DEED OF CONFIRMATION

THIS DEED OF CONFIRMATION is made and entered into at


Mumbai on ___ day of June, 2018 BETWEEN MR. PANDURANG
MAHADEO KADAM (Pan No. AHYPK1328A, Aadhaar No. : 4257
6163 4102) an adult, aged 69 years, an Indian Inhabitant, residing at Flat No
D-310, Ramesh Enclave, Sec-23, Nerul, Navi Mumbai - 400706 (which
expression shall unless it be repugnant to the context or meaning thereof
shall mean and include his heirs, executors, administrators and assigns)
hereinafter referred to as THE PARTY OF THE FIRST PART AND MR.
KHALID SAYED (Pan No. CFYPS9781R, Aadhaar No. : 2542 7811
5500) an adult, aged 49 years, an Indian Inhabitant, residing at Tenament
No. 412/B/5041, 2nd floor, Tagore Nagar Aarambh Co-operative Housing
Society Ltd., Tagore Nagar, Vikhroli (East), Mumbai - 400 083 (which
expression shall unless it be repugnant to the context or meaning thereof
shall mean and include his heirs, executors, administrators and assigns)
hereinafter referred to as THE PARTY OF THE SECOND PART.

WHEREAS THE PARTY OF THE SECOND PART had


purchased the Tenament No. 412/ B /5041, 2nd floor , Tagore Nagar
Aarambh Co-operative Housing Society Ltd., Tagore Nagar, Vikhroli(East),
Mumbai 400 083 in the year 2004 (hereinafter referred to as “THE SAID
TENAMENT”) from THE PARTY OF THE FIRST PART as per
document placed at Annexure-I attached to this DEED OF
CONFIRMATION. THE PARTY OF THE FIRST PART has already
handed over the possession of the said tenament to the PARTY OF THE
SECOND PART in the year 2004 and THE PARTY OF THE FIRST
PART is no where responsible for the non payment of stamp duty and
registration charges by the PARTY OF THE SECOND PART .
AND WHEREAS the PARTY OF THE SECOND PART has
now approached the PARTY OF THE FIRST PART with a request to
reguralise the sale vide registration for administrative reasons through
a DEED OF CONFIRMATION in the present date.
AND WHEREAS it has been informed by THE PARTY OF THE
SECOND PART to THE PARTY OF THE FIRST PART that the said
purchased property i.e., THE SAID TENAMENT has not been
transferred by him during the past several years since the date
03/09/2004 due to his personal reasons : -
NOW THIS DEED OF CONFIRMATION WITNESSETH AS UNDER
1. That the PARTY OF THE FIRST PART hereby has made free from
all claims and encumbrances whatsoever, all and singular his right, title and
interest in THE SAID TENAMENT. That it is agreed and recorded that
hand over of THE SAID TENAMENT by the PARTY OF THE FIRST
PART in favour of the PARTY OF THE SECOND PART is completed in
the year 2004.
2. That PARTY OF THE FIRST PART has confirmed and handed over
all the relevant documents, papers, records and transfer letter and transfer
forms duly signed and executed for transfer of right, title and interest of
THE SAID TENAMENT to the PARTY OF THE SECOND PART on the
date of execution of this DEED OF CONFIRMATION.

