CONFIDENTIAL
AMORNEY CLIENT WORK PRODUCT

Ijust wBnted to drop everyone a quick note to update you on some of our activities this week.

I had a good meeting with Vernon yesterday. My understanding is that the initial draft comments delivered to the
Directors office (frorn the staff) were not acceptable to the Directods office. Staffis revising the comments now.
Also, ADEM anticipates asking EPA for an extension to the comment period (Walter Coke has encouraged them
to do this as well).

With regard to the Pd ADEMs plan is to limit this activity to a file review ofthe ABC facility. Ihey did not
appear to be far along on this activity yet.

Lasdy, with regard to ADEM and Lance's reaction to the Governor's letter, etc - he is continuing to calm down
and be in a better frame of mind about this.

With regard to the technical action list for our comments on the listing Ron Thompson and David Burton from
or offrce completed the sit€ iN€stigetion regarding flooding and sediment transport this week and are
completing the technical drawings to support tlre fact that it is not feasible for sediment from the ABC area to
contaminate the proposed zuperfund site. We have been knee deep in document compilation and review
associated with the issues identified on the technical action list and anticipate providing a draft ofthe technical
review and work to you by the end of nq<t week.

Please let me know if you have any questions or need any additional information at this time.

Thanks, Trey
