Nic Von Schneider has petitioned the Supreme Court of Saginaw Valley to certify questions regarding potential contradictions between the Student Association Charter and Bylaws. Specifically, Von Schneider questions whether two sections of the Bylaws contradicting a section of the Charter specifying that the Parliamentarian chooses the version of Robert's Rules of Order used. The Bylaws state that actions must be approved by majority vote unless otherwise specified in the Charter, Bylaws, or Robert's Rules of Order, Newly Revised and that Robert's Rules of Order, Newly Revised shall be used unless inconsistent with the Charter or Bylaws.

Does Article III, Section 1, 3.1.1 of the Student Association
Bylaws contradict Article I, Section 2, Subsection 3 of the Student Association Charter?
Does Article III, Section 7, 3.7.4 of the Student Association
Bylaws contradict Article I, Section 2, Subsection 3 of the Student Association Charter? LEGAL ARGUMENT
Article III, Section 1, 3.1.1 of the Student Association
Bylaws states: “The parliamentary Authority shall be based on Robert’s Rules of Order, Newly Revised in all cases in which it is not inconsistent with statute, the Charter, or the Bylaws, or the Standing Rules of Order.” (Emphasis added.) Article III, Section 7, 3.7.4 of the Student Association Bylaws states: “No act shall be valid unless approved at a meeting of the Association by a majority vote, unless otherwise specified in the Charter, Bylaws, or Robert’s Rules of Order, Newly Revised, of the members present and voting.” (Emphasis added.) Article I, Section 2, Subsection 3 of the Student Association Charter states in part, “... meetings will be conducted using the version of Robert’s Rules of Order that the Parliamentarian specifies at the beginning of his/her term.” The Parliamentarian conceivable has the right, under the Charter, to choose his or her version of Robert’s Rules of Order, however the Bylaws command that he or she use the Newly Revised version.
