PABE, of legal age, Filipino citizen, married {to ELENITA E. PABE, and a residents of P-7 Mabini Poblacion San Jose, Province of Dinagat Islands; \WITNESSETH: imate surviving compulsory heirs of the deceased father Pedro Fabe, who died intestate on 01, November 2005 at home, in P-7, Mabini Poblacion San Jose, Surigao del Norte; ‘That said deceased died intestate, without a Will or Testament, and without any outstanding debts in favor of any person or entity; ‘That the deceased left a parcel of residential land situated at STA. Cruz, San Jose, Province of Dinagat Islands ‘covered by Tax Declaration No.15-06-0011-05131 4" GR in the name of Pedro Fabe, consisting of (0.9535) square meters ‘more or less, with the following boundaries, on the North by Leonarda De Arnigo; on the South by Gregorio Masaya, on the East by Gaudiosa Pegarro, and on the West by Esmeralda, for being a portion of residential lot consisting an area of (150) square meters more or less, with the following boundaries on the North by Maria Victoria Gall; on the South by Leo Melan; fon the East by Dalmacio Diez and on the West by Maricel Cambaya; ‘That pursuant to Rule 74 Section 1 of the Revised Rules of Court, and all being with full capacity to contract, | hereby adjudicate unto ourselves the land described above, in equal shares; That further, for and in consideration of the sum of ONE THOUSAND PESOS ONLY (P1,000.00) Philippine Currency to Us in hand paid to our full and entire satisfaction by ANTONIO B. MACALUA and ERLINDA D. MACALUA, likewise of legal age, Filipino, husband and wife, with residence at P-4, Santa Cruz, San Jose, Province of Dinagat Islands. The receipt of which is hereby acknowledge by the VENDOR to our full and entire satisfaction, the latter hereby SELL, TRANSFER, and CONVEY by way of ABSOLUTE SALE, a portion of residential lot which is free from all liens or encumbrances whatsoever, unto the said VENDEE, their heirs, successors and assigns, all our rights and interest over the above mentioned parcel of land.
