EBOL, surviving wife, Filipino citizen, widow, RIZALINA EBOL TINACO, daughter of legal age, Filipino citizen, married to GREGORIO C. TINACO, JR,, of legal age Filipino, single, and a residents of P-3, Barangay Magsaysay, Dinagat, Province of Dinagat Islands, \WITNESSETH. ‘That we are the legitimate surviving compulsory heirs of the deceased husband Pacifico Ebol, who died intestate on Cctober 18,2005 at P-2, Barangay Magsaysay, Dinagat, Surigao del Norte. ‘That said deceased died intestate, without a Will or Testament, and without any outstanding debts in favor of any person or entity; ‘That the deceased left @ parcel of coconut land situated at Magsaysay, Dinagat, Province of Dinagat islands covered by Tax Declaration No. 15-03-0011-00706, 4 General Revision Pursuant to R. A. 7160 in the name of Pacifico Ebol, consisting an area of 0.5998 hectare more or less, with the following boundaries; on the North by Primitivo Ebol; on the South by Inocencia Gillo; on the East by River, and on the West by Public School Site; of which a portion of residential ot sold under this instrument is only 120 square meters with the following boundaries; North by Ebol- Remaining portion, ‘South by National Highway, East by Florue D. Pinero, and West by Ebol-Remaining portion; “That pursuant to Rule 74 Section 1 of the Revised Rules of Court, and all being with full capacity to contract, we, the ‘surviving heirs respectively, do hereby adjudicate unto ourselves the land described above, in equal shares; ‘That further, for and in consideration of the sum of THIRTY THOUSAND PESOS ONLY (P30,000.00) Philippine Currency to us in hand paid to our full and entire satisfaction by MARIO S. MALATE and MELIZA J. MALATE, both of legal age, Filipino citizens, husband and wife, and a residents of P-5, Barangay Cuarinta, San Jose, Province of Dinagat Islands. The receipt of which is hereby acknowledge by the VENDOR to our full and entire satisfaction, the latter hereby SELL, TRANSFER, and CONVEY by way of ABSOLUTE SALE, a portion of residential lot which is free from all liens or encumbrances whatsoever, unto the said VENDEE, their heirs, successors and assigns, all our rights and interest over the above mentioned portion of lot.
