INRTODUCTION

A tort, in common law jurisdictions, is a civil wrong that causes a


claimant to suffer loss or harm resulting in legal liability for the
person who commits the tortious act. Trespass to goods consists of
direct physical interference with the goods which are in plaintiff’s
possession, without any lawful justification. It may take numerous
forms, such as throwing of stones on cars, shooting birds, beating
animals or infecting them with diseases or chasing animals to make
them run away from their owners’ possession. It is also a trespass to
kill a dog by giving it a poisoned meat .Tress to goods is actionable
per se, that is, without the proof of any damage. However, when the
plaintiff has suffered no loss, he will get only nominal damage.

AIMS AND OBJECTIVES

This project thorough a focused analysis of the tort of trespass to


goods following some landmark decisions and other authorities
intends to clarify what kind of situations make for a valid standing of
trespass to goods in court and the defences available in them, if any.

RESEARCH METHODOLOGY

The researcher will be relying upon Doctrinal Method of research to complete


the project.
