ORDER

Accused Jake Bunayag and Lorito Nacionales, when arraigned, duly

assisted by the Public Attorney’s Office, both of them pleaded not guilty.
Pre-trial will be on July 25, 2018 at 2:00 o’clock in the afternoon. Issue
subpoena to private complainant Cresanto Pundaog, 150 Paclar St., 6th
Division Patag, Cagayan de Oro City, to be served by the Process Server.

ORDER

There being no plea bargaining, the pre-trial is terminated. The

prosecution will present the private complainant, the doctor and two (2)
reserved witnesses. While the defense will present five (5) witnesses
including the accused. The parties will mark their exhibits during the trial
proper. Initial trial will be on September 11, 2018 at 8:30 o’clock in the
morning.

Issue subpoena to Cresanto Pundaog, 150 Paclar St., 6th Division

Patag, Cagayan de Oro City, to be served by the Process Server.

Anent accused Lorito Nacionales, who is 86 years old, a resident of

Bugo, Cagayan de Oro City, the defense counsel manifested that he be
allowed to post a bail of P20,000.00 cash bond. Over and above objection of
the prosecution, the motion is granted. The bailbond therefore for the
temporary liberty of accused Lorito Nacionales only is P20,000.00 cash
bond provided that he will not be the bondsman.

PROVISIONAL DISMISSAL

Acting on the manifestation of both parties, this case is provisionally

dismissed with the consent of accused JAKE BONAYOG and LORITO
NACIONALES.

The office of the Clerk of Court is directed to release the bailbond put
up by accused JAKE BONAYOG and LORITO NACIONALES covered by
Official Receipt No. 4682671 issued on July 27, 2018 in the amount of
P20,000.00 (Nacionales) and Official Receipt No.4683078 issued on August
8, 2108 in the amount of P30,000.00 (Bunayog), to their bondsman.

SO ORDERED.
