SANGGUNIAN DRAFT ORDINANCE NO.

169-2017
AN ORDINANCE ESTABLISHING THE TOURISTS TRICYCLE TRANSPORT FOR HIRE AND
PRESCRIBING THE GUIDELINES, RULES AND REGULATIONS FOR ITS OPERATIONS,
AND ACCREDITATION PURSUANT TO SECTIONS 36 AND 37 OF CITY ORDINANCE
NUMBER 494, AND PROVIDING PENALTIES FOR VIOLATIONS THEREFOR.

WHEREAS, Puerto Princesa City and Palawan now become one of the finest tourist
destination in the country either by local or foreign tourists;

WHEREAS, there are many tourists who like to avail the services of a tricycle for hire in
going to and from any tourist destination in the City of Puerto Princesa;

WHEREAS, the Local Government Code of 1991 Section 458, par 3, Art. 3
Chapter______ provides that……….(operation of tricycle) x x x x”

WHEREAS, pursuant to Section 36 of Ordinance No. 494 commonly known as the


Tricycle Code of Puerto Princesa City, a group of tricycle operators and drivers coming from
different Tricycle Operators and Drivers Associations organized and called themselves Puerto
Princesa City Tourism Hotel Frontliners under the direct supervision and control of the City
Tourism Department to serve as Tourism Frontliners for purposes of transporting local and
foreign tourists in the City;

WHEREAS, the aforesaid provision of City Ordinance number 494 is aimed to strictly
regulate and closely supervise tricycle operators and drivers catering to the transportation
needs of tourists to prevent abuse and overcharging of fares and such other acts that will place
the City in bad light that may drive tourists away;

NOW, THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of Puerto


Princesa in its session assembled, THAT:

SECTION 1. TITLE. This ordinance shall be known as "The Tourism Frontliner Tricycle
for Hire Ordinance of 2017".

SECTION 2. LEGAL BASIS - This ordinance is based on Sections 36 and 37 of City


Ordinance Number 494 otherwise known as the Tricycle Code of Puerto Princesa City.

SECTION 3. OBJECTIVES. This ordinance aims to strictly regulate and closely monitor
tricycle operators and drivers catering to the transportation needs of tourists visiting the City and
to provide the guidelines and regulations in their operation and accreditation by the City Tourism
Office of the City Government of Puerto Princesa.

SECTION 4. DECLARATION OF POLICY. It is the policy of the City Government to


have an efficient and safe transport system in Puerto Princesa City that shall serve the needs of
the fast-growing number of tourists arrivals in the City.

It is also the duty of the City Government of Puerto Princesa to implement measures that
will sustain and develop further the robust tourism industry of the City which provides jobs to
many people and an additional source of revenue for the City Government.

SECTION 5. DEFINITION OF TERMS. For the purpose of this Ordinance, the following
terms shall technically and operationally be understood to mean as:

1. TODA - Tricycle Operators and Drivers Association

2. Tourism Frontliners - a group of tricycle drivers and operators who cater


primarily to the transportation needs of tourists visiting the City of Puerto Princesa and are
regulated by the City Tourism Office of Puerto Princesa City
3. Tourism Related Establishments (TRE) – any commercial establishment such
as but not limited to malls, restaurants, resto bars, hotels, motels, pension houses, frequented
by tourist, local of foreign, and cruise ships docked at the Puerto Princesa City port, and
accredited tourist spots duly recognized by the City Tourism Office of the City of Puerto
Princesa.

4. City Traffic Management Office – an agency of the City Government tasked to


implement the Traffic Code and Tricycle Code of the City

5. Accreditation - shall mean recognition and approval by the Sangguniang


Panlungsod of Puerto Princesa City.

6. Cruise Ship – a large passenger ship docked at the Port of Puerto Princesa
City, usually of foreign origin, used for pleasure trip, and stops at different ports.

