This is an example of a ³roll back´ warrant for a storage facility and a suspect¶s

warehouse (business) as a result of initial search warrants. The initial search warrant
would be attached; much like a police report would be attached for a search warrant, so
therefore there is no need to re write in entirety what lead the affiant to obtain the original
search warrant. I have provided a very brief narrative that would be beneficial to set the
stage for the roll back search warrant, but again is not entirely necessary. The ³roll back´
search warrant details what was discovered as a result of the service of the initial search
warrant(s), leading to the request of additional locations, persons, vehicles, etc. You
would add in any of the ³boiler plate´ language that would be applicable to this ³roll back´
search warrant.

On 09-15-10, The San Luis Beach Police Department obtained Search Warrants (attached
hereto as Exhibit No. 1 and incorporated as if fully set forth herein) signed by The
Honorable Judge Prosecutem for the following locations:

These Search Warrants were a result of a shooting that occurred at 22619 Birch Avenue ,
San Luis Beach and an attempt robbery that occurred at 2229 Pine Ave # A, San Luis
Beach. The common dominator for these two locations is victim Chris Smith. It was
determined that an acquaintance of victim Chris Smith , Ronald MacDonald, accused Chris
Smith of stealing a large amount of cocaine from Ronald MacDonald¶s residence in San Luis
Beach.

On 09-13-10, Ronald MacDonald arrived at Chris Smith¶s residence with two other
unknown suspects and handguns demanding money from Chris Smith. Chris Smith was in
fear for his safety retrieved a shotgun telling Ronald MacDonald to leave. Ronald
MacDonald and the other suspects fled the location. Chris Smith then called San Luis
Beach Police Department.

On 09-15-10, Mr. and Ms. Smith¶s house (parents of Chris Smith) was shot by at least three
suspects. San Luis Beach Police Department was able to detain and arrest two of the
suspects that fled the area. Chris Smith responded to the scene of the detention and
identified these two suspects as the same two suspects that accompanied Chris Smith on 09-
13-10.

Based on this and other information, I Detective Calhoun wrote a Search Warrant signed by
The Honorable Judge Prosecutem.

The following paragraphs detail why the ³roll back´ search warrant for additional locations
is needed.

On 09-15-10 at about 1830 hours, San Luis Beach Police Department executed the Search
Warrant at 6860 Oak Avenue, San Luis Beach. A knock and notice was given and no one
answered. San Luis Beach Police Department forced entry into the location and it did not
have any occupants. However, the information from Chris Smith was true and correct. Two
bedrooms inside the location did in fact have all the necessary equipment to support a
marijuana grow. However, the marijuana plants were not located there. The only remaining
items from the marijuana grow was hydroponic grow equipment (lighting, fertilization,
irrigation and by-products (clippings, twigs, etc.) from harvested marijuana plants.
Therefore, the plants were cut and transported to a different location leading detectives to
know and believe that information provided by Chris Smith was correct.
Detectives also found personal family pictures of Subject Ronald MacDonald inside the
house connecting him to this location.

On 09-15-10 at about 1900 hours, The San Luis Beach Police Department executed the
Search Warrant at 20504 Maple Blvd # 119 San Luis Beach. A search of the location
revealed no occupants.

A search of the location revealed personal documents belonging to Subjects Mary DelaCruz
(girlfriend) and Subject Ronald MacDonald showing that they lived there.

Furthermore, documents were recovered showing the address : 6411 SandDune Ave, San
Luis Beach where deliveries were being made. It is also noted that Chris Smith provided us
that address as a location that he personally knows as the location where narcotics would be
delivered to. Therefore, there is a great chance that the marijuana that was grown at the Oak
Avenue location could be located there.
Additionally, documents were also recovered showing a Public Storage Unit document in
the name of girlfriend, Mary DelaCruz dated 09-13-10. This storage unit was newly rented.
Therefore, this is another location that the narcotics could reasonably be located. All
documents were recovered as evidence.

It is my opinion that the information provided by Chris Smith has proven to be true.
Therefore, San Luis Beach Detectives believe that the evidence of Sales of Marijuana could
reasonably be located at the following addresses:

6411 SandDune Ave, San Luis Beach and


22222 Maple Blvd San Luis Beach. Unit 3163

These locations could also contain the weapons used in the shooting in The City of San
Luis Beach, your affiant requests permission to search for the items initially sought in the
original search warrant authorized by Judge Prosecutem.
