do hereby voluntarily and expressly state that I am the duly authorized signatory and

hereinafter referred to as “Company”. That I have been authorized to execute this agreement
with GCLPI and bind myself and the Company with the terms and conditions hereto. I further
confirm that the Company and the undersigned are jointly liable in regard to this credit
agreement.

2) I/We agree to pay GATEWAY CONTAINER LINE PHILS. INC. the corresponding freight and other
related charges as they fall due in accordance with the approved credit term, prior to GCLPI
release of shipping documents and/or related shipments which have been granted credit under
this Agreement.

3) In case any account become due and demandable, I/We hereby authorize GCLPI all its exclusive
option to apply to the payment of our obligation any and all money securities, things of value
belonging to or due us from any source and which may be in GCLPI’s custody and possession and
hereby hold GCLPI harmless and free of such application payment. I/We also authorize GCLPI to
withhold the release of any original bills of lading of any of our shipment/s until all overdue are
fully settled.

4) I/We hereby agree to submit myself/ourselves to the jurisdiction of the courts of Metro Manila in
any legal action arising out this transaction. I/We further agree to pay GCLPI an additional sum of

not less than twenty percent (20%) of all unpaid accounts, but in no case less than Php 10,000 as
and for attorney’s fee in case of suit, in addition to costs.
5) I/We agree to use GCLPI prevailing conversion rate at the time/day of payment for PESO
payments of foreign currency accounts.

6) Any account that is not paid on its due date shall earn a penalty of 2% plus an interest rate of two
(2%) per month until fully paid. If account remains unsettled or is not fully paid after its due date,
the approved credit line will temporarily suspended until the account is fully paid.

7) Any breach of terms and conditions of this credit accommodation by me/us shall automatically
cause all unpaid invoices/charges to become due and demandable and shall be charged the
stipulated penalty of two percent (2%) plus interest of two percent (2%) per month.
8) I/We hereby certify that I/We caused the preparation of this application. That the information
contained herein is true and correct to the best of my knowledge, and that I/We agree to be
bound by the terms and conditions hereof in court of law.

9) That this Credit Application is valid only for a period of one (1) year and shall be subject to
evaluation prior approval of renewal.