3. That the PARTY OF THE FIRST PART agrees and covenant that
from the date thereof till the completion of the transfer of THE SAID
TENAMENT in favour of the PARTY OF THE SECOND PART, the
PARTY OF THE FIRST PART shall not cause or cause to be done or omit
to do any act, matters, deeds or things which may in any manner
prejudicially effect the right, title and interest in THE SAID TENAMENT
on the date of completion of the transfer under this DEED OF
CONFIRMATION.
4. That the PARTY OF THE SECOND PART has agreed to
become a member of Tagore Nagar Aarambh Co-operative Housing
Society Ltd. formed by the allottees, and abide by all and singular the
bye – laws, rules and regulations adopted by the said society or which if
may adopt from time to time.
5. That the PARTY OF THE SECOND PART has agreed that if any
kind of claim/s arises from the Government or any Central / State
Government authorities viz Registrar , Income Tax , Anti - Corruption
Bureau etc in future after the registration of this DEED OF
CONFIRMATION for the purpose of regularisation of the Annexure-I
attached to this DEED OF CONFIRMATION, then THE PARTY OF
THE SECOND PART shall be sole responsible for the said DEED OF
CONFIRMATION. Any claim/s arising by the Government authorities
will be paid by THE PARTY OF THE SECOND PART and shall be
solely responsible for the same. In case of the PARTY OF THE FIRST
PART is held responsible by Government Authorities then this DEED
OF CONFIRMATION stands cancelled and the PARTY OF THE
SECOND PART will take full responsibility of the enforcing the
“PARTY OF THE FIRST PART” to enter into such agreement OR
hand over peaceful possession of the “SAID TENAMENT” OR “PAY
ALL THE DUES AS DEMANDED BY ANY OF THE GOVERNMENT
AUTHORITIES”
6. That the PARTY OF THE FIRST PART shall whenever required to
do so, from time to time and at all the times hereafter execute and sign or
caused to be executed and/or sign all such letters, forms, applications, deeds,

legal documents whatever and wherever necessary, writings and papers if


any for more perfectly securing, assuring and effectually transferring THE
SAID TENAMENT unto and to the use of the PARTY OF THE SECOND
PART forever and also present this DEED OF CONFIRMATION before
the Jt. Sub – Registrar of Assurance for registration purpose and to admit
execution thereof.
7. That the PARTY OF THE FIRST PART shall execute all the
necessary legal documents and / or transfer forms, in favour of the PARTY
OF THE SECOND PART for the effectual transfer of THE SAID
TENAMENT in the name of PARTY OF THE SECOND PART. The
PARTY OF THE FIRST PART shall have NO OBJECTION
CERTIFICATE to transfer the rights of THE SAID TENAMENT such as
Electric Meter, Ration Card etc., in the name of the PARTY OF THE
SECOND PART.
8. That the PARTY OF THE FIRST PART do hereby further covenants
with the PARTY OF THE SECOND PART that the said PARTY OF THE
SECOND PART shall henceforth quietly and peacefully possess and
occupy THE SAID TENAMENT without any let, hindrances, denial,
demand, interruption, eviction by the PARTY OF THE FIRST PART or
any other person/s lawfully claiming or equitably claiming through or under
him.
9. That the PARTY OF THE SECOND PART is entitled to have and to
hold the possession, occupation and use of the said tenament and the
PARTY OF THE SECOND PART shall hold the same unto and to the use
and benefit of the PARTY OF THE SECOND PART, his heirs, executors,
successors and assign forever without any claims, charges, right, interest
demand or lien of the PARTY OF THE FIRST PART or any person or
persons claiming through or under him subject to payment by the PARTY
OF THE SECOND PART including all the taxes, maintenance, charges
and/or call made by the concerned official authorities thereby.
10. That the Stamp Duty, Registration Charges and Expenses incidental
thereto if any payable in respect of this DEED OF CONFIRMATION for
the purpose of regularisation of the Annexure-I attached to this DEED

OF CONFIRMATION relating to THE SAID TENAMENT shall be borne


and paid by the PARTY OF THE SECOND PART only.

(East), Mumbai 400 083, admeasuring 144 Sq.ft., built up, building
constructed in the year 1981 on CTS No. 295 of Village - Haryali and
consisting of Ground + 4 floors without lift facility.
IN WITNESS WHEREOF THE PARTIES HERETO HAVE
HEREUNTO SET AND SUBSCRIBED THEIR RESPECTIVE HANDS
ON THE DAY AND YEAR FIRST HEREINABOVE MENTIONED.
