Subject: Re: Complaint Case against PT Sawit Mandiri Lestari

Dear Sir,
We refer to the complaint lodged by the Environmental Investigation Agency (EIA) and Jaringan
Pemantau Independen Kehutanan Kalimantan Tengah (JPIK Kalteng) on 5 June 2015, against PT Sawit
Mandiri Lestari (PT SML), subsidiary of PT Sawit Sumbermas Sarana, Tbk (PT SSS). The RSPO Complaints
Panel notes the following:
1. The implementation of actions plan
PT SML has implemented most of the points on the action plan based on the agreement signed by
the parties (PT SML, EIA and JPIK Kalteng) on 9 July 2015. The progress report had been submitted by
PT SML on 14 October 2015.
2. The ownership of PT SML
We refer to your formal email on 11 April 2016 in regards to the selling of PT SML in December 2015.
We note that the transition process to the new owner (a non RSPO member) will be completed by
the end of June 2016. Therefore, PT SML is no longer owned or controlled by PT SSS. Under such
conditions, the RSPO Complaints System is not applicable to PT SML as a non-RSPO member.

For these reasons, the RSPO Complaints Panel considers that that this complaint case is closed.