SECTION 6. QUALIFICATIONS OF TOURISM FRONTLINERS TODA. It shall be the


duty of the City Tourism Office to regulate and supervise one (1) Tourism Frontliners Tricycle
Operators and Drivers Association (TODA) as defined under this Ordinance, which must comply
with the following requirements:

1. It must be an entity registered with the Security and Exchange Commission


(SEC) or by the Cooperative Development Authority (CDA), or by the Department
of Labor and Employment (DOLE) as the case maybe.

2. It must be accredited by the Sangguniang Panlungsod of Puerto Princesa City.

SECTION 7. QUALIFICATIONS OF MEMBERS – any person engaged in the


transport of tourists as provided under this ordinances must comply the following qualifications
and requirements;

1. Must be a bonafide member of a duly recognized and accredited Tricycle Tourism


Frontlinern Association or TODA by the City Tourism Office;

2. Must at least have basic knowledge of the English language to be able to communicate
with foreign tourists. Knowledge of other foreign languages is an advantage.

3. Drivers must possess valid driver's license with appropriate restriction code, and his
name is listed in the records of the City Tourism Office (CTO);

4. Drivers and operators must have undergone or attended a lecture-seminar on the


following courses/topics:

a) Training seminar to be conducted by the City Tourism Office on the


conduct and manner in dealing with tourist-passengers;

b) Basic Road Courtesy and Discipline to be conducted by the City Traffic


Management Office;

c) Basic Right of Persons with Disabilities (PWD’s) as provided by the Magna


Carta For Persons With Disability" ( RA 9442 ) to be conducted by the
Persons with Disability Affairs Office (PDAO) or the City Social Welfare and
Development Office (CSWDO).

d) Basic Rights of Children and Senior Citizens to be conducted by the City


Social Welfare and Development Office.

SECTION 8. REQUIREMENTS AND GENERAL APPEARANCE OF TOURISM


FRONTLINER TRICYCLE DRIVERS. – Any person accredited as Tourism Front liner
tricycle drivers by the City Tourism Office (CTO), in addition to the requirements set forth
under the immediately preceding section, MUST:

a) Wear prescribed uniform and Identification Card issued by the City Tourism
Department while performing their duties and responsibilities to tourist-passengers.
b) Observe proper hygiene and good grooming at all times.

c) Comply with all rules, regulations and guidelines that shall be set forth by the City
Tourism Office.

SECTION 9. REQUIREMENTS AND GENERAL APPEARANCE OF TRICYCLE


UNITS.

a) Must have a valid franchise from the City Tricycle Franchising and Regulatory
Board (CTFRB), and a Mayor's Permit or Franchise sticker and City Tourism
accreditation sticker that must be attached on the windshield and;

b) Tricycle unit must be well painted with “BALAYONG inspired design”, sturdy and
not dilapidated, well maintained cleanliness and must be well decorated in
accordance with the standards set by the City Tourism Office;

c) Front sun visor must be attached to the unit with a width of six (6) inches painted
with yellow color and written with "TOURISM FRONTLINERS" in blue color;

d) Laminated authorized fare guide must be conspicuously displayed and visible to


the passengers inside the tricycle unit.

e) The tricycle must carry at all times a First Aid Kit and trash box/can.

SECTION 10 - INSPECTION AND ACCREDITATION. All Tricycle for hire accredited


under this Ordinance must have complied with the inspection requirement set forth by City
Ordinance No. 494 and must be certified to be roadworthy by the Tricycle Franchising Section
(TFS)

Thereafter, units that passed the inspection requirements shall be registered in the
registry of Tourism Frontliner tricycle for hire, including the names of the operators and drivers,
by the City Tourism Office and entered to the Data Base of Accredited Tourism Frontliner Units
and Drivers, to include all drivers who comply with the provisions of the preceding Sections
hereof.

