EXTRA-JUDICIAL SETTLEMENT OF ESTATE OF ELENA DANDAN WITH DEED OF ABSOLUTE SALE KNOW ALL MEN BY THESE PRESENTS: This AGREEMENT, made and entered into by and among LUISA DANDAN ALVAREZ, of legal age, Filipino. Widow, a resident of P-3 Barangay Santa Cruz, San Jose, Province of Dinagat Islands. WITNESSETH: That | am the legitimate surviving compulsory heirs of the deceased mother ELENA C. DANDAN, who died intestate on at home, Barangay Wilson, San Jose, Province of Dinagat Islands. ‘That said deceased died intestate, without a Will or Testament, and without any outstanding debts in favor of any person or entity; ‘That the deceased left a parcel of agricultural land situated at Odoc Santa Cruz, San Jose, Province of Dinagat Islands covered by Tax Declaration No. 15-06-0011-00349 4" General Revision Pursuant to RA. 7160 in the name of Elena C. Dandan, consisting an area of 0.7960 hectare more or less, with the following boundaries; on the North by Policarpio Esmeralda; on the South by J. Gerandoy & P. Napol; on the East by C. Baltazar & Credit Coop., and on the West by Pedro Dealde; of which a portion of residential lot sold under this instrument is only 133.5 square meters, with the following boundaries; North by Nining Delos Reyes; East by Flora Redoble; South by Melven, and West by Sea. ‘That pursuant to Rule 74 Section 1 of the Revised Rules of Court, and all being with full capacity to contract, |, the surviving heir respectively, do hereby adjudicate unto ourselves the land described above, in equal shares; ‘That further, for and in consideration of the sum of FORTY THOUSAND PESOS ONLY (P40,000.00) Philippine Currency to us in hand paid to our full and entire satisfaction by ALLAN 0. SUAL and MARIA GINA D. SUAL, both of legal age, Filipino, husband and wife, and a residents of P-2 Bonifacio, Poblacion San Jose, Province of Dinagat Islands. The receipt of which is hereby acknowledge by the VENDOR to my full and entire satisfaction, the latter hereby SELL, TRANSFER, and CONVEY by way of ABSOLUTE SALE, a portion of residential lot which is free from all liens or encumbrances whatsoever, unto the said VENDEE, their heirs, successors and assigns, all our rights and interest over the above mentioned portion of lot.
