Jain Subodh Law College State Moot Court Competition - 2018’, to be held from 20° September to 22" September, 2018 to enable law students from all across Rajasthan to participate and showcase their majesty over law and legal principles; THEREFORE, the Moot Court Committee of S.S. Jain Subodh Law College, Jaipur, hereby declares the following rules, namely: for Justice and Peace 1° S.S. JAIN SUBODH LAW COLLEGE, JAIPUR, STATE MOOT COURT COMPETITION - 2018 CHAPTER -I PRELIMINARY 1. (1) Short title and commencement: These rules may be called State Moot Court Competition Rules, 2018 (hereafter referred as SMCC Rules, 2018). (2) They shall come in to force from the date of publication, on the official website of S.S.Jain Subodh Law College, Jaipur-www.subodhlawcollege.com Definition: In these rules, unless the context otherwise requires, - ‘Institution’ means and include 'S.S. Jain Subodh Law College, Jaipur’, affiliated to University of Rajasthan; ‘Competition’ means the 'I“ §.S. Jain Subodh Law College State Moot Court Competition - 2018'. ‘Governing Council' means the student-faculty-staff body appointed for the administration and smooth conduct of the competition, including all other members conferred with powers on ad-hoc basis by the Faculty In-charge of the Moot Court committee of S.S. Jain Subodh Law College, Jaipur; "Team’ means and includes only bona fide representatives of any University for Justice and Peace or college, may that be state or central or any other department recognized/authorized by the Bar Council of India to impart law degrees, and who have applied and registered for the competition by complying with the procedure prescribed in these present rules:' Team Code! means a unique code assigned by the institution to the applied and registered team:' Moot Problem! means a set of facts published by the institution for competition;' Bench’ refers to the members duly invited by the institute, to adjudge any of the rounds, collectively;’ Memorial Round’ refers to the assessment of memorials, submitted by teams, on the predefined criterion, hereinafter mentioned in these rules;' Oral Round ' refers to the oral pleadings made by the teams before the bench during any of the rounds of assessment, including time given for rebuttal; In these rules, except as otherwise indicated, a reference to a rule is reference to that rule in these rules, and a reference to a form is a reference to that form attached in annexure to these rules, as the case may be. 3. a @ (3) @ for Justice and Peace CHAPTER IT REGISTRATION PROCESS AND FEES DETAI Eligibility. - Students duly enrolled and pursuing full time 5 year or 3 years undergraduate law course may apply in a team of 3, that includes two orators and one researcher; Students enrolled and pursuing post-graduate diploma or short term certificate courses in law are not eligible to apply Students from any University/Department/ Institute not recognized by the Bar Council of India, to impart law degrees are not eligible to apply; Any person, other than the 3 team members are not eligible to avail facilities reserved for the student participants. 4, Registration Procedure.— a (a) Each team shall register to the institute, by sending scanned copy of duly filled registration form, in the prescribed manner (Refer Annexure - I) on or before Ist September, 2018, 05:00 pm to slemee] 8@gmail.com. (b) Ahard copy of the registration form shall also be sent to the institute on or before 06° September, 2018 along with the Demand Draft for payment of registration fees. (c) Late submission shall not be entertained, under any of the circumstance; On completion of the timeline for registration, as specified, the institute shall respond to each team with a unique team code, which shall be printed on the memorials in the specified place and also shall be used to identify teams for Justice and Peace during the competition; Each registered team shall send soft copy of memorial from both sides to the governing council at slememorials@gmail.com on or before 12" September, 2018. Clarifications can be sought on any part of moot proposition. These clarifications are to be sent via mail on slemec18@gmail.com. It is the discretion of the governing council, whether clarifications sought are valid or to be clarified, These clarification mails are to be sent before 5" September, 2018. 5. Fees and Payment.