INTRODUCTION

Shri Hari Singh Gaur was first in the Legal history of India, who realized the necessity of
establishing an all Indian court of final appeal in India in place of the privy council. So many
times he moved resolutions in the Central Legislative Assembly between 1921-1925
regarding establishment of a Court of Ultimate Appeals in India. The efforts were made in the
First, second and third round table conferences for the establishment of a Federal Court in
India. Section 200 of The Government of India Act, 1935 laid the foundation for the federal
framework in India. Ultimately, the Federal Court of India was established in 1937 as a
judicial body under the provision of The Government of India Act, 1935 with original,
appellate and advisory jurisdiction. It functioned till the Supreme Court in India was
established in 1950 and in Pakistan in 1956 after partition. The seat of the Federal Court was
at Delhi in India and in Karachi in Pakistan. There was a right of appeal to the Judicial
Committee of the Privy Council in London from the Federal Court of India.

AIMS & OBJECTIVES

 To understand the need for a Federal court in India to hear the final appeal in the
place of Privy Council.
 To understand how the First, second and the third table round conferences at London
paved the way for the establishment of Federal Court in India.

HYPOTHESIS

 The need to establish Federal Court in India was considered as a successful step
towards the proper functioning of judicial administration in India.
RESEARCH METHODOLOGY

The researcher in the project advanced would like to rely upon the doctrinal method of
research.
