California Law Enforcement Officer’s Misconduct

Geoffrey Graves, a San Jose police pleaded not guilty in Santa Clara County Superior

Court to assaulting a lady when driving her to lodge to isolate her from her partner in a

household argument in September. He was charged at the Hall of Justice in San. Graves' accuser,

whom the prosecutor had not mentioned, did not report the supposed rape until Oct. 15, when

she related the episode to police while she was being set up for suspicion of DUI in San Jose

(Kaplan, 2018).

California's sexual assault law, also named as California's rape law, any form of touch on

a person’s intimate parts for purposes of sexual arousal, abuse or gratification is enshrined in

Penal Code 243.4 PC.

Sexual assault can be charged as either a felony or misdemeanour. Criminal punishments

may apply if the supposed victim: was unconscious during the act, was deceitfully convinced

that the act was done on professional basis; was unlawfully restrainedly; was systematized and

either therapeutically weakened or truly debilitated; or was compelled to jerk off or touch one of

your private parts or the private parts of an individual under the above-stated scenarios.

Conviction of a misdemeanour attracts a prison sentence of either six months or one year,

contingent upon the circumstances and a fine of up to two thousand (or up to three thousand

dollars if the victim was your worker). Conviction of felony subjects you to two, three or four

years in the California state jail and a maximum ten thousand dollars fine. Conviction of a

misdemeanour of sexual assault attracts a minimum ten-year necessity to enrol as a level one sex

offender. What's more, most felony offence convictions convey a lifetime prerequisite to enlist as

a level three sex guilty party.

Graves had offered in March to concede to one count of assault to avoid being sentenced

for enhancements that could have landed him in jail forever. In any case, investigator Carlos

Vega denied the offer, betting on a conviction. A not guilty ruling was delivered by the jury of

five ladies and seven men part 9-3.

We can credit the result of the case to the overwhelming defence by Deputy Alternate

Public Defender Kristin Carter, who gutted the validity of the supposed victim in her final

contention. Carter noticed that the lady was in the country illegally and did not report the

supposed strike until the when she was stopped three weeks for driving drunk, recommending

that she had consensual sex with the officer yet made up the assault to get a visa to remain in the

nation and evade the DUI. The case was decided in a fair manner.