— a The registration fees for the competition is Rs. 3000/- (In words- Rupees Three Thousand only) with accommodation and Rs. 2000/- (In words- Rupees TwoThousand Only) without Accommodation, which includes accommodation for competition days, food, pickup from airport/railway station, and any other facility provided by the institute, to its discretion. The registration fees shall be paid only by Demand Draft to be drawn in favor of'S.S. Jain Subodh Law College' payable at Jaipur. The Demand Draft shall only be the mode of payment; the registration fees in no other form shall be accepted. for Justice and Peace CHAPTER II MEMORIAL 6. Written Submissions. (1) Each team shall research in the domain of moot problem and prepare memorial from both sides, namely, petitioner/appellant and respondent; (2) Thememorials shall have following heads, namely- a. Cover Page (It shall include the team code in upper right hand corner, name of the case, parties for which written submissions are made, name. of the forum approached for dispute resolution, year.) Table of Contents List of Abbreviations Index of Authorities Statement of Jurisdiction Statement of Facts Issues Raised Summary of Arguments i, Arguments Advanced j. Prayer No team shall specify anything other than that mentioned under clause (2) to in order to maintain anonymity, Each team shall submit a soft copy (one in .docx and the other in .pdf) of the memorials from both sides to be mailed to the institute at for Justice and Peace slememorials@gmail.com on or before 12"September, 2018, 05:00pm. ‘The memorials shall be assessed out of 100 marks, by a team of experts on the predetermined criterion, as specified here under- (a) Clarity of Facts (20 marks) (b)_ Use of Law (20 marks) (c) UseofAuthorities/Precedents (20 marks) (d) Argumentation and Clarity of thoughts (20 marks) (ce) Presentation (10 marks) (f) Originality (10 marks) All teams are requested to bring 5 hard-copies of their memorial from each side (total 10 copies) when they report for on-site registration on 20" September, 2018. They shall handover these copies while they register on site. The softcopy submitted for the memorial round and the hard copy submitted during the registration have to be identical. Any discrepancies observed may lead to severe penalties that may include, but is not limited to the disqualification of the team. Formatting and Citations. — (1) Alll written submissions shall be typed on A4 size paper, in Times New Roman (font type), in 12 points (font size), line spacing 1.5, both side Justified, and headings to be in the same font and size, but with bold. (2) Written submission shall contain a border. (3) Each page shall have | inch margin from each side. (4) Cover page of the memorial on behalf of petitioner/appellant shall be in blue, and respondent shall be in red. The memorial shall be spiral bound only and shall not contain more than 25 pages, excluding cover page, for Justice and Peace table of content and index. (5) All teams shall give footnotes by adhering to Blue Book: A Uniform System of Citations (19" Edition) 8. Plagiarism. — (1) Memorial or any other parts of the pleadings if found to be plagiarized, then governing council reserves the right to disqualify a team, at any stage of the competition. 9. Anonymity of Teams.- (1) Teams shall not reveal their identity in any form, except by means of the Team Codeallotted to them during the Competition. (2) The Written Submissions shall not reveal the identity of the team in any form and should not bear the logo, name etc. of the University/College represented. Any material presented to the Panel should be devoid of any identification mark/seal of the Team. If any such mark/seal exists, it must be rendered unrecognizable. Any violation of Rule 9 shall attract severe penalty or disqualification as determined by the Governing Council. The decision of the Governing Council in this regard shall be final and not subject to challenge. During the submission of the memorial, the email should have no reference to the name of the institution and should only contain the team code. for Justice and Peace CHAPTER IV ORAL PLEADINGS AND SELECTION CRITERION 10. Dress Code— (1) The participants shall adhere to the following dress code while in the court rooms: a. Ladies: White salwar and kurta or white shirt and black trousers or skirt along with black blazer and black shoes; and b. Gentlemen: White shirt, black trousers and black tie along with black blazer and black shoes. (2) The above mentioned dress code extends to the Inaugural and Valedictory ceremonies as well. 11. Structure of the Competition. - (1) The competition will be held for three days 20°-22"' September, 2018. Inauguration of the competition along with memorial exchange for the Preliminary Round shall be conducted on 20" September, 2018 at 11:00 A.M. (2) The competition shall have two Preliminary Rounds, one Quarter Finals, one Semi-Finals and the Final Round. 12. Scouting. (1) No member of any team will be permitted to hear the arguments in any courtroom in which that team is not one of the contesting teams whilst that team is in the competition. The Governing Council shall take strict action, which may include but not be limited to the expulsion of the said team from the competition, ifthis rule is violated. 13. Preliminary and Quarter Final Round.