PETITION

COMES NOW the Petitioner, by the undersigned counsel and

unto this Honorable Court, respectfully avers that:

1. Petitioner is 25 years of age, single, Filipino and a resident

of 331 V. Rama Ave., Cebu City, Cebu, Philippines;

2. Respondent is a government official whose functions include

the custody of birth records as well as registration thereof.
Respondent is holding office at Gaisano Capital South
Building, corner of Colon St. and Leon Kilat St., Cebu,
 Philippines where summons and other court processes can
be served;

3. Petitioner was born on January 25, 1994 in Cebu City, Cebu

and duly recorded in the Local Civil Registry of Cebu City as
evidenced by the Certificate of Birth issued by the Local Civil
Registrar of Cebu City herein attached as Annex “A”;

4. Petitioner has made herself known to the public for the past
twenty-five (25) years and continues to do so as REAH
PEREZ ANDRINO, as shown by her school diplomas and
documents. Attached herein and made integral part of this
Petition are her College Diploma issued by University of
San Carlos marked as Annex “B”, and her Voter's
Certification as Annex “C” and made integral part hereof;

5. Recently, Petitioner secured an authenticated copy of her

birth record from the Philippine Statistics Authority. Attached
and made an integral part of this Petition is the Certificate of
Live Birth of REAH PEREZ ANDRINO marked as Annex “D”;

6. To the dismay of the herein Petitioner, it appears that her full

name in the Certificate of Live Birth is REAH PEREZ which
is different from her known name and the one entered into in
her Certificate of Birth issued by the Local Civil Registrar of
Cebu City which is REAH PEREZ ANDRINO;

7. Petitioner has been using the name REAH PEREZ

ANDRINO in all her records and documents pertaining to
her. Up until the discovery of the inconsistency, she has
been using the said name in all of her transactions;

8. In order to avoid confusion and to straighten the entries in

her birth record, Petitioner filed this instant Petition in order
to have the erroneous entries rectified and further reflect her
correct name which should be entered as REAH PEREZ
ANDRINO:

9. Petitioner has no derogatory record in his character as

evidenced by the clearances issued by the proper authorities
herein attached as Annex “E”and “F”, and, respectively;
 PRAYER

WHEREFORE, it most respectfully prayed that, after the due

notice and publication, and hearing, this Honorable Court adjudge
and order herein Respondent to effect the rectification of the Birth
Record of REAH PEREZ pertaining to the entry of her full name from
REAH PEREZ to REAH PEREZ ANDRINO.

Other reliefs just and equitable under the circumstances are

likewise prayed for.

I, REAH PEREZ, of legal age, single and a resident of 331 V. Rama

Ave., Cebu City after having been duly sworn in accordance with law,
depose and state that:

1. I am the PETITIONER of this case

2. I have caused the preparation of the foregoing complaint;

3. I have read the contents thereof and the facts stated therein are
true and correct of my personal knowledge and/or on the basis
of copies of documents and records in my possession;

4. I have not commenced any other action or proceeding involving

the same issues in the Supreme Court, the Court of Appeals, or
any other tribunal or agency;

5. To the best of my knowledge and belief, no such action or

proceeding is pending in the Supreme Court, the Court of
Appeals, or any other tribunal or agency;

6. If I should thereafter learn that a similar action or proceeding

has been filed or is pending before the Supreme Court, the
Court of Appeals, or any other tribunal or agency, I undertake to
report that fact within five (5) days therefrom to this Honorable
Court.
