Description of Service
This service enables customers to sue in First Instance for
all kinds of requests (eviction, monetary claims, handover
of documents to turn them in to Authorities, lease
renewal, rent claim, termination of lease in force, and
return to the premises previously evicted from for
demolition and reconstruction)

Required Documents
1. A copy of lease (Ejari) and previous leases.
2. A copy of plot map or new Title Deed issued by Dubai Land Department.
3. A copy of certificate of ownership if the leased premises are located in Freehold
areas.
4. Personal data (landline, mobile, email).
5. Details of leased property, its type and Makani Number (if available).
6. A copy of the Landlord’s passport along with residence visa (for expatriate) and
Emirates ID.
7. A copy of the Tenant’s passport along with residence visa (for expatriate).
8. A copy of Commercial License if the lessor is a legal entity (company or
establishment) and a copy of license holder's passport.
9. A copy of Notice along with notification officer’s report or Registered Post along
with receipt of Notice acknowledgement in case of monetary claims.
10. Proof stating contractual relationship between Lessor and leasing office, lease
or management contract in force.
11. Portfolio (sequential evidence stating validity of lawsuit such as:
correspondence، notices، irregularities، DEWA bills or others).
12. Lessor’s Notice to Lessee through Notary Public or registered post.
13. A copy of “Offer and Deposit” receipt (if available).
14. All documents must be submitted in or translated legally into Arabic.
15. A copy of inheritance certificate for heirs if (lessor) is deceased.
16. A copy of Power of Attorney attested by Notary Public for legal agent and
Emirates ID.
17. A letter from bank or bank statement mentioning Plaintiff’s IBAN (International
Bank Account Number) in case of monetary claims.

In addition to the documents required for all types of requests (Eviction Claim Registration)
Customer may choose one of the requests
1- File an eviction lawsuit over failing to observe any obligation imposed on the
Lessee by the Law or any of the terms of the Lease
2- File an eviction lawsuit over making a change to the Real Property
3- File an eviction lawsuit over the Real Property being condemned
4- File an eviction lawsuit over using the Real Property for a purpose other than
that for which it was leased
5- File an eviction lawsuit for urban development purposes in the Emirate
6- File an eviction lawsuit over leaving the commercial Real Property unoccupied
7- File an eviction lawsuit over wishing to repossess
8- File an eviction lawsuit over failing to pay the rent
9- File an eviction lawsuit for having agreed upon terminating a Lease in force
10- File an eviction lawsuit over subleasing the Real Property
11- File an eviction lawsuit over restoration or comprehensive maintenance
12- File an eviction lawsuit to demolish the Real Property to reconstruct it or to
add any new constructions
13- File an eviction lawsuit over using the Real Property for any illegal purpose or
for a purpose which breaches public order or morals
14- File an eviction lawsuit for selling the Real Property

Required documents
Lessor’s Notice to Lessee to fulfil the obligation or term within 30 days of its receipt
Lessor’s proof stating this by a technical report issued by or attested to by Dubai
Municipality.
Petition report of “Determination of Fact” stating the duration of abandonment and its reason
- Lessor’s Notice to Lessee through Notary Public or Registered Post twelve (12) months prior to the
date set for eviction.
- Proof stating that Lessor or his/her relative do not own an appropriate alternative property.
-A copy of Notice to pay served by the Lessor upon the Lessee.
- Lessor’s Notice to Lessee to pay through Notary Public or Registered Post (30) days prior to file a
lawsuit.
Termination agreement signed by both the Lessor and the Lessee or their authorized
signatories.
Proof (petition report) stating that the Lessee has subleased the premises (Determination of
Fact).
- Evidence stating that the condition of the Real Property is verified by a technical report issued by or
attested to by Dubai Municipality.
- Lessor’s Notice to Lessee through Notary Public or Registered Post twelve (12) months prior to the
date set for eviction.
- Lessor’s proof stating this by a technical report issued by or attested to by Dubai Municipality.
- Lessor’s Notice to Lessee through Notary Public or Registered Post twelve (12) months prior to the
date set for eviction.
Petition report of “Factual Determination” by the competent government authorities.
Evidence stating the seriousness of sale
- Lessor’s Notice to Lessee through Notary Public or Registered Post twelve (12) months prior to the
date set for eviction.

2- File a lawsuit obliging to reimburse utility charges
3- File a lawsuit claiming taxes as stipulated by the lease
4- File a lawsuit claiming fine for dishonoured cheques
5- File a lawsuit claiming rent increase
Submitting cheques and bank’s cheque return memo in addition to the capacity of signatory of cheques
and his/her relationship with the Lessee.
Evidence stating that the defendant refuses to pay maintenance charges of the leased property though the
lessor is supposed to undertake (it).
Evidence stating outstanding taxes in terms of premises at the time of lease.
Submitting cheques and bank’s cheque return memo in addition to the capacity of signatory of cheques
and his/her relationship with the Lessee.
The clause referred to in the lease stating the fine to be imposed upon the Lessee
A copy of Rental Increase Calculator index taken from Real Estate Regulatory Agency – RERA website,
stating the rent in the area, and copies of previous contracts, if they were renewed, in order to determine
the starting date of the first contract and the last rent increase.
