreparable harm and significant injury, the degree of which may be difficult to ascertain.
Accordingly, any one or all persons listed herein agree that _________________shall have the right to
obtain an immediate injunction enjoining any breach of this Agreement, as well as the right to pursue any
and all other rights and remedies available at law or in equity for such breach.

9. This Agreement shall be constructed, interpreted and applied in accordance with the laws of the Republic
of the Philippines, subject to the terms and conditions as set of forth under Section 4of this Agreement.
Any violation of the provisions of this Agreement shall give cause for _______________________ to
proceed against the Receiving Party for appropriate action such as civil, criminal or administrative
remedies.

10. In the event of dispute arising and/or resulting from this Agreement, it is expressly agreed that the venue
thereof shall be in the proper courts of the City of Manila. It is also agreed the mediation, arbitration, and
other alternative modes of disputes resolution in accordance with the Procedure of Arbitration Law of the
Philippines, the Arbitration Rules of the United Nations Commission on International Trade Law
(UNCITRAL) or other similar arbitration rules and regulations.

11. This Agreement shall be in effect for five (5) years from the date of the last disclosure of Confidential
and Proprietary Information, at which time it will terminate.

This Agreement may be modified upon written agreement between the Parties.
