    JOINT MOTION TO SEVER AND STAY CLAIMS AGAINST DEFENDANT


    TOYS R US

    COME NOW THE PARTIES and for this Joint Motion to Sever and Stay Claims

    against separate defendant Toys R Us state the following.

    On September 20, 2017, separate defendant Toys R Us filed with the Court a

    Notice of Suggestion of the Pendency of Bankruptcy. (Dkt # 421). Based on the pending

    bankruptcy, the parties have agreed that separate defendant Toys R Us should be severed

    from this matter and all claims as to it should be stayed. This Motion seeks Court

    approval of this agreement.

    WHEREFORE, PREMISES CONSIDERED, the parties respectfully request that

    all claims as to separate defendant Toys R Us be severed and stayed.
