JUDICIAL COUNTER-AFFIDAVIT

I, ERWIN CIMAFRANCA, 45 years of age, Filipino, married,

resident of Brgy. Zone III, Sogod, Southern Leyte, Philippines after having
been duly sworn to in accordance with law, hereby depose:

PRELIMINARY STATEMENT

The person examining me is Atty. Angelica Grace G. Reyes of the

Public Attorney’s Office. The examination is being held at the Public
Attorney’s Office, Sogod, Southern Leyte. I am answering her questions
voluntarily, to the best of my knowledge and fully conscious that I do so under
oath and may face criminal liability for false testimony and perjury.

PURPOSE

This Judicial Counter-Affidavit is being offered to prove that the

accused is innocent of the crime charged.

Q1: Nganong nia man ka sa opisina sa PAO karon? (Why are you here in the
PAO Office?)
A1: Kay magpatabang ko ug tubag sa ahong kaso. (Because I want to ask help
regarding my case.)

Q2: Dis-a man diay ka kaniadtong Mayo 15, 2018 sa may mga alas 6:00 and
takna sa gabii?(Where were you on May 15, 2018 at around 6:00 o’clock in
the evening?)
A2: Naa ko sa videokehan sa Zone III, uban nila Eugene Porgarillas ug si
Wilson Quijano. Nag-inom mi kay napildi ag among kandidato pagka-kapitan
sa eleksyon sa barangay. (I was at the videoke place in Zone III, Sogod,
Southern Leyte with Eugene Porgarillas and Wilson Quijano. We were having
a drinking spree because the candidate we supported during the Barangay
Elections lost.)
Q3: Kinsa pa ma’y naa didto? (Who else were there?)
A3: Sila Ronald Magna, Potenciano Pasulujan ug uban pa, nag-inom atbang
sa videokehan, sa pajag ni Juliet Amongan. (Ronald Magna, Potenciano
Pasulujan and some other people were also having a drinking spree just
across from the videoke place at the make-shift house owned by Juliet
Amongan.)

Q4: Unsa may sunod nga nahitabo? (What happened next?)

A4: Pagkataod taod, kadungog ko sa ilang storya na “Bisag kinsa kontra ni
Bembem, mapildi jud.” ug nang hagit pa sila namo agi sa padungog dungog
ug mag sige pa ug katawa. (After some time, I heard them saying, “Bisag kinsa
kontra ni Bembem, mapildi jud.” and they began taunting us and snickering
in our direction.)

Q5: Unsa man ang imong gibuhat? (What did you do?)
A5: Sa una, wa ra nako gitagad kay naa man gud ko didto aron maglipay lipay,
dili mangita ug away. (At first, I ignored them because I was there to be merry
and not to get into trouble.)

Q6: Unja, unsa man ang sunod nga nahitabo? (Then, what happened next?)
A6: Pagka alas 7 na anang gabii, nahutdan na gajud ko ug pasensya kay
nagsige pa jud sila ug pang-insulto namo ug sa among kandidato. (At around
7:00 on that same evening, I lost my patience with them because they were
still hurling insulting words at us and at the candidate we were supporting.)

Q7: Unsa may sunod nga nahitabo? (What happened next?)

A7: Mingkuha ko ug kawajan gikan sa ali sa balay duol namo ug ningduol ko
nila. Akong gipakita nila ag kawajan ug nangutana ko nila, “Kinsa’y isog
ninjo diha?” (I got a bamboo stick from the fence of the house where we were
drinking and I stormed towards them. I brandished the bamboo stick I was
holding and then I asked them, “Kinsa’y isog ninjo diha?”.)

Q8: Unja, unsa man ang gibuhat nila? (Then, what did they do?)
A8: Ning dagan dajon sila pagkahuman ana. (They ran immediately after
that.)

Q9: Unsa may sunod nga nahitabo? (What happened next?)

A9: Pagkahuman ana, naa’y mga pulis naabot didto ug giingnan ko na
arestuhon kuno ko mahitungod sa panghitabo ganina sa gabii. Niuban pod ko
nila. (Some time after, some police officers arrived at the scene and told me
that I was being arrested for the incident earlier that night. I willingly went
with them to the Police Station.)

Q10: Unsa man ang imong ikasulti sa akusasyon batok kanimo? (What can
you say about the accusation against you?)
A10: Dili na tinuod na nanghulga ko ni Ronald Magna ug Potenciano
Pasulujan na naa ko’y buhaton na krimen nila. Igo ra ko nag-ingon nila na,
“Kinsa’y isog ninjo diha?” tungod kay ganahan ko na di na sila mag sige ug
storya ug lain kaajo na mga butang, unja kahibaw pa jud sila na naa mi didto.
Mao ra to akong intension. (It is not true that I threatened Ronald Magna and
Potenciano Pasulujan that I will commit a crime towards them. I just said
“Kinsa’y isog ninjo diha?” because I wanted them to stop hurling insulting
words towards us, even if they knew that we were there. That was my only
intention.)

Q11: Naa pa kay laing ipuno ug isulti? (Do you have anything more to say?)
A11: Wa na maam. (Nothing else.)
