Yale alumnus, award-winning filmmaker, and African American Studies scholar Dr. Robin J. Hayes sues her former employer, The New School, alleging she was fired in retaliation for objecting to being discriminated against because of her race, gender, color, and sexual orientation. Hayes also claims the university repeatedly breached their contract when it refused to consider her for promotion to tenure. During her work at The New School, Hayes consistently advocated for students who are people of color, women, and LBGTQ identified, according to the lawsuit.
The complaint (filed in the United States District Court for the Southern District of New York on July 11, 2018) argues Dr. Hayes found The New School’s administration hostile toward her work; although she excelled by directing the documentary film "Black and Cuba," publishing research, engaging in community service, and establishing a leadership program for students. According to the lawsuit, senior administrators at the university instructed Hayes to “do less around diversity” and refused to implement hip hop-related curriculum she proposed. The Ford Foundation and National Endowment for the Humanities have funded Hayes’ work.
Hayes’ insistence that the University honor her contract was also met with vitriol by senior leadership, including Provost/Chief Academic Officer/Associate Professor Tim Marshall, according to the complaint. The suit claims Marshall authored a termination letter to Hayes in which he made a series of false allegations about her conduct and then referred to her legal objections to discrimination as a “protest.” On the university’s website and Twitter profile, The New School lauds itself as a progressive bastion of social justice and dissent.
