The placing on the European Union (EU) market of live or unprocessed agricultural
products, processed agricultural products for use as food, animal feed, seeds and
vegetative propagating material, bearing a reference to organic production methods,
must comply with the rules laid down by Council Regulation (EC) No 834/2007 (OJ L-
189 20/07/2007) (CELEX 32007R0834).
Organic products from third countries may only be placed on the EU market when they
are labelled as products with indications referring to organic production, if they have
been produced in accordance with production rules and subject to inspection
arrangements that are in compliance with, or equivalent to Community legislation.
Imports into the EU are allowed according to the following schemes established by
Commission Regulation (EC) No 1235/2008 (OJ L-334 12/12/2008) (CELEX
32008R1235):
Country authorisation
In order to ascertain that goods have been obtained according to production rules
equivalent to those laid down in the Community, the European Commission makes a
thorough investigation into the arrangements in the country concerned, examining not
only the requirements imposed on production but also the measures applied to ensure
effective control. Where rules are found to be equivalent, the third country is included
in the list of authorised countries established in the Annex III of Commission
Regulation (EC) No 1235/2008.
Imports of organic products can only take place if these recognised authorities or
bodies have controlled them.
Documentary check
The release for free circulation into the EU of a consignment of organic products is
conditioned by the submission of the original certificate of inspection to the relevant
Member State's authority, the verification of the consignment by the relevant Member
State's authority and the endorsement of the certificate of inspection.
From 19 April 2017 the certificate could be submited by electronic means into the
Trade Control & Expert System (TRACES)by the first consignee. The rules foresee a
6-month transitional period during which both paper and e-certification will be used.
From 19 October2017 organic imports will be covered only by e-certification.
The importer should indicate the number of the certificate in the customs declaration
(Code C-644 in box 44 of the SingleAdministartive Document -SAD).

summary of the information consisting of import authorisations, ingredient
authorisations and bodies or public authorities in charge of

The inspection body will verify that the inspection certificate, preferably written in
German, is compliant with the requirements derived from the aforementioned EU
legislation. Additionally, and if deemed necessary, the actual products may be
physically inspected in order to assure the required level of compliance with these
requirements.
The release for free circulation of products not complying with the requirements is
conditional on the removal of references to the organic production method from the
labelling, advertising and accompanying documents.

nº 889/2008 de la Comisión (DO L-250 18/09/2008) (CELEX 32008R0889) cubren principalmente

Las autoridades designadas en los Estados miembros aplicarán las medidas de inspección y el
sistema de control específico que se aplicarán a este tipo de productos.
Los productos orgánicos de terceros países solo pueden comercializarse en la UE cuando están
etiquetados como productos con indicaciones referentes a la producción ecológica, si han sido
producidos de acuerdo con las normas de producción y sujetos a acuerdos de inspección que
cumplen o equivalen a Legislación comunitaria.
Las importaciones en la UE están permitidas según los siguientes sistemas establecidos por el
Reglamento (CE) no 1235/2008 de la Comisión (DO L-334 12/12/2008) (CELEX 32008R1235):
Autorización de país
Para asegurarse de que los productos se han obtenido de acuerdo con normas de producción
equivalentes a las establecidas en la Comunidad, la Comisión Europea realiza una investigación
exhaustiva de las disposiciones en el país afectado, examinando no solo los requisitos impuestos a
la producción sino también las medidas aplicadas para garantizar un control efectivo. Cuando las
normas se consideran equivalentes, el tercer país se incluye en la lista de países autorizados
establecida en el anexo III del Reglamento (CE) no 1235/2008 de la Comisión.
Las importaciones de productos orgánicos solo pueden tener lugar si estas autoridades u
organismos reconocidos las han controlado.
Control documental
Los envíos importados deben estar cubiertos por documentos expedidos por la autoridad u
organismo competente en el tercer país, que acredite que el envío cumple con la legislación
comunitaria:
A partir del 19 de abril de 2017, el primer consignatario podrá enviar el certificado por medios
electrónicos al Sistema de Control de Comercio y Expertos (TRACES). Las reglas prevén un período
de transición de 6 meses durante el cual se utilizará tanto el papel como la certificación
electrónica. A partir del 19 de octubre de 2017, las importaciones orgánicas estarán cubiertas solo
por certificación electrónica.
El importador debería indicar el número del certificado en la declaración en aduana (Código C-644
en el casillero 44 del Documento de Administración Única -SAD).

El despacho a libre práctica de productos que no cumplan con los requisitos está condicionado a la
eliminación de las referencias al método de producción orgánica del etiquetado, la publicidad y los
documentos que lo acompañan.
