1. That the above named petitioner filed the above case against the
respondent for recovery of remaining Jahaz Articles, Gold and Silver
Ornaments and Cash of Rs.2 Lakhs.
4. The mother of the petitioner tried to her best to convince the respondent
of his marital obligations by way of mediation and arbitration, but all her
efforts too turned futile.
5. Under the said circumstances the respondent had gone to the extent of
divorcing the petitioner by pronouncing Talak on 13.03.2016. After the Talak
the respondent and his elders prepared one agreement stating that the
respondent handed over Jahaz Articles, Maher and Iddath amount to the
petitioner. But the said date the respondent handed over some Jahaz Articles.
Mehar amount paid at the time of marriage. Iddath amount was not paid to the
petitioner.
6. The respondent did not handed over the remaining Jahaz Articles, Iddath
amount, Gold and Silver Ornaments and Cash of Rs.2 lakhs to the petitioner
till today. It is in the custody of the respondent. The respondent postponed the
return of above said on one pretext or the other.
7. I humbly submit that the Hon'ble Court directing the respondent to pay
Iddath amount and to return the remaining Jahaz Articles, Gold and Silver
Ornaments and Cash of Rs.2 Lakhs to the petitioner and also to pay the
maintenance to the petitioner till her second marriage.
So I pray the Hon'ble Court to send notice to the respondent and taken
on file in the interest of justice.
