‘COMES NOW the undersigned Affiant, a peace officer under the laws of the State of Tex after
having been duly sworn on oath, deposes and says that Ihave good reason to believe and do believe
that CEDRICK JOSEPH MARKS committed the offense of BURGLARY HABITATION WITH INTENT TO
COMMIT OTHER FELONY as charged inthe complaint to which this Afidavitis attached and that my
belief in the foregoing is based on the following information.
JOHN LEACH, AM A CERTIFIED PEACE OFFICER FOR THE STATE OF TEXAS CURRENTLY
EMPLOYED WITH THE TEMPLE POLICE DEPARTMENT, GELL COUNTY, TEXAS. PURSUANT TO MY DUTIES,
{VE BEEN ASSIGNED TO AN INVESTIGATION INTO A REPORT OF BURGLARY HABITATION WITH INTENT
TO COMMIT OTHER FELONY IN WHICH THE SUSPECT IS CEDRICK JOSEPH MARKS. PURSUANT TO THIS
INVESTIGATION | HAVE REVIEWED ALL OFFENSE REPORTS AND WITNESS STATEMENTS MADE IN
CONNECTION WITH THIS INVESTIGATION.
I WOULD ADVISE THAT ON AUGUST 21, 2018, around 8:51 AM, Temple Police Department
officers were dispatched to 7708 Redbrush, Temple, Bell County, Texas, for a domestic disturbance call
after a woman came to the police department and reported that her ex-boyfriend had broken into her
house. Jenna Kay Scott reported that her and her ex-boyfriend both had open investigations against
each other for assault family violence crimes that were pending in Killeen, ell County, Texas. Jenna
identified her ex-boyfriend as Cedric Marks (DOB: 7/15/1974). Jenna stated that on August 21, 2018,
she was at her residence with her daughter, UNNI 2ying in bed, when she heard the house alacm
announce “garage door,” which wes an indication thatthe garage door leading into the residence was
open. Jenna went tothe living room to see who was in the house and saw Marks in the residence,
though he was not supposed tobe there and had no consent to come into the home. Jenna stated she
had her phone in her hand, but Marks took her phone and threw it out of reach. Jenna then stated she
yelled for her daughter, to call 91, but Cedric tld her to have JIA hang up her phone. Jenna then
told WMI hang up her phone and to side the cellphone under the door. Jenna stated Marks then
told her that itis “your word against mine” and that he has friends atthe Killeen Police Department.
Marks told Jenna "you know what | am capable of... your entire family and al of your fiends will need
witness protection if you call the police.” Marks then told Jenna that he knew he had charges pending
and she needed to drop them. Jenna provided police officers with a doorbell video from August 21,
2018, The video shows a men identified as Marks appraaching the front door of the residence and then
walking out of sight, cowards the garage. The video istimestamped 9:21 AM.
Jenna's daughter nine-year-old, IMM was interviewed at the Child Advocacy Center regarding
what she observed on August 21, 2018. SIMBM reported that she heard her mother yell “call 911, he's
here.” @HMNNE stated her mother told her to stay in her room, but she heard her mother yeling, “help!”
am stated she called 911 and then her mother told her to hang up the phone and slide it under the
door.Officers collected information from 911 dispatch, and it confirmed that SMM phone made a
911 call on August 21, 2018 that was dropped. 911 dispatch then attempted to call her back multiple
times, the first call taking place at approximately 9:23 AM.
WHEREFORE, PREMISES CONSIDERED, YOUR AFFIANT REQUESTS THAT A WARRANT ISSUE FOR
‘THE ARREST OF THE SUSPECT IDENTIFIED ABOVE FOR THE FELONY OFFENSE DESCRIBED ABOVE.
