EXTRA JUDICIAL SETTLEMENT OF THE

ESTATE OF AAA

KNOW ALL MEN BY THESE PARTIES:

This Extrajudicial Settlement of Estate is made and entered into this _________
day of ______________, in Makati City, by and among:

BBB , of legal age, Filipino, widow, and residing at , Malate , Manila;

CCC, of legal, Filipino, married to GGG, and residing at Malate , Manila;

DDD , of legal age, married to MMM and residing at, Malate , Manila;

Hereinafter collectively referred to as “Heirs”.

WITNESSTH: That

WHEREAS, BBB is the surviving spouse of the decedentAAA , who died

intestate, not leaving any will or testament, on September 7, 2018, in Malate , Manila.
Copy of his Death Certificate is hereto attached as Annex “A”;

WHEREAS, CCC and DDD are brother and sister and only children of Spouses
AAA.
(“Sps. AAA” for brevity). They are both Filipino citizens, of legal age, and married.
Copy of their respective Certificates of Live Birth are hereto attached as Annexes “B”
and “C” and made integral part hereof;

WHEREAS, the property relation of Spouses AAA is governed by the

CONJUGAL PARTNERSHIP OF GAINS (CPG), they having gotten married before the
affectivity of the new Family Code, which took effect in August 1990. Copy of Sps.
AAA’s Certificate of Marriage is hereto attached as Annex “D”;

WHEREAS, at the time of his death, AAA and his wife BBB owned the
following real properties which are all located in the Philippines;

1. A parcel of land with improvements thereon located in the District of Malate ,

Manila with the following particulars:

With the assessed value of Php535, 420.00 for the land and Php105, 640.00 for the
improvement. Copies of the respective Tax Declarations are hereto attached as
Annexes “E” and “F”.

2. A parcel of land located in Barrio Marilao Bulacan , with the following

particulars:

With the assessed value of Php 357,320.00 under Tax Declaration No. 222-333-
444-, copy of which is hereto attached as Annex “G”.

WHEREAS, it is to the best interest of the parties hereto to dissolved Sps.AAA’s

Conjugal Partnership of Gains (CPG) and thereafter to divide, partition and adjudicate
among themselves, in equal share the other half (1/2) share pertaining to the decedent;

NOW, THEREFORE, for and in consideration of the foregoing premises, the parties
hereto agree to DIVIDE PARTITION and ADJUDICATE among themselves the afore-
described conjugal properties in accordance with the law on intestacy.

1. One-half of the two(2) afore described parcels of land shall belong to BBB as
surviving spouse of AAA;

2. The remaining one half (1/2) of the same listed properties belong to the estate
of the decedent shall be divided equally among CCC and DDD at one-third
(1/3) share each;

3. However, BBB cedes here one-half (1/2) share in the conjugal partnership of
gains under paragraph (2) immediately preceding, in favor of DDD, which
the latter gratefully accepts;

4. CCC also cedes his one third (1/3) share in the estate of his father in favor of
her brother DDD , which the latter gratefully accepts.

The above- named heirs hereby affirm that they have executed the foregoing instrument
of their own free will, without force, intimidation or violence upon their persons, and
that heirs proclaim that they have no claim or demand against each other.
