DA Case No. 18021623 ‘The undersigned Detective Vargas with the West Jordan Police Department, in reference to agency case no. 18014162, upon a written declaration states on information and belief that the defendant, JONATHAN HUNT, committed the crimes of: COUNT 1 MURDER , 76-5-203 UCA, First Degree Felony, as follows: That on or about September 13, 2018, at 8040 South Redwood Road, in Salt Lake County, State of Utah, the defendant, as a party to the offense, intentionally or knowingly caused the death of Noe Luna; or intending to cause serious bodily injury to another, committed an act clearly dangerous to human life that caused the death of Noe Luna; or acting under circumstances evidencing a depraved indifference to human life, knowingly engaged in conduct which created a grave risk of death to Noe Luna and thereby caused the death of Noe Luna; or defendant engaged in the commission, attempted commission, or immediate flight from the commission or attempted commission of any predicate offense, or was a party to the predicate offense, and a person other than a party as defined in Utah Code Section 76-2-202 was killed in the course of the commission, attempted commission, or immediate flight from the commission or attempted commission of any predicate offense, to wit: Felony Discharge of a Firearm, and the actor acted with the intent required as an element of the predicate offense. NOTICE IS GIVEN that that dangerous weapon or a facsimile of a dangerous weapon or the representation of a dangerous weapon was used in the commission of furtherance of the crime, giving rise to enhanced penalties as provide §76-3-203.8, Utah Code Annotated, 1953 as amended. COUNT2 FELONY DISCHARGE OF A FIREARM WITH SERIOUS BODILY INJURY, 76-10-508.1 UCA, First Degree Felony, as follows: That on or about September 13, 2018 at 8040 South Redwood Road, in Salt Lake County, State of Utah, the defendant, as a party to the offense, discharged a firearm in the direction of any person or persons knowing or having reason to believe that any person may be endangered by the discharge of a firearm; or with the intent to intimidate or harass another, discharged a firearm in the direction of any person. Furthermore, the aforementioned violation caused serious bodily injury to any person. THIS INFORMATION IS BASED ON EVIDENCE OBTAINED FROM THE FOLLOWING WITNESSES: A.A, S.A, R. Baleras-Hemandez, F. Bardole, A. Curtis, 8. Elison, B.H, A. Hercules, A. Hofheins, S. Hutchings, A. Jeter, J. Kangas, T. Longmore, J. Lozano, B. Lucas, J. Monson, J. Richards, J. Robertson, L. Saavedra, B. Saavedra-Solano, T. Shepherd, T. Smith, R.C, N. Vargas, T. Webster, T. Wright DECLARATION OF PROBABLE CAUSE: Your Declarant, Detective N. Vargas of the West Jordan Police Department, based on information in report number 18014162, interviews of witnesses, and investigation by law enforcement officers, states as follows: ‘On September 13, 2018, at 12:36 a.m., law enforcement officers responded to Rancherito’s restaurant, at 7849 South Redwood Road in Salt Lake County, Utah, on a report of a shooting. Officers located a male, later identified as Noe Luna, with gunshot wounds to his, upper torso. Luna was transported to the hospital, where he later died. B.H. reported that he and Luna were seated at Rancherito’s when a male he knows as ‘Jay’, and an unidentified male, entered the restaurant and approached their table. Luna and Jay had been texting through Snapchat before Jay and the unidentified male arrived at Rancherito’s. Jay and the unidentified male appeared upset and argued with Luna. While BH. and Luna remained seated, the unidentified male punched Luna in the head. Luna stood up and the unidentified male yelled at Luna. The unidentified male pointed a gun at Luna and shot Luna two times. The unidentified male and Jay then ran out of the restaurant. S.A. reported that he was eating at Racherito’s when a visibly upset male, who he referred to as the shooter, walked inside. The shooter walked to the bathroom in the back of the restaurant for approximately 30 seconds before he walked out of the bathroom and out of the restaurant. Approximately two minutes later, the shooter walked inside the restaurant with a second male. Both males approached two males sitting at a nearby table. S.A. heard the shooter shout and saw the victim stand up. The shooter pointed a gun at the victim and fired two shots. ‘The shooter and the second male then ran out of the restaurant. B.H. was in possession of Luna’s phone and showed officers the Snapchat messages between Luna and Jay from the past several months. B.H. told officers that the incident was over a girl named “R.C.” Messages saved on Luna’s phone revealed that Jay was upset with Luna over R.C. B.H. showed detectives R.C.’s social media account. Officers spoke with R.C.’s mother, L.W., who confirmed R.C.’s social media account and identified one of R.C.’s friends as ‘Jay’ by his username and picture. She identified the male as JAYDAN OLSEN. R.C. stated that she previously dated OLSEN and was still friends with him. When detectives gave R.C. a physical description of the other male with OLSEN at Rancherito’s., R.C. stated that the description matched that of OLSEN’s friend, “JB” or “JP.” Officers responded to OLSEN’s residence and observed OLSEN and a male who matched the physical description of the shooter. The male with OLSEN was identified as JONATHAN HUNT. During a search of OLSEN’s vehicle, detectives located a loaded firearm under the passenger seat, which matched the description that witness, S.A. had given of the firearm used to ill Luna. The firearm had two rounds missing from the magazine.
