Exhumation- Easy or Difficult to give justice to victims

Introduction

Exhumation or disinterment is the process of removal of remains of previously buried individuals for
medico-legal investigations, relocation or other purposes. These becomes absolutely necessary for a
second autopsy to be done to verify the cause of death or identify the deceased. Exhumation may also
be done if there are suspected foul play at time of death and later facts emanate as to the real cause of
death. In some cases, it may be needed at request of family to recover an object placed in the remains
and to rebury the remains at a different location.

Legal experts if done correctly and as early as possible, it is of critical value as evidence to secure
convictions, while delays have have helped accused get an acquittal as forensic analysis gets hit by each
day's decay. Foul play in cases of hurt and homicide is an established fact. People on basis of entimity
falsely charge their enemies; this practise carried out globally. The legal provision requires a magistrate,
district or judicial, to order an exhumation if necessary in a case.

Compared with conventional autopsy done imidetially done after death, exhumation poses many
problems.

Objectives of the study

This is to determine the cause of death of victims abducted as to aid justice to the relatives/nation and
assist the law enforcement agent to conclude their investigation.

Purpose of the study

The purpose of this study is to know the situation in the study area and to also know the factors which
make hinderance in providing justice in exhumed cases. By this study we are going to able to know that
autopsy done by untrained personnal leads to exhumation.

Research Question/ hypothesis

 What was the autopsy report


 What was the F.I.R
 What was view point of the deased relatives view point
 What was the exhumation report
 Comparision between the autopsy and exhumation report

Method

This research will be done by cross sectional study. The data will be based on secondary data
analysis,stastical data and different cases held in the area.
The sample for this study will be carried out from tehsil samani, tehsil barnala and district bhimber azad
kashmir. The sample verified from chief forensic expert from muzzafrebad.

The instruments that will be used in the study will include, interviews, police reports, autopsy
reportsself conducted cases.

Conclusion

This has to assist for a truce in mitigating of justice and end to the missing individuals.From this study
the casuality medical officer will be able highlight his/her mistakes or neglegance done in the cases. This
will also help to give justice to the deased relatives of the victims. This will also help the police
department to improve their investigation process. This will also help out the future researcher to
determine the homcidal and susidal cases and their tendency towards more homocidal or susidal or
poisionous cases held in the region. This will also help in terms of internal and external validity, and
discuss the implications of the study affecting victims, policies and scholarly/ future research.
