COMPLAINT-AFFIDAVIT

I, Angel G. Langit, Filipino, of legal age, and with

residence at No. 365 Maginhawa St. Brgy. Diliman, Quezon

City, after having been duly sworn in accordance with law,

hereby depose and state that:

(1) This complaint-affidavit is being filed to charge, Roland P.

Canin, Filipino, of legal age, and with residence at 178-F

Malibug Street, Quezon City, of the crime Rape under

Article (Art.) 266-A of the Revised Penal Code (RPC),

committed as follows:

(a) On 21 August 2017, after our class, at around 1:00 in

the afternoon, I am with my roommate and college

 classmate, Rachel Sy, at St. Claire’s Dormitory,

Matapang St., Quezon City.

(b) After we finished eating lunch, we proceeded to our

room to have some rest. Rachel told me that she would

go out at around 2:00 in the afternoon.

(c) Before Rachel left, I noticed that we had no drinking

water left so I told her to bring the empty water

container in the refilling station located one street away

from our dorm.

(d) I was so exhausted that I fell asleep that I did not notice

that Rachel left

(e) At around 6 in the evening, someone knocked on our

door. When I opened the door, it was Rolando Panis y

Canin alias “Rolly” with the refilled water container.

(f) Rolly barred the door, closed the light, whipped out a

sharp object and poked it against me and told me,

“huwag ka magingay, kung hindi papatayin ko kita!”

(g) Rolly then forced me to lay on the bed. Out of fear for

my life, I followed his orders. Rolly drew his short pants

down to his knees, and after lowering my underpants,

he inserted his penis into my vagina.

 (h)At around 6:30 in the evening, my mother suddenly

opened the door and saw Rolly on top of me.

(i) I pushed Rolly away and shouted, “Mama! Tulong!”.

Then, Rolly ran away.

(j) Appalled by what happened, my mother and I went to

the police station to report the crime committed by

Roland Panis y Canin Alias “Rolly” against my person.

The police took my sworn statement, a copy of which is

hereto attached and made an integral part hereof as

Annex “A”. Thereafter, I was examined by their medico-

legal officer. A copy of the Medico-Legal Report is

likewise hereto attached and made an integral part

hereof as Annex “B”.

(2) Hence I am personally filing this formal complaint.

(3) The elements of rape are the carnal knowledge, force or

intimidation, and the commission of the act without the

consent or against the will of the woman, or when the latter

is under twelve (12) years of age or when she is deprived of

reason or otherwise unconscious.

(4) Based on the foregoing, it is beyond cavil that respondent

Roland Panis y Canin Alias “Rolly” committed the crime of

rape punishable under Art. 266 of the RPC. He had sexual

 intercourse with me by inserting his penis into my genital

or anal orifice of another person.

(5) Further, whenever the crime of rape is committed the

penalty shall be reclusion perpetua to death.

August 22, 2017 with the following findings:

- deep lacerations at 3 and 8 o’clock positions due to

insertion of blunt item or instrument
- with emission of semen