SECTION 11- LIMITATION OF MEMBERSHIP. For the purpose of this ordinance,


membership of Puerto Princesa City Tourism Frontliners shall have an initial number of Two
hundred (200) accredited member-operator/drivers with a ratio of one (1) accredited
driver/operator per accredited unit. This number maybe increased or decreased subject to the
approval of the Sangguniang Panlungsod, upon proper recommendation by the City Tourism
Office.

Any registered /accredited member of tourism frontliner TODA who have tendered their
resignation or has ceased to be a member shall no longer be re-admitted to join the Tourism
Frontliner TODA.

SECTION 12 - EXEMPTION FROM THE 50-50 TRAFFIC SCHEME AND ZONING


SCHEME,. The Tourism Frontliners, unlike other tricycles for hire shall be allowed to operate
every day and cross over other zones as they are exempted from the provisions of Section 30 of
Article F of City Ordinance Number 494 which refers to the 50-50 traffic scheme, and Section
35 of Article G of same ordinance which refers to the zoning scheme.

SECTION 13 - BAN FROM PICKING UP PASSENGERS Tourism Frontliner tricycles


are prohibited from picking up passengers on their way to and from the destinations of their
tourist passengers, however, they are allowed to wait and/or fetch their tourist passengers from
their destinations and convey them back to their point of origin.

SECTION 14 -. AUTHORIZED FARE. For the purpose of systematic and quality service,
leading accommodations such as hotels and other tourism related establishments in the City of
Puerto Princesa shall be selected/designated by the City Tourism Department as point of
departure in coordination and approval with the concerned Tourism Related Establishments.

Initially, the following departure points with the following fare guide shall be strictly
observed by the members of Tourism Frontliners. The approved fare guide must be
conspicuously displayed and must be visible to the passengers inside the tricycle.

SECTION 15- POLICY MAKING BODY – The City Tourism Office with the proper
consultation with the persons and offices concerned, may at any time formulate additional
measures, rules and regulations and other policies necessary in the proper implementation of
this Ordinance subject to the approval of the Sangguniang Panlungsod.

SECTION 16 - PROHIBITED ACTS. It shall be unlawful for any tourism accredited


tricycle drivers/operators who violated the following acts and shall be subjected to penalties
provided under the next succeeding Section.

1. Those tricycles drivers who charged their tourist passengers more than the prescribed
rates provided under this Ordinance.

2. Those who picked up passengers on their way to and from the destinations of their
tourist passengers, however, they shall be allowed to wait and/or fetch their tourist
passengers from their destinations and convey them back to their point of origin.

3. Violation of Section 7, 8, and 9

SECTION 15 - PENALTIES. The Officers and members of Tourism Frontliners TODA


are enjoined and encouraged to police their ranks by formulating their own rules and
regulations. Any driver/operator who violates any provisions of this Ordinance shall upon
conviction pay the fines herein provided to the City Treasurer:

First Offense - - - P 1,000.00

Second Offense - - 3,000.00

Third Offense - - 5,000.00 plus the revocation of their


franchise and perpetual disqualification from acquiring any accreditation from the City Tourism
Office.

SECTION 16 - NO CONTEST PROVISION. Any person, natural or juridical, who


is apprehended or cited for violation of this ordinance, who does not wish to contest the
violation and is willing to pay voluntarily the fine imposed upon him/her prior to the filing
of formal charges with the proper court shall be allowed to pay said fine with the City
Treasurer to avoid being criminally prosecuted within twenty-four hours from
apprehension, otherwise the case shall be prosecuted.

SECTION 16 - IMPLEMENTATION. The City Tourism Department shall be the lead


agency in the implementation of this ordinance, with the assistance of the City Traffic
Management Office and the City Philippine National Police (City PNP).

SECTION 17- REPEALING CLAUSE. Any ordinances, rules, and regulations


inconsistent with any provisions of this Ordinance shall be deemed repealed, amended, or
modified accordingly.

SECTION 18 - EFFECTIVITY. This Ordinance shall take effect fifteen (15) days
following its publication in a newspaper of general circulation in the City of Puerto Princesa.