— (1) (2) (3) (4) (5) (6) (7) (8) (9) (10) (uy for Justice and Peace There shall be Preliminary and Quarter final rounds held. For Preliminary Rounds -Each team shall argue once from petitioner/appellant side and from respondent side in no particular order. The Quarter final round consisting of 8 teams in total. It shall be a knock out round and teams are required to plead only once, side to be pleaded shall be based on draw of lots. In both rounds, each team will be given 20 minutes to present oral pleadings and additional 5 minutes shall be reserved for rebuttal Teams are required to exchange their memorials and shall return the same intact to the governing council on completion of their respective rounds. Oral pleadings of the team would be adjudged by a panel of 2 judges, invited by the institution. Extension of timings shall be at the discretion of the judges. In no case researcher would be allowed to plead, however he is allowed to pass notes to the orator with the prior leave of the judges. Case compendium or any other relevant material to be submitted to the judges shall be submitted only through court masters. No team is allowed to carry Mobile inside the court room for research or any other pupose. No team shall indulge themselves in any act of misconduct in or out of the court room undermining the credibility of judges or that of the competition, if done it may lead to immediate disqualification. 14. Semi-final Round. - (1) Semi-final round shall be a knock out round consisting of 4 teams in total. Sideand teams would be determined on the basis of draw of lots. for Justice and Peace (2) Each team will get minimum 40 minutes to argue from the allotted side, including 5 minutes time reserved for Rebuttals. 15. Final Round.— ad) Final round shall be a knock out round consisting of 2 teams in total. Side would be determined on the basis of draw of lots. (2) Each team will get minimum 45 minutes to argue, including 5 minutes for Rebuttal, Side on which teams would be arguing is based on draw of lots. 16. Assessment Criterion for Oral Pleadings. — (1) Team performance shall be judged in all rounds on the basis of following criterion_ (a) Knowledge of the Facts (20 marks) (b) Application of Laws to the Fact and Interpretation (20 marks) (c) Argumentative Skills (20 marks) (d) Clarity of Thoughts and Expression (20 marks) (¢) Court Mannerism (10 marks) (6) Response to Questions (10 marks) 17, Qualifying rules. — (1) Each preliminary round shall be decided on the basis of allocation ofa total of 150 marks; which includes 50 marks of memorial and 100 marks of oral pleadings. (a) Any team scoring the highest out of 100, in each round, will be declared as winner. for Justice and Peace (b) Ifthere isa tie, to be qualified for quarter final round then, the team which has obtained higher memorial marks shall qualify to the quarter finals Quarter final round would be a knock out round; marks obtained only in oral pleadings out of 100 will be a decisive factor in determining which team will qualify semi-finals. In case of tie in oral pleading marks, then the memorial marks will determine qualifying team. Even if tie persists then, a team with highest individual score will qualify for semi-finals. Semi-final round would be a knock out round, marks obtained only in oral pleadings, out of 100, will bea decisive factor in determining which team will qualify finals. In case of tie in oral pleading marks, then the memorial marks will determine qualifying team, Even if tie persists then, a team with highest individual score will qualify for finals. In the Final Round average marks obtained only in oral pleadings out of 100 will be a decisive factor in determining whichever team has won the competition. In case of tie in oral pleading marks, then the marks obtained in memorial round will determine winner. Ifa tie persists, the team with highest individual score will be declared as winner of the competition. 18. Awards and Certificates, — () (2) (3) Best team shall be awarded with a trophy, certificate of merit and a cash prize of Rs. 15,000/-. Runners up shall be awarded with a trophy, certificate of merit, and a cash prize of Rs. 10,000/-. Best speaker is determined on the basis of highest marks obtained in the preliminary round, and shall be awarded with a trophy, certificate of merit, and cash prize of Rs. 5000/- Best memorial is determined on the basis of highest marks obtained in the memorial round, and shall be awarded with a trophy, certificate of merit and cash prize of Rs. 5000/-, for Justice and Peace CHAPTER V MISCELLANEOUS 19. Miscellaneous Provisions.- Accommodation shall be provided to the participants only during the days of the Competition The governing council reserves the right to amend, modify, change or repeal any of the Competition Rules and the same shall be communicated toteams. All teams are bound to follow code of conduct and rules laid down by S.S Jain Subodh Law College, Jaipur and its constituent departments. Carrying, possessing and consuming liquor, cigarettes or any other intoxicating material shall be dealt strictly. Any behavior of indiscipline with governing council or any other staff member or student volunteer shall be dealt strictly Noaudio or videotaping of oral pleadings is permitted. (7) No team shall ask for feedback immediately on completion of each round, however, at the end of all rounds member may talk to judges, with minimum inconvenience caused to them (8) Any attempt to approach framer of the moot problem or judges of the competition, prior to the