Legal Exercise:
Specifically, Proclamation No. 572, Series of 2018, revoked the amnesty granted to
Senator Antonio Trillanes IV, "effective immediately,” declaring it void ab initio for “non-
compliance with the minimum requirements set forth in the Amnesty Proclamation.”
In this issuance, the President ordered the Department of Justice and the Armed Forces
of the Philippines (AFP) "to pursue all criminal and administrative cases" against
Senator Trillanes in relation to the Oakwood mutiny and the Manila Peninsula incident,
which happened in 2003 and 2007, respectively. The President also ordered the
Philippine National Police (PNP) and the AFP "to employ all lawful means to apprehend"
Trillanes so that he can be recommitted to his previous detention facility, the PNP
Custodial Center.
In January 2011, Trillanes, who was then a duly-elected senator of the Republic, formally
applied for amnesty – within the application period. He was included in the list of
officers and soldiers officially granted amnesty that same month.
Your law office has been engaged to provide legal services to Sen. Antonio Trillanes IV.
You are a member of the legal team who has been assigned to this case.
In not more than 2,500 words, printed on legal-size paper (8.5 x 13), draft a
Memorandum of Law discussing the relevant legal issues, as well as the applicable law
and jurisprudence regarding the issuance of Proclamation No. 572, Series of 2018, dated
31 August 2018.
You should submit your Memorandum of Law to the School of Law Office not later than
5.30 p.m. on Tuesday, 18 September 2018. We will conduct Constitutional Law Review
class from 5.30 p.m. to 8.30 p.m. on Tuesday, 18 September 2018.
