Sale With Assumption of Balance
This DEED, made and entered at Mandaue City, Philippines and between ALEXANDER
LIMPIADO ILIGAN, of legal age, Filipino, single with residence and postal address at Unit
1Oprra, Kalunasan, Capitol Hills, Cebu City and hereinafter called the VENDOR,
And
DISCORO SEGUERRA BARGAMENTO, JR. of legal age, Filipino, single with residence and
postal address at Sitio Bahadas, Tabunok, Talisay City, Cebu. and hereinafter called the VENDEE;
WITNESSETH
WHEREAS, the VENDOR is the registered owner in fee simple of that certain property with all the
improvements existing thereon, situated at _____________________ covered by Original/Transfer Certificate of
Title No. _________ of the Register of Deeds of _____________, and more particularly described as follows:
TECHNICAL DESCRIPTION
LOT 35 DUPLEX
Boundaries:
WHEREAS, the VENDOR has offered to sell and the VENDEE has agreed to buy the above-described
land with all the improvements thereon for the total price of FOUR HUNDRED THOUSAND PESOS (P
400,000.00);
NOW THEREFORE, for and in consideration of the sum of FOUR HUNDRED THOUSAND PESOS (P
400,000.00) has been paid to and the receipt whereof is hereby acknowledged by the VENDOR, the said VENDOR
does hereby SELL, TRANSFER and CONVEY, in a manner absolute and irrevocable, unto the VENDEE, his/her
heirs and assigns the real property above-described together with all the improvements existing thereon, free and
clear of all liens and encumbrances;
The VENDEE does hereby accept this sale and binds himself to assume as he hereby assumes the payment
of the unpaid balance of the house and lot of the vendor amounting to
______________________________________________(P________________) as of this date in favor of the 77
Living Spaces, Inc. in which he should be pay the amount of NINETEEN THOUSAND, THREE HUNDRED
NINETY PESOS AND SEVENTY FOUR CENTAVOS (P 19,390.74) until___________________ and does hereby
further agree to be bound by the precise terms and conditions therein containd;
The VENDOR shall secure the approval of the _____________ to the assumption by the VENDEE
of the balance over the subject property; and
After the full payment of the property to ___________ and Title to the said property be issued to the name
of the VENDOR, the VENDOR shall cause the transfer of the Title’s name under the VENDEE.
IN WITNESS WHEREOF, the parties have hereunto set their hands and signed these presents on the date
and at the place first above written.
ACKNOWLEDGEMENT
BEFORE ME, a Notary Public for and in the above jurisdiction, this 21 ST day of FEBRUARY 2019,
personally appeared the following persons:
known to me to be the same persons who executed the foregoing Deed of Sale with Assumption of Mortgage
involving the sale of house and lot, which instrument consists of _____ pages, including the page on which this
acknowledgement is written and signed at the left margin of each and every page by the parties executing this
instrument and their witnesses and sealed with my notarial seal and said parties acknowledge to me that the same is
their free and voluntary act and deed.
