RE: FOIL – Town of West Seneca

Dear Mr. Warren:

In response to your e-mail dated January 27, 2019 requesting all documents, e-mails,
correspondence, estimates, requirements, memos and minutes related to the conversion of the
water districts in the Town of West Seneca from a leased managed to direct service with the Erie
County Water Authority (the “Authority”) from January 2015 to date, please be advised that
there were no documents responsive to your request during the period of January 20015 to date.

Nonetheless, we have attached several documents that predate January 2015, relating to
the proposed conversion of the water districts in the Town of West Seneca from leased managed
to direct service. Those documents are described as follows:

(1) A letter, dated August 23, 2011, from Wesley C. Dust, P.E., the Authority’s
Executive Engineer to Richard Henry, P.E., West Seneca Town Engineer, containing
sample agreements with the Town of Hamburg;

(2) Emails exchanged between January 3 and January 5, 2012 relating to projects to be
completed before the Authority would consider providing direct service to certain
West Seneca residences;

(3) Email exchanged between February 26 and February 26, 2013 relating to a New York
State Efficiency Grant Proposal submitted by the Town of West Seneca to improve its
water system;

(4) Resolution adopted on March 7, 2013 by the Authority’s Board of Commissioners


relating to a New York State Efficiency Grant Proposal submitted by the Town of
West Seneca to improve its water system;

(5) Letter of Transmittal, dated March 8, 2013, with a certified extract from the Minutes
of the Meeting held on March 7, 2013, relating to a New York State Efficiency Grant
Proposal submitted by the Town of West Seneca to improve its water system;
