EXTRAJUDICIAL SETTLEMENT OF ESTATE OF THE LATE BRAULIO CALAMBAJJULITA D. CALAMBA WITH DEED OF ABSOLUTE SALE OF SHARE LAND KNOW ALL MEN BY THESE PRESENTS: ‘This AGREEMENT, made and entered into by and among LORETA CALAMBA PEPITO, of legal age, Filipino, married, to RODULFO R. PEPITO, and a residents of P-4 Barangay Gamao, Bayogan City; WITNESSETH: THAT- WHEREAS, Braulio Calamba, died intestate on at Caraga Provincial Hospital Surigao de! Norte, whereas in our mother Julita D. Calamba, died on April 8, 2015 at Luna, San Jose, Province of Dinagat Islands, leaving a certain agricultural land located at P-1 Luna, San Jose, Province of Dinagat Islands, consisting of (16,923) square meters, with Transfer Certificate of Title No. 2698 and Lot # 12, PSD-13-006351 (AR) as surveyed for Julita Doydoy vda. De Calamba, boundaries, on the N. Along lines 10-1 Lot # 13, PSD-13-006351 (AR), E. ‘Along lines 1-2-3-4-5-6 Creek/Lot #7, PSO-13-006351 (AR), S. Along lines 6-7, Lot # 11, PSD-13-006351 (AR), S. Along lines 7-8 Lot # 11, PSD-13-006351 (AR), SW. Along lines 7-8 Lot # 11, PSD-13-006351 (AR), and W. Along lines 8-9-10 Road 10 M. Wide, PSO-13-006351 (ARI, for being 2 portion of agricultural land consisting an area of (1,300) square ‘meters, with the following boundaries; on the North by Ronie Calamba, on the South by Lelie Calamba, on the East ‘by Calamba-Remaining portion, and on the West by Municipal Road. This property is covered by Tax Dec. No. 15-03 (0010-00466 4" General Revision Pursuant to RA. 7160, in the name of Braulio Calambs ‘Whereas, LORETA CALAMBA PEPITO, is the sole and only legitimate legal heir of the late Parents entitled to succeed to her estate; WHEREAS, it isto the best interests of the party hereto to divide, partition and adjudicate by and among, themselves the entire above-described land in equal shares invoking Section 1, Rule 74 of the New Rules of Court, subject however, to contingent liabilities to creditors, heirs or other persons who might have been deprived of lawful participation in the estate of the decedent, for the period of two years from and after the settlement and distribution thereof pursuant to Section 4, Rule 74 of the Rules of Court; and That in the remote event that any ‘other property of the decedent should ever be found which is not herein included, the parties hereto further agree ‘as they do so agree to settle and distribute the same in like manner and proportion as above established ‘That for and in consideration of the sum of FIFTY THOUSAND PESOS ONLY (P50,000.00) Philippine currency, Jn hand paid by the VENDEE, BOBBY C. BRONCANO, of legal age, Filipino citizen, married, a resident of P-6 ‘Mahayahay, San Jose, Province of Dinagat Islands, the receipt of which is hereby acknowledge by the VENDOR to his {ull and entire satisfaction, the latter hereby SELL, TRANSFER, and CONVEY by way of ABSOLUTE SALE the portion of agricultural land which is free from all liens or encumbrances whatsoever, unto the said VENDEE, his heirs, legal successors and assigns.