competition shall be dealt strictly. In case of any other conflict the decision of the Governing Council shall be final and binding. for Justice and Peace 1"' S.S. Indostan is a country whose laws are identical to that of India, While gaining independence in 1950, Indostan got partitioned on communal lines, A separate Republic called ‘Republic of Palistan’ was carved out and separated from Indostan, . However, Indostan remained home to eight major religions of the world and a large number of languages and dialects. Indostan focused on national development and established itself.as a democratic State with no official religion. Communal harmony in Indostan remained predominantly peaceful with exceptions of infinitesimal disruptions. But as decades passed, the communal atmosphere of the country began to heat up. A number of communal riots broke out in various parts of the country and proactive attempts to reinstate peace in the nation were made. . With the increase in usage of social media, hate-speeches easily found their ways to arouse the masses for violence. Fake news and propaganda witnessed unprecedented rise on internet and the chaos diverted the nation from the exclusive path of development. . On 15.03,2017, a sadist communal violence broke out in the city of Mahore—the capital of Indostan, as a consequence of a video circulated on a messaging app named 'Howsapp’. The violence was reported relentlessly by news and social media which resulted in a series of communal clashes in various parts of the country. . On 02.04.2017, Mariah Muzo, a political leader, was shot dead by an assassin for his communal speeches. His community avenged the killing by setting ablaze Jacob Paloz outside his residence a week later, The chaotic national life took a more ugly turn, A month after political killings, a minor git! child was raped to instil fear in the community. for Justice and Peace . Thereafter, 19 riots broke out in various districts of the country and a large amount of security forces had to be deployed. Indostan came to a standstill and the country suffered an economic loss of 187 crores overa week. . Observing the destructive state of internal affairs, a Member of Parliament of the ruling party introduced Prevention of Selective Violence against Minorities Bill, 2017 in the Parliament. The Bill was easily passed because of overwhelming majority of the ruling party in both the Houses of Parliament and the said law came into force on 19.12.2017. . Following the enforcement of law, enormous number of arrests and detentions were made, including detention of a journalist - NizadPolad,who was detained on the grounds of circulation of hate speech punishable under Section 49 of the above-mentioned Act since for publishing news which was true but had amplified communal tension. At the same time, his son, Adolf Polad, was arrested in case of attacking minorities and was being prosecuted under section 33 of the Act. . After few days, NizadPolad was found dead inside pit near Dhwandagarh Police Station, In this miserable state of affairs, Nizad’s wife - SacrotPolad, was approached by a Non-Governmental Organisation named “Majasthani Union for Civil Liberties” which filed a PIL petition in High Court of Judicature for Majashtan challenging the provisions of Prevention of Selective Violence against Minorities Act,2017 forbeing violative of Constitution of Indostan. 10. Admitting the petition, the High court confirmed the following issues for adjudication: a, Whether Sec. 23is arbitrary, unjust and violative of Article 14 of the Constitution. b. Whether Sec 33 of the Act is vague, arbitrary and violative of Article 14 of the constitution. c. Whether Section 49of the Act is violative of right to Freedom of Speech under Article 19(1)(a). for Justice and Peace 1° §.S. JAIN SUBODH LAW COLLEGE, JAIP. STATE MOOT COURT COMPETITION - 2018 PROVISIONS OF PREVENTION OF SELECTIVE VIOLENCE 2017 Section 23: Removal of person likely to commit an offence under this Act.- (1) Where a Magistrate is satisfied, suomotu or upon a complaint ora police report that a person is likely to commit an offence under this Act in any area ina State, it may, by order in writing, direct such person to remove himself or herself’ beyond the limit of such area, by such route and within such time as may be specified in the order, and not to return to that area from which he or she was directed to remove himself or herself for such period, not exceeding six months, as may be specified in the order. Section 33: Attack on minorities to be prosecuted under this Act.-All attacks on minorities shall be prosecuted by a special public prosecutor appointed by Government of Indostan and the Courts shall presume guilt of accused, unless proved innocent. Section 49: Circulation of hate-speech: Any person sending message which is offensive or menacing, or, true or false information circulated for generating hatred, ill-will, enmity, insult or injury shall be punished with rigorous imprisonment for a term which shall not be less than ten years but which may be for life, for Justice and Peace S.S.
