Transitory Provisions under the Proposed Federal Constitution

The Consultative Committee designed a transitory mechanism for the


smooth and orderly transition from a unitary form of government to a federal
system. As designed, the transition hinges on the Federal Transition Commission
headed by the President as chairman and ten (10) members who are natural born
citizens of the country and with proven probity, integrity, independence, and
expertise in the fields of economy, law, fiscal management, governance and
development. The President shall appoint the members upon recommendation by a
search committee headed by the Chairman of the Federal Civil Service Commission.

The Federal Transition Commission is mandated to complete its task up to


June 30, 2022 when the new set of elected national, regional and local officials shall
have assumed office under the new Constitution. It is basically tasked to formulate
and adopt a transition plan for the orderly shift to a new government under the new
Constitution. For the proper execution of plans, it shall promulgate rules,
regulations, decrees, orders and other issuances to implement and resolve disputes
that may arise therefrom. The transition plan includes the transition plans for the
different components of the federal government, national as well as regional, the
fiscal management and administration plan, and the establishment of mechanism
for the people’s participation in the transition. People’s participation shall include
the broadest socio-economic spectrum of the society.

The first national, regional and local elections under the new Constitution is
set on the 2nd Monday of May 2022 with the newly elected officers to assume on
June 30 of the same year. The term of office of the President and the Vice President
shall not be extended. All officials of government under the 1987 Constitution shall
continue to hold office under terms and conditions as may be provided in the
transition plan. Permanent employees separated from service are entitled to
separation pay, or retirement benefits. However, at the option of the employees,
they may be given preference in employment under the Federal government.
